If you only got $1200 (i.e. $1200 for US citizen + $0 for K-1 AOS applicant) then in upcoming tax season you should get $1200 for K-1 AOS applicant + $0 for US citizen. See #30 on Page 2: https://www.irs.gov/pub/irs-dft/f1040--dft.pdf "Recovery rebate credit."

Thank you for the information. Last question,

will this still be possible to receive on the next tax season when we filed separately on 2019? She didnt receive any stimulus check til now.

  2. I have questions. I think some of it I asked before but forgot about it.

    1. Did anyone here receive the stimulus check 2x ($2400) for married filing jointly?

    2. Will we get that additional $1200 when we file for the next tax season?

    3. To those who had their interviews done, did you get another medical exam thus a new one?

congratulations to you and for us waiting for the schedule hope it will be soon!

    @rocoblue

My wife and I got married in December too. We went to HR Block for assitance regarding the chance of filing jointly with foreing income.

The accountant helped us out with everything, I had to just tell her a good estimate on my earnings in Chile (2019), and she told us it would all be exempt on our joint filing.

Like I said in the other post, I saved my wife $500 in tax payment, and she got $80 back. Although HR Block charged us something in between $100-$200, it was totally worth it, considering we also got our stimulus money very fast.

    Best of luck!

Thanks for the input. I guess where she was working from is not under tax treaty as to what@Letspaintcookies said. I checked it too. Yeah maybe that was the reason. Thaaanks!

I can't be sure because you didn't filled your timeline but if you got married in 2019 which I guess otherwise you wouldn't be able to file married you could have filed jointly as long as your wife had an SSN or ITIN. Being a resident for tax reasons is different than for immigration.

We filed separately too but for other reasons. My husband has gotten his check and I'll claim my part with the taxes for 2020

I see. We got married Dec 2019. When I filed my taxes the guy said it would be better to file separately cause my wife doesn’t have an income and her income from her previous job is in a foreign country. That was the reason as far as I can remember and he even checked it on his rule book. So I won’t have to pay more I guess. Is she going to get it too next year?

Hope everyone is doing well despite of what is happening.

This is insane! As Zsazsa said, call again and tell them 'Financial Hardship' as your reason for expedite. Don't give any additional details. From my experience the agents are reading from a script and let you pick an answer. Answer and be silent, wait for them to continue the conversation. We didn't have to prove financial hardship but I wrote something like 'I dont't want to feel my husband to have the burden of providing single income'. There are enough some sample cover letters on VJ.

I am a rather rigorous person and would even go as far and let one of the potential employers write you an offer. Tell them you have a greencard already (DO NOT bother explaining them what an EAD is!) so they will actually write it. I know it sounds harsh, but I have talked to many recruiters in the past weeks. They ask if I had a greencard and I replied yes, even though I have EAD only. In 99% of the cases they are not trying to figure out whether you actually have a greencard, they want to know if you are legally authorized to work without sponsorship. You will need the written offer for the expedite request, and if she can chose from several employers I would 'utilize' one of them to get the offer letter and ultimately the EAD. Just my 2 cents. Good luck!

She’ll try to call again by June and try her luck. She’s kinda of hesitant to say yes she has the green card to the employers cause she knows she’ll get the job right away. Thank you for your inputs. Will let her know about that. It’s just that the agent asked her reason first and for most during the call so she said that. But she might try that “financial hardship”.

on another topic. Have you guys received the stimulus check? Did you receive twice since you guys filed IRS with your spouse? I filed but it was separately since my wife doesn't have the legal status yet. So the tax guy said to file it separately. Was wondering if you guys have the same situation.

  6. This waiting game is crazy. My wife passed her NCLEX and has a lot of job offers because of the Covid thing but still can’t start to work because she still doesn’t have the EAD. She tried to call the USCIS for an expedite and told the agent she passed the NCLEX and that the employer couldn’t hire her because she doesn't have the EAD/Green card. The agent said it’s not an emergency case. But to think hospitals around the country are badly needing nurses. She just gave up answering calls and replying to emails for possible employers cause she can’t proceed to anything. All is in halt. Kind of frustrating for her cause she wanted to work.

does the timeline starts from the receipt date of the date when you got the fingerprinting done?

