  2. During my AOS interview, the interviewer checkmarked something on his computer that asked whether I am requesting an SSN. My I-131 and I-765 forms were closed by USCIS because "the applicant or petitioner received a status or benefit through other means".

     

    Inputting my alien number on the SAVE Case Check website returns "No cases found that match the search criteria." so I believe the SSA offices haven't accessed my case.

     

    So, should I just wait to see whether I get my SSN in the mail? Or should I contact the SSA office?

    We are on the fence about getting a joint sponsor due to family stuff that's going on... 

     

    If we get an RFE, would it be just to submit the 2020 tax documents once we have them? Do you know how long they take to review that stuff?

    So they look at the supporting documents and through the pages when you give it to them? I remember at my K1 interview in Canada they didn't look at anything during the interview haha.

     

    So the worst outcome is RFE or administrative processing? A couple of the people on FB are scaring me talking about deportation proceedings...

    Ohh I think I might have been mixed up on when he was unemployed. If he was unemployed when he filed that is a little confusing unless the assets were sufficient. 

     

    He was employed when he filed his 2019 taxes. He was unemployed when we sent off our AOS package, but he had made well enough over the minimum by that time and we also used our account balances as assets. 

     

    He hasn't filed his 2020 taxes because I don't have an SSN and it's needed if you're filing married instead of single, so we thought better wait until I get an SSN. We were expecting I'd get my I-131/I-765 card before the AOS interview.

     

    As for the interview - let's say they ask for the I-864 and supporting documents. Should I just hand it over orrrrrr should I say we didn't file his 2020 taxes yet?

    If his assets and possibly your foreign assets meet the requirements to make up for the lack of income.. You should be good.

     

    I'd bring a letter showing proof of none-filining of the 2020 return (can be printed from your IRS account) along with he other documents you mentioned.

     

    If you used the assets, you should be good with the documents you provided in the i864.

     

    Obviously bring a copy of everything for If it's needed.

     

    Yes, we included our checking and savings (separate) accounts information on the I-864. We put his current income on that I-864 at the amount he had made to that date in 2020 with a note on the last page.

    He should file his 2020 taxes as married filing separately. He mail the tax return and for the place where your SSN / ITIN goes he can enter NRA.

    It depends where you are now in the process, and what his current income is.  And what his current income will be when you have the AOS interview 

     

    We put his current income at the amount he had made in 2020 to that date and put a note on the last page of the form explaining it. We also included printouts of his and mine separate checking and savings account balances. 

     

    Regardless, we will be completing a new I-864 for the interview. Yes, he makes well over the income requirement and we will include our account balances too.

     

    Considering the interview is in less than a month, do you think we should still file them? 

  9. We submitted AOS package in september 2020, with my husband as the only sponsor. We used 2019 tax returns. He was unemployed at that time but this didn't seem to be a problem.

     

    He's been working for 5 months now at a large telecommunications company. He is a contract worker hired by a temp agency for them and his boss submitted the paperwork for him to become full-time but HR takes a while, so we don't know if he'll become full-time before the interview.

     

    He got an extension on his 2020 taxes. We didn't file because I don't have an SSN. I requested an ITIN on the extension application.

     

    Would 2020 W2s (he made about 50k) 2019 tax documents + current job paystubs + current bank info + temp agency contract be enough?

     

    Would the above plus MAYBE full-time contract and/or MAYBE employment verification letter be enough?

     

    Do we need a joint sponsor? We could maybe ask one of his parents but would seriously prefer not to.

  12. I spoke to my manager today and he wants me to stay on as an employee or a contractor if possible, at least during the transition time. I will speak with HR soon and maybe legal, but I feel like this is one of those cases where not many people know.

     

    It is a Canadian company that has locations internationally. It's an acquisition-based company and my department/division are in Canada and I would be helping them out only. 

     

    (I am asking this in the Canada discussion board since it is a Canadian employer but I understand if it has to be moved to a better area)

    02/03/20 third email from correspondence unit that mentioned its under final review and to watch for the canada post email, status change to "administrative processing", status change to "issued"
    02/04/20 second visa shipped
    02/05/20 second visa picked up

    Yes

     

    You line up outside, people from a certain time block get called in, you go through a security screening like at the airport, then you go up to the interview room

     

    I don't recommend any specific organization other than to get an accordion file folder and organize based on how you like/remember, that way you'll have everything quickly regardless of what order the officer asks in

    lets say my name is John smith. do you know how many John smiths there are in the USA? millions. how will they find it?

    Every social media profile has a unique handle, and I assume they expect your handles instead of your names. So you would give your Instagram link which has your Instagram username, or your Facebook link which has your unique Facebook identifier.
