  1. Hello guys! Our AOS package is almost ready, as a lot of you the I944 is the one who is giving me some headache, on the education skills I'm gonna send my high school diploma to be translated and do the educational equivalent since it also shows I studied english. Where I'm having doubts is my certification, I'm a certified massage therapist in my country, but here in CA, it as is own council who issues the licenses and certificates. I pretty much would have to go through school again to gain a license from one of the approved schools, so I'm just gonna translate my certification and write a letter about why I didn't do the equivalency, and of course my comprise to gain my license through one of the approved schools by the council. Do you guys thinks this is a good approach?

    Any input is greatly appreciated

You're lucky that you managed to get married at all, many people have issues finding a county clerk that is still open, and they only have 90 days.. You're doing very well in that regard. 👍

We were almost in the same situation but we already had our appointment schedule since February but then, they cancel everything because of the pandemic, but then again they send us an email to have like an emergency wedding only if we were interested and follow the directions, so we of course took the chance, which we are so glad we did.

    You're correct.

It's not needed until the interview.

Minimum requirement is a photocopy of the marriage certificate.

    Everything else is optional.

I sent my MC and about 10 wedding photos for giggles.

Thank you! Maybe I will send a couple ones from our wedding but I dont have much lol since the pandemic we were only allowed to marry in front of a window outside the courthouse with no witnesses or family and straight home after due the lockdown haha

  4. Hello! I'm gathering all the documents to send my AOS, I have notice most applicants also send evidence like photos and the lease together etc, but I can't find any source that states this evidence is needed? I thought all this proof was needed for the interview, can somebody please tell me how you decided what extra evidence you need to send with the AOS

    Thank you!

    Btw I'm adjusting from a K1 visa

Fingers crossed that with the restrictions on who can go in, they are still going ahead with it. Keep us posted.

Welcome to the USA!  Wishing you many happy years here with your spouse to be.

Thank you so so much! We had to cross sonner due the restriction ban they are gonna implement with Mexico starting today, which we don't know k1 are exempt.

We will definitely keep you guys posted and hopefully we can get marry in a few weeks.

Future income cannot be used to support you now. Neither can past income. They will care about current income first. At the time you present the I-134, it needs to show the petitioner's current income...that is how much they are earning at that time. The past income may be considered for the public charge piece as well, but current income is what is required.

If you are close to the poverty level for your household size it may be wise to seek a co-sponsor for now. The I-134 is not binding, and they do not need to use the same sponsor (or any other sponsor at all) for AOS after marriage.

Thank you! So if I'm understating right he should multiple his current income x12 and that amount is the one he need to write in the annual income?

Can I ask another question? On the question, beneficiary children, should he write both of my children? Or only the k2, since our child in common is already listed on the dependant section.

    Thank you for your time!

    Current income annualized

    Thank you!!

  7. Hello! My fiance and I have a doubt regarding the I-134, the question annual income, should we provide the 2019 income or the 2020 expected income?

My fiance have the 2019 tax documents ready(w2, transcripts, paystubs)

He also have the 2020 pay stubs so far.

We are above the 125% with the 2019 taxes and is gonna be even higher 2020.

    Thank you for your time!

"They" don't change anything. Unless I am missing something. You are in control of the DS-160. So create a new one and begin to use it for fingerprinting and the interview. The DS-160 is accessed by the confirmation number. If you present the new confirmation number that is the DS-160 that will be used, including at the fingerprinting. Your making this much harder then it needs to be. I'm giving you the answer and you want to keep going around it. I am confused why that is.

Understood. Sorry a little bit of panic and a lot of overthinking. I will create my new ds160 and  call it a day. Thank you!

Create a new DS-160. Check the box single and don't present any type of lease. Let sleeping dogs lie. DS-160 is for the interview unless instructed otherwise. Your objective here is to present yourself as single, willing to marry within the 90 day window that starts once you arrive in the US. That is what is required for a K-1 visa. Do what is asked and not what isn't. No where in any instructions does it say to present a lease contract. I hope this helps. Hank_ may have some additional points.

Thank you! Here in Mexico they ask for the confirmation page of the DS160 when you present yourself for the fingerprints appointment, so I will take the new one with me and will see if they can change it or wait till the interview with the CO.

  10. @Hank_ @Greenbaum

Thank you for your replies! I can't reopen or change the ds160 at this point on the website, so I will create a new one, my doubts are

Should I check the box for common law marriage? Or just single ( I will bring our uptade lease contract for the interview )

This new confirmation page, I need to present it also to my fingerprint appointment? Or just to my embassy appointment with the CO? My common sense tells me straight to my fingerprint appointment so they can make the change right?

Thank you for your time and orientation.

  11. Hello! I have my k1 interview in a few weeks, me and my fiance live together,  I checked the box for domestic partnership as my marital status, I want to know is this was a mistake? Since we send our lease contract for our house back when we file for the I-129F I though this was the correct box for me to check. Am I wrong? :(

edit* we are from Mexico going to Ciudad Juarez embassy

  12. I had the same issue when trying to pay, the first payment was accepted (k1) but for my k2 the page keep saying the card was rejected, fiance call is bank and still nothing, he ended up login in the website when he got home and make the payment through his computer with another card and that one actually was accepted.
