Today, after a full year from when I submitted my application, I received a RFE. The ridiculous part is that they say in the letter that I’ve sent what they wanted but it’s not sufficient because it was relevant to the year prior, and not for the year 2021..how was I supposed to have documents for the year 2021 when I filed at the beginning of the year 2021? This is taking way too long and I’m getting upset over it…
Not to mention they sent the letter for my biometrics at the wrong address even if I had done my due diligence and updated it on their website, and I couldn’t attend the appointment because the letter came after the scheduled date…It was November 2021. I finally had my biometrics rescheduled in February 2022…
I’m so over this whole process, it’s been years of uncertainties and wasted time and money.

Huzzah! We have an interview scheduled for April 18! We called the (mis)information phone number to find out the interview date/time because we have had mailing issues and we wanted to make sure we were aware well in advance when the appointment would be.

The work permit has still not been adjudicated and so I asked if that will be paused since the I-485 interview is scheduled. The support agent said no, they’ll continue processing because it will likely be a couple months after the interview before a decision is made on the greencard.

does that sound right?! I keep seeing y’all say approved right in the interview.

we’re so ready to be complete with this process, but if nothing else I really want to file our joint tax return and we’re waiting on an SSN to do that unless we really have to pay an accepting agent to apply for an ITIN (we’re adjusting from a B visa, couldn’t have gotten a SSN upon arrival).

    friendly thoughts/suggestions?

An update for fellow April filers...we had our interview today. The interview was quick and casual, although we prepared a lot for it. Our officer asked us some questions to confirm from the form followed by some history of how we met and how many times ( we are adjusting from K-1). She asked to see photo ids and passport. Then asked for any evidence we have to prove our relationship. We told her we had originals and copies, she asked to see copies only.
We provided joint health insurance, work beneficiary confirmation, lease page showing husband as occupant, joint bank account statement, airline ticket from a trip we took, Airbnb reservation, and photos.
She kept all the copies. Then said we were done and that she doesn't need anything else from us. She would review and then update status.
We left all smiles and hugs. We walked out of the building checked the status no change. Walked about 10 minutes to the train stop and checked again, this time it was updated to " New card being produced".

Yaaaay! And just like that we are hopefully done for the next two years!

Then repeat for ROC! Good luck all! This group has been a major morale support.

This gives me both a little bit of hope and also a little bit of despair. I’m hoping they are able to get through biometric backlogs faster than adjudication. We applied in April, still no biometric appointment.

XenophiliusPDX got a reaction from Timona in I applied for advance parole I-131, but I need to travel in the immediate future. What should I do if my advance parole application is still pending?
Wouldn’t any interaction with USCIS beg the questions about unauthorized work in the United States? If you’re still a director abroad but working here on a B visa pending AP (so presumably still pending EAD). Unauthorized work by a spouse of a USC is forgiven, but would it create complications?

these are not meant to be pointed questions, rather asking to understand for my own situation, too.

XenophiliusPDX got a reaction from Chancy in I'm on tourist visa and get married in US how's the process
Everyone’s situation and journey is different. We had filed the I-129F, it was approved, and on our first visit in the United States our situation and intentions changed. Just after a month of being together thanks to a visitor visa, we decided to marry and stay together and adjust status. There was no intent to bypass the normal process, we were following it. But given all the things going on in the world, when we decided to marry after being together for several weeks, our intentions changed. In our situation we were already engaged. In others situations, they don’t even meet their fiancé until during a visit. I think the morally important thing is that available avenues are pursued with integrity and honesty.

But my readings here tell me that intent is determined at the border by the CBP. If they determine that the intent is to use an issued visa for its correct purpose and then the situation changes, that is what adjustment of status is for. It is unnecessary to have a system that places the burden on the pending immigrant to show that what CBP determined was correct was in fact correct.

We FINALLY have an appointment at Homeland Security!  10 months to the day after filing the 485 and 765!  It has been a long haul!  Has anyone noted any significant changes in procedures or processing since last year??

We got biometrics' done on 7-7-2021 as scheduled. Although Jeigh did not have any issues others did not go so well. Missing or incorrect paperwork got some of them sent away.
On another note, the actual biometrics here in Birmingham are done by a third party company. Let's just say...they did not have any bedside manners.
From constant ordering of the people in line to STAY IN A SINGLE FILE LINE, take ONLY the papers I need to see from the file; to "SIR" I did not ask for your paperwork yet as he sat the papers on the desk. I was even scolded for having a tablet out to keep my 1 year old son occupied.
I guess some people like there jobs more than others....
