    Got it :) sorry for my ignorance but what is NOA and do i understand 100% correct that i need to reach out to U.S. Congressman and Senator (not State)? Found their websites and believe can fill out request forms there.

    As for correspondence address if i am asked - should i give congressman / senator my or my attorneys office address? Reason is that my attorney receives USCIS correspondence.

    @Stillwinning!!!😊 how reaching out to Congressman / Senator might interfere eare with lawyer’ work? Should I notify my lawyer before reaching out to government?

    Thank you. @Stillwinning!!!😊 - I am in similar situation (have C31 and hopefully will get AP renewed) but I filed fo asylum. However, then withdrew it and USCIS confirmed my withdrawal. With this - can I travel back to my home country? 

    Back in a day - a lawyer told me to travel back only when get an American passport..

  5. Dear Frields...awaiting for my I-485 interview. I-360 approval was in July 2020.

     

    Received courtesy letter saying that they miss my medicals In Aug 2020. 

     

    Latest status update online for I-485 was: “We received your fingerprint fee for your Form I-485, Application to Register Permanent Residence or Adjust Status. Your case is now properly filed“ AND “fingerprints relating to your Form I-485, Application to Register Permanent Residence or Adjust Status have been applied to your case.”

     

    Does anyone know what is this “fingerprint fee”? Also - last time I did fingerprints it was like in Fall 2018 (more than 2 years). Are my fingerprints likely expired and I will need to retake them before interview?

    Yeah I got a notification from my USCIS account saying so and it gave 3 reason as to why they did it

    Can it be that maybe you just being approved without interview and what are the 3 reasons? Also how long has been the waiting time since I-360 approval?

    Yes it will update to interview is scheduled and they'll send you the letter with the date, time and place. Sometimes they don't bother to update! But I monitored mine through my rep. I was the one who told my attorney when they'll be receiving my interview letter..lol. I didn't take any chances..I got a copy of it from my senator. You can do the same..👍

    may I please ask: when USCIS sends an interview notice to me - will online status of my case on uscis website change / update accordingly? I just want to ensure to know / be aware that uscis sent me the interview notice. Mail letters go to my lawyers office and unfortunately not having complete trust with them.

There would have been more chances of approval without interview if your medicals were intact and with USCIS..we've not established for certain why some cases are approved without interview but there's more chances if the documents are complete and no further clarification is needed from the petitioner!💁

    learnt to trust my gut feeling as was trying to convince my attorney to send do and send medicals in advance to enhance chances for “no interview” approval. Her stance was to just wait and provide things when USCIS asks for them. Well...having a good attorney is a blessing which wish was my case. Thanks again.

Is there any legal information if anyone knows: if vawa I-360 is approved (like in my case) - can it be revoked / rejected if trump signs a new immigration executive order (which he will soon) and it will include removal of vawa for immigration purposes? Know that it will be related to “merit based immigration” but still..
     

    I don’t know what to expect from ongoing immigration changes and if trump stays in the office longer...

     

    I am just praying and waiting for the interview...my case was approved 2 weeks ago. Long wait for the I-485 interview to come...

    Thank you so much! i think i made a mistake in my 2019 return and put parents which i support as dependents and made myself a head of household. just found that they are not eligible as not living in the us, canada or mexico. will amending the filing / or calling them to disregard the filling if at all allowed  will fix it in the irs records or irs will come back with an audit (i still did not get my return due to covid yet)? cpa was not accurate and did not provide me with right info. my parents are quite old and i was supporting them but irs seems does not allow it for tax purposes.

     

    My last question - if one had unlawful overstay of few months (3-6) will that disqualify from i-485 through vawa? reason asking is that a note "visa overstay" was put in the i-485 application but i entered the usa all legally on h1b visa. basically a unlawful gap between my ex-wife withdrawing i-130 and my filing for vawa was less than 2 months (this seems to be the overstay)

  14. Friends - would anyone know if VAWA is considered to be "married to US citizen" and waiting period for naturalization is 3 years? Also, learnt that naturalization requires 3 years of past tax returns if "married to US citizen" green card is held. Would you advise please if this is correct and how much scrutiny is given to past tax returns.

Its just a guess (based on articles talking about major reduction of USCUS staff) that maybe if they decide to waive your interview at some point you will get medicals RFE and then they will just mail you the GC. It's unlikely, but possible - it's been happening a lot to people applying for employment and marriage based cases.

    I received C31-based EAD February 2020, approval notice March 2020, then courtesy letter April 2020 (meaning April my case has already been processed by NBC). Then in June 2020 I inquired with my congressman on case status and USCIS responded that it's still pending in NBC? Why? No clue. But you can find our where yours is through congressman, takes about 2 weeks.

    thank you so much for being so helpful. Wondering how did you go about contacting congressman..did you just call their office and provided necessary data? Did you do it after certain waiting point? I received my c31 ead in April and still not change to I-360 status but my filing/priority date is nov 2018 and uscis technically reviewing July 2018 filings now per their website. Also - what did courtesy letter say? I am in Houston too and wonder how your process went so quickly from ead 31 to nbc - very happy for you
