  1. Reviving the thread - filed for citizenship this January and have my interview set to April. Hoping for a quick turnaround for the oath as well!
  2. Just make sure you received your NOA for you N-400 and on that letter there's your extension of two years from your green card expiration, no need to sweat if it's gonna be done in 4 or 7 months then!
  3. Then you were very lucky, lots of people wait ages for I-130 or I-485 approval. ROC are lowest priority and have been slow for years now. USCIS only deals with people going through the legal process so even if your assumption was true this makes no sense. Asylum claims (which is a legal immigration path) are not affecting anyone's ROC process. If applying for citizenship is something of interest, N-400 are flying off the shelves these days and can be done in tandem with I-751.
  4. I can see the interview notice from USCIS and a second notice from the local office named for me and my partner on my USPS informed delivery but it hasn't been delivered yet. Marked for Saturday, I really hope it comes through today!! By the looks of it, since it's from the local office and names my partner I am assuming is an in invitation for a combo interview but I can't be sure until it's delivered. Don't let me down again USPS!!
  5. Yes, that's how it is supposed to be. You are not working without authorization while on F1 and receiving a PhD stipend, it's just how it is structured with universities - you received a W2 and that counts for income for the IRS and USCIS, but the university will still claim you're not an employee when it comes to workers rights, unionization etc. So just list the university as an employee for the PhD then your postdoc institution in the employment section, with the correct dates. For clarification for others: It is a grey area only for universities because they don't want the claim as employer but trainee, nothing more. That stipend money is also declared with tuition costs on your I-20, if I recall correctly. There's a possibility of having a job up to 20 hours/week on campus that will pay you on top of your stipend and that's legal as long as you follow the protocol at your school for it, mine didn't allow more than 10 hours/week for example, but it is within the legality of the visa.

  7. It does not, the processes can happen simultaneously. But you won't be approved for the N-400 until you have your I-751 approved as well. It's been 5 years, so way way past normal processing times. Edit: I see your renewing your ADIT stamp yearly, that's good. You can start your N-400 process, including all your marital changes but please go after your I-751 while you're at it. Start with USCIS for an inquiry about being out of processing times, escalate to your local representative, etc. Sometimes even the filing of the N-400 helps move the I-751 along but you need to figure out why it's been 5 years and your still stuck at biometrics taken with no other movement in that process. https://egov.uscis.gov/e-request/displayONPTForm.do?entryPoint=init&sroPageType=onpt
  8. That's exactly it. You're writing paragraphs in perfect English, there's nothing that will trip you up. The sentences are similar to the questions on the civis test, as you will have to read " who was the first president" and write "the first president was George Washington". Don't overthink it, it's one phrase each.

  10. It's hard to follow your story because you said you became a citizen through marriage but now wants to file for a green card for your ex-wife. So you married wife A, both of you not US citizens. Divorced wife A, married wife B, she was a US citizen and got you your citizenship. Now you are thinking of remarrying wife A, is that it? Besides extra scrutiny to clarify you didn't just married your wife B for citizenship purposes I don't see why not. Be prepared to prove your marriage to the US citizen was genuine and that you're not just trying to get citizenship for your non US wife. If you knew your non US wife before obtaining citizenship that will be another hurdle to prove you didn't marry just to get yourself and your first partner a US passport.
  11. Got my citizenship interview scheduled for April 11, no mention of ROC and my case is still on "received on Jan 23" status. Will be prepared for a combo, I also used the template and added to the N-400 application.

  13. Interview scheduled for April 11, hooray! I was worried about an interview later in the year due some health issues but since it's going to be next month that won't be problem. This is the first time USCIS actually scheduled something in my favor lol
  14. You should have a 4 year extension on this GC based on your I-751 application. If I would travel internationally while trying to straighten things out with USCIS is a different issue.
  15. Woo! My received date is the 22, if I could get the interview done before May it'd be a great help for me, this gives me hope!
  16. You will receive a two year extension on that green card with the application for citizenship, so the process can go for much longer and she will still have a valid green card in hand.

  20. Honestly I fail to understand what status or work authorization you were here for 4 years after graduation. While the EB1 was being processed, is it like an AOS that you have "authorizied stay"? If you had any income, was it through what type of job/visa? These questions are not just curiosity but for clarity on what type of ban if any you'd be under when you leave the US.
  21. Extremely unlikely you will be granted a non immigrant visa after applying for a green card. I don't think you have many options here, EB1 has certain criteria that you either meet or you do not and if even with an appeal you got denied that is it. Your time in the US is coming to a close, OPT is attached to the school somewhat and it is for immediate employment after graduation, that ship has sailed.
  22. It might just take time, i wouldn't worry about it. The most common thing at the moment is for the biometrics to be reused but if it's not on your account you just have to wait until they send you something.
