I honestly think it might complicate your case. If your vawa is approved and standing by for aos adjudication I wouldn't recommend you looking in the direction. You can renew your ead combo card for usual travel and work in the US.

    Hope this input helps.

Thank you and I think the same now....

@sandranj what would you think on apply for dv lottery while AOS is pending under approved I-360?

Well I went with mine and it was definitely requested!👍

    Thanks @Stillwinning!!!😊 you are awesome.

just to ensure and apologies for asking: the tax returns were not submitted as part of I-485 and thought it’s not needed to submit them or take to the interview. I did submit joint tax return when was filing I130/485 wth ex abusive spouse). Did officer asked for them and reviewed them during your interview? How meticulous are they? My tax returns a bit messed up bc of divorce.

I864w is the waiver for affidavit of support, abstract of marriage is basically the original document which shows you and your spouse's names and date of marriage only. Not sure if you need that. The certificate will do. You also don't need the i864w also as it's not required. You basically want to go with your original documents..personally I went with my marriage certificate, birth certificate, drivers license, recent 3yr tax documents, employment verification letter, passport, i-94 document, EAD card. If you are divorced, be sure to go with the decree too.👍

Thank you so much - do we need to bring tax returns? Only asking as thought they are only required for naturalization Interview and if attending interview with a spouse.

Oh okay just.. take all the documents showing the prenup and Divorce with you also I took with me (originals). Officer took the divorce decree to update my file.

    all passports

    , birth certificate,

I-94, proof of Income and tax returns do I-864w ( just to be safe)

    Medical examination

    Driver license

    All EAD cards

    divorce Decree

abstract of marriage, certificate of mariage

    bills, pictures and bank statements.

As a reminder officer only asked me my spouse name. But nothing about my past marriage or abuse.

but interview was very tricky specially about yes or no question. Please review the I-485 that you sent read and remember what you said.

something I remember also is traffic ticket take with you any court related traffic ticket. The officer took it and asked me if there was anybody injured in the accident I was into, thanks God the response was no.

from that point I knew USCIS knows every little thing about us

Wow thanks a lot for sharing.

did you take all your past traffic tickets or officer pulled them somewhere? What type of questions from I485 were asked and I assume it’s only I485 that is attached to I360 And NOT to I130?

yes AO made copy of divorce decree and gave me the original..

    I went to Cleveland,OH

Wow thank you for sharing and congrats again!

what other documents did you take with yourself and why did officer take your divorce decree? I am asking as my divorce decree looks messed up given I had to pay my ex spouse for his attorney fees and also we had prenup. I just wanted to have this all finished with divorce as he was torturing me.

I wish all of you to get approve on I-360 and I-485. This journey was super super hard for me but I always believe in the power of the ALMIGHTY. You just need patience lots of patience and keep praying.

Thank you all, good luck to all, if you have any question I'll be here. Thank you @Stillwinning!!!😊 for those late night PM and reply thank you for supporting me. You are an Angel.

So happy for you so much! Did you happen to seek help from government? My timeline started in Nov 2018 and having I-360 approved in April 2020. Had courtesy letter in August and still no word on interview...

Did he keep divorce decree with himself?

What city did you have interview at?

You just have a priority date if your spouse is a green card holder. If you filed form I-765 category C9 in July then you are good.

The IB1 is the immigrant class of admission, it means when you obtain your green card the  USCIS will specify IB1 as you class of admission.

Thanks @sandranj I believe what I brought up before is that C14 EAD needs to be constantly renewed to maintain deferred action status because the deferred action letter attached to approved I-360 says one has to prove “economic necessity” to get it. Though is this deferred action really needed if one is in AOS like me now? It’s valid for 15 months.

May I suggest you stop worrying about what hasn't happened yet? So many people here had same notice as you..didn't even renew C31..only renewed c9 and are still on course! Nobody is going to deport you..you will be fine! We can expanse on this matter all day still doesn't change anything! I never renewed my C31 either..I had lots of plans lined up but pandemic struck! Nobody knows what tomorrow will bring..sufficient for the day is it's own problems!😊👍

Thank you again @Stillwinning!!!😊 and @Pinkrlion. You are amazing and apologies as I definitely worry too much but keep praying.

Only C31 has anything to do with deferred action not C9. If you read the notice it says USCIS reserves the right to issue it or not to..at least mine says so..again renewal of C31 is what reinstates your deferred action status just like the notice says!😊👍

sorry @Stillwinning!!!😊 just googled around and found below - it seems to have the deferred action extended one has to get C14 EAD ONLY. I only keep thinking about deferred action because with current I-485 wait times - 15 months can be not enough. My case was approved in April 2020 and still no word for interview besides courtesy letter on medicals. Also confused why we need a deferred action thing if our I-485s are pending which are AOS and allow us to stay in the US legally.

will keep C31 renewed / up to date then to avoid the risk of being deported

You're welcome..the priority date doesn't have any influence on the pace of your case. We pretty much all got the class IB1 thingy..self petitioning spouse of a USC/LPR. When you renew your c31 yes your deferred action status is reinstated. No wrong or right regarding c9 or c31..c9 renewal is free..c31 is not..you can choose to renew one of them or both..it's a personal decision..I personally chose c9👍

Understood - to ensure i get it @Stillwinning!!!😊: renewal of C9 (based on VAWA's I-485) will extend the deferred action for me and why some receive it and so do not?

  12. 33 minutes ago, Stillwinning!!!😊 said:

The receipt date of your i485 not your i360 is the priority date! I got the deferred action grant too as many others..this is just to keep us protected as low priority for removal pending when we adjust status..it usually lasts for 15months giving us ample time to adjust status..you're perfectly in order..no worries!😊👍

Thank you again. As @Pinkrlion just said - July 2017 is the priority date of my marriage petition (I-130) and marriage I-485 which were filed concurrently? Does it give me any estimated time for VAWA I-485 interview and why priority date is from marriage case (it was withdrawn by my abusive spouse)?

Last question: the approval letter says that i will need to file for EAD renewal to maintain the deferred action status - do you know if its only C31 or C9 is good too? Filed C9 extension in July 2020. Is this "Deferred Action" notice good or bad as understood not everyone receives it?

Does anyone know what "Class: IB1" is? seeing it in the approval notice.

  13. Friends - having I-360 approved in April and notice received 3 months later in July.

I filed for vawa in November 2018 but priority date shows July 2017 on the approval notice. Do you know why there is a time difference and what priority date stands for? Also what is “Class: IBI“?

Lastly, 2nd page of approval notice says about “Initial Grant Deferred Action”. I don’t think I am part of deferred action and why is it there? To be clear - I am awaiting for I-485 interview.

God bless all and thank you so much in advance

I know...I’m not in alarm mode but I just wanna be cautious/proactive I guess. I don’t want my file to get lost in NBC while I’m waiting for an interview spot in local office :)

thx for your reply btw :) Idk how you still make the time for this thread even though you already got your GC :)

If I received the courtesy letter on medicals - does it mean my I-485 is at NBC already? I-360 approves in July 2020.

  15. 10 hours ago, Stillwinning!!!😊 said:

I can't influence or inform that decision...you may try both like I suggested.😊

:) sorry if I ask to many questions here. My current “online priority date” from uscis website for I-485 interview scheduling is July 2017. I filed I-360 and I-485 in Nov 2018. I-360 got approved in Jul 2020. Would this make sense for me to reach out to government if “online priority date” is not near current?
