    In this process a lot of it has to do with luck too, just like @RachelBounty mentioned, there doesn't seem to be a pattern to how they approve/move along with things. I think that everyone who has had their EAD's approved should be very very thankful nonetheless.

    Make sure that once your case has passed the "estimated" time to be approved for the EAD that you put in a service request, that will for sure get things moving and your EAD will get to you guaranteed.

    Thank you! It was literally less than two hours. I got up in the middle of the night to use the bathroom and checked my phone and saw the best notification. Then, I couldn't go back to sleep out of joy and I was playing with my phone and less than 2 hours later it changed again! 

  2. Hello everyone! So nice to read all your updates! On to my case, we received a RFIE for birth certificate and I-864 asking us for a joint sponsor (not because we are not above poverty line, but because we messed up by sending tax account information instead of return). We also included my husband's employment verification letter and four months of paystubs, to prove that we don't need a joint sponsor. They received our response on Jan. 30th. When do you think we are going to get the "interview ready to be scheduled" update?

    Because a part of the RFIE (which I didn't copy here) asked for my birth certificate. I did include it in the original submission, together with a translation. However, I made the translation with a translator from my home country, who didn't know the format for USCIS and made it too crammed and technical. So I ended up having a translator from the USA doing it, and I looked for one that knew the USCIS format. 

  4. So, our response consists of the following:
    1) The original letter that the USCIS sent us.
    2) A cover letter that lists: a) what is required of us; b) what we are presenting. This letter is signed by sponsor (hubby) and applicant (me).
    3) A copy of form I-864 (edition date 03/06/2018) with the correct household size).
    4) Hubby's 2 w-2s and IRS tax return for the most recent tax year (2018). This time we're sure that we are sending tax RETURNS instead of ACCOUNT transcripts lol
    5) Copy of birth certificate in original language.
    6) Translation of birth certificate.
    7) Certification by translator.
    😎 Letter of sponsor saying the following:
    To whom it may concern,
    This is a response to the Request for Initial Evidence (RFIE) letter dated January 15th, 2020. The RFIE states that based on the documents submitted with Form I-864, Affidavit of Support, for the petitioner/ sponsor, xxx xxx, the income did not meet 125% of the poverty guidelines for the petitioner/ sponsor's household size.
    I include in this packet the following documentation:

    • an employment verification letter (stating that my estimated annual gross income salary is 54,080.00 excluding applicable overtime).
    • Paystubs for the last four months.
    • A correct version of form I-864.
    • Two w-2s.
    • A complete IRS tax return for the most recent tax year

    All this documentation serves the purpose of proving that I qualify as a sponsor for the applicant.

    Just to add to what Aryton said, you can get your Tax Transcript by going to the IRS website---->: Get IRS Transcript

     

    After clicking on the link, go to the section for "Get Transcript Online" (see 1st screenshot).  You will then want to sign up for a free account.

     

    After signing up, you will get a question as to why you are requesting your transcript.  You can select "Federal Tax" and then click "Go" (see second screenshot).  

     

    Select the "Return Transcript" for the tax year(s) you need and save the pdf.

    Thank you! We did that last night. However, we can't find my husband's W-2 from 2018 (he had two jobs, we found the main one but we can't find the other one). Are we going to get denied?

    So today I received our RFIE and I am a little bit worried. The first part is for the I-864 and it states:
    - you have submitted Form I-864, Affidavit of Support. We are unable to process the I-864 because it has one or more deficiencies. In order for us to process your application further, you must:
    Submit a completed and signed form I-864, Affidavit of Support, from the petitioning sponsor. All pages must be present and of the latest edition date. The date needed is 03/06/18. I swear we sent everything complete. I guess they lost it.
    provide a complete and correctly calculated household size for the petitioning sponsor on Form I-864.
    Submit a complete copy of the petitioning sponsor's Federal income tax return, including all supporting tax documents (W-2s, 1099, Form 2555, and tax schedules) filed with the return, for the most recent tax year. I am terrified because we cannot find my husband's W-2 for 2018 (we haven't filed our 2019 taxes yet). Originally I had sent them the tax account transcript, so that's why they might be asking for his tax return again. I know that in the original application you could send the tax returb transcript without the w-2 if it was an IRS transcript, but here it is asking for a w-2. What happens if we don't have it? Are we going to get denied if we send the IRS return transcript without the w-2?

    - Fill out the I-864 form again, making sure that the household size is correct and that there's nothing missing.

    - Send the 2 w-2s that my husband has (let's hope that the company he worked for kept a copy of it) AND the IRS tax returns for 2018.

    - Get an employment letter and four pay stubs from this job (he's been working there for 4 months) and two other paystubs from his previous job.

    Any suggestions? Again, why do they ask for a joint sponsor if he makes above poverty line?

  8. Hi! Quick question. We have a RFIE coming our way and, although we haven't received it yet, I assume it's going to be about the tax returns, since we sent the tax account transcripts instead of the returns. So, we might get the generic RFIE to submit all documents submitted to the IRS (w2, etc). We have the 1040 for my sponsor, but we can't find his w2s. Is it ok to respond with the IRS tax return and 1040 or will they want to see the w2? 

  9. Hello everyone! Just venting: I want an update this week! 

    Did my biometrics on 12/9, stuck in "Fingerprints have been applied to your case". Next step is either a RFE or interview ready to be scheduled... Given that my PD is 10/17, what's the latest I could get a RFE?

    Also if it helps I have an F1 visa and I am applying to AOS through marriage to a USC.

    Really happy to see others moving forward... But I want my share, too!

    Hey Karla! The problem with my application was that it took me a month to receive the first NOAs, so that delayed the biometrics. I sent my paperwork on 10/17 (also my PD) and I didn't get notices until November 19th or so... And the biometrics was done on 12/9, so you're right: my biometrics were kind of late with reference to my PD. I also think I am going to get an update some time next week, but who knows...? Thanks for your words!

    For those who are wondering: March 2020 - Oct 2020 is a reasonable time to expect EAD card, SSN (could be mailed, may have to be apply seperately), and some news on the i130. These are rough guestimations based on processing times, I remind myself of this on days I worry badly. 

     

    Barring RFIEs, RFE, and other spanners in the works there will be significant movement this year (ability to work, get credit, and not be a ghost/SSN). So count the little victories & try not to worry until October, or chill out once you've filed your taxes to be prudent--plus you can also file a tax extension that stretches till October so win-win. 

    I hope there are movements this year since I applied in 2019 lol. I am reading about many people not getting their EADs and jumping straight to green card.
