He is from Dominican Republic and wasn't making much money. I don't even know what proof of tax payment from DR IRS would want. Or don't they ask for proof of income tax payment from  foreign country? And what's that got to do with the USA anyway. He wasn't sending me money to pay bills in the USA.... So I wonder if Dominican Republic has a tax agreement with the USA...

My love, how long has your husband being working in the USA?

If he has being working here in the USA forget about DR that doesnt matter they dont pay tax. Your husbands W2s and yours is more than good enough and even if he didnt work you can still file with him and get more money. you can still get a credit because your still together living as a family.

My apologies.  I misinterpreted your post.........you are likely correct......but taxes can get pretty complex....especially the first year for a new immigrant.

I understand, but that's what I do Im a tax professional.

The best thing she can do is talk to the person who is going to file for her, there she can ask all the questions she may have. Also, For my understand you have to file together the first years for a new immigrant. having a bank account and being in their apartment lease is not good enough for immigration.

Sorry, my question is trying to figure out which option would give me a bigger refund. Thought that was clear in my post but maybe not. Sorry about that confusion. I want to get the biggest refund and hence why I'm thinking of filing separately.

It was clear to me, but my love filing "married filing separately" wont give you a bigger refund. If you file together with your kids as a dependent you will get a lot more.

In your situation, your family  would almost certainly benefit from filing jointly.........you should compare the calculation for the taxes for BOTH spouses filing separately versus filing a joint return.......then make your decision.......or consult a competent tax preparer.

That is incorrect........Any married couple can file as "Married filing separately" if they want.

Yes they can, but they will not get as much as money if they file "married filing seperately" you better of filing "head of household".

Hi guys.... I think I would get a bigger refund if I file "married filing separately". My husband started working in the USA in June 2019. He arrived in the USA on February 9th, 2019 so he has a conditional greencard. Do we need to file joint taxes or can we file separately as married without jeopardizing the permanent greencard application? We have a child together who was born recently in the USA. We have a joint credit and checking account. We also have a joint car insurance and we are both on our apartment lease. Isn't that enough evidence that we are a family?

If you are married you must file together. If you file married filing separately you will not get nothing back.

CR1/IR1 are treated as the same class type as it’s the length of the marriage on the date of entrance into the US that classifies CR1 or IR1 not the interview date. I think what they meant is that CR1/IR1 are scheduled before other classes. Whether or not this is true for this embassy I wouldn’t be able to tell you, but just to clarify

Yes, thank you I was so confuse with what people were saying when it comes to CR1/IR1.
