    my lawyer initially said no need to rush as there is no deadline and CIS sends it to everyone. Couple months ago she said its rough times in immigration now and better to sit tight. again i have anxiety about this. I dont know maybe I should just respond myself. I paid lawyer and now she is just being slow on anything

    About two weeks after I send a response. The status changed to "...we received your response to our Request for Evidence for your Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant, Receipt Number...... USCIS has begun working on your case again. We will send you a decision or notify you if we need something from you....".

    Before I responded to the initial rfe. My status read something like they will not work on my case until they receive a response to the RFE and the days from the time they send the rfe continued counting. After I send the rfe they updated my status to response to rfe received. I haven't received a prima facie yet. Hopefully I get one soon. It's still early to get worried. Its been less than month since they received my response.

    If you can still respond to their initial rfe i suggest you do so. I dont think its wise to fail to respond to any letter from uscius. What if this prolongs your case processing?. Please work on it. Since they never gave a deadline I suggest you work on it.

    I listened to my lawyer. They tell CIS sends it to everyone and no need to respond as will cause only more scrutiny. I don't know. Hard to get lawyer to do anything as she has "higher" priority deals. Worrying me a lot.

  3. have anyone receive initial request for evidence for prima facie (good moral character and good faith marriage) with NO deadline and did you reply to it? I got mine a year ago and still did not reply. Will clock stop ticking until after I provide a response? Again, it's not like an official RFE (Notice 797E and etc). Just a letter. Usually official RFEs are detailed and specify what exactly CIS needs. This letter is different.

    would you mean if someone gets married during removal proceedings - its roughly 20% approval? Will judge make the decision in this case?

    Uscis is not obligated to issue RFE anymore, it’s discretionary now .Tell your attorney that she/he should read more often about  the U.S Immigration  Laws.

    Do you feel replying to initial evidence request for Prima Facie after a year it was received is okay? Based on my current timeline, I should get the I-360 decision in November 2020.

    Agree with you and that is why I dont get it why my lawyer is so slow. I paid the full amount for service so am stuck with this lawyer.

     

    What is this blue receipt and I did not get any prima facie.

Detail punch in the face-where when it happen what lead to it what happened after. If she called u names but wasn’t physical express how it made u feel what state of mind it put u in ect. 

    Thank you Gi Gi!  Are you in this with a help of lawyer? Most time I feel I can do it myself. My lawyer is always busy (deportations, courts and etc). Feels like she does not care about a case until it get really bad.

    Thank you guys. I much appreciate it. My lawyer's reasoning is that the more is provided the more CIS will ask for and question. I feel like lawyer is causing me more pain than the case itself. My case has so much evidence of abuse but I don't know why it is not provided to CIS.

     

    Another question: I am a male. Would you believe CIS treats male cases equally as female cases without sexism?

  10. Applied for vawa (I-360, I-485, I-765 and I-131) in Nov 2018. Did not submit a lot of documents and no affidavit. Received initial request for evidence to quality for prima facie  couple months after (in Jan 2019). 2 things requested to provide more evidence for were GOC and good faith marriage. USCIS phrases it "you are invited to provide".

     

    Attorney is telling me to not care about initial request for evidence but wait for official RFE to provide more proof / documents. 

     

    What are your thoughts, community? I have a lot of proof but am told to wait until RFE and disregard initial request for evidence for prima facie (I will not be using public benefits even if have it).