  7. Thanks a lot guys! I appreciate all your replies. I guess we’ll open an account at Chase as most of you recommended it. We’re your account was opened as joint?or the petitioner has to open it first and just add the beneficiary after? Which is easier? I’m planning to just open for my wife cause I already have an account but hesitant cause she doesn’t have the green card yet and it might be difficult for her.

    Thank you for the reply.

Oh so they're worse than Navy fed 😂 took about 6 weeks and lots of unnecessary document uploads to finally get my debitcard

Geez! We also uploaded unnecessary documents and the last one they required from my wife was not received by them. We did it multiple times already still haven’t heard from them. So I just gave up and decided to open an account for her

  9. Hi guys! Hope all is well despite the pandemic that is happening.

It seems that USAA is taking a long time to add my wife to my account. I’ve been patiently waiting for almost 3 months now. We’ve been sending the required documents but still no answer from them. Was wondering what banks do you guys open with your spouse? That is sure will add my wife to it. A savings account maybe with minimum maintaining balance and affordable fees.

    Thanks in advance.

  10. Thanks! Yeah I guess it depends on the state. I’ll have to find out at the DMV soon.

Guys. Was doing some stalking here on VJ to kill time, as one does...

And I found that a lot of November 2019 filers are getting RFEs for not including 2019 IRS Tax Returns/Transcripts? What is that about... We filed in January and am betting most of us did not include 2019 tax returns... really hoping not to get an RFE for something not required but who even knows with USCIS

that’s odd and unacceptable!haha. W2s for 2019 aren’t given until late of January 2020. Maybe because their case are being processed this month (February) that made them require for the 2019 IRS. Also it depends on the person handling the case I guess. We’ll have to prepare that soon. I bet one of us might need the 2019 IRS. Just in case. Hopefully not. 😂

    1/3 Filed

1/8 Sms with 3 case numbers

1/10 got 1 NOA (for AOS, dated 1/7)

    1/15 got biometrics app

    1/30 biometrics taken

2/4 got 2 NOAs with red stamps (for EAD and AP, dated 1/7 and the stamp says 1/29) —> these were remailed by them.

    Sorry, Ill update timeline soon.

Wow it took a long time for them to get you that. Well I just have to wait and hope it shows up in the mail like yours. Thanks for the info!!

Guys whoever has gone thru this a little info may help. Im planning to get my wife a driver’s license. Can she get it now? Or will it be better to wait for the AOS to be approved then get one? If so, what are the requirements? TIA

Hi. No I dont have it yet. I think that update was to let me know they were sending a duplicate of NOA1 for AP.

Turns out I only got 1 NOA (for AOS), but the other two were missing, they were returned to sender and then they mailed back to me with a red stamp (dated Jan 29th). So, false alarm, no AP yet.

    Regards!

Hi when did you file? Cause I also haven’t received the NOA1 for EAD but have the case number. I guess it was lost in the mail. I only receive 2 NOA1 for AOS and AP. I called them they said to wait for 30 days ☹️.

You can see my timeline in the signature! But basically the application was delivered on January 14th, I got hard copy NOAs on January 24th, biometrics notice on January 25th (a day later) and had biometrics today on February 4th, 2020. I know it all seems nervewracking but try to remain positive. When there are hundreds of thousands of applications with millions of pieces of papers it's a miracle they make as little mistakes as they do when you really think about it in the grand scheme of things. So it is just a little bit of administrative delay :) Hang in there - In Shaa Allah it is coming soon!

Sorry I was using my mobile and it didn't show any of your timeline. Thanks! Keeping the hopes high. Seeing your timeline! Mashallah yours was fast moving! Keep us posted ;)

No, you should receive receipt notices for all three. When you get the Bios appointment notice it is just one notice you receive. It is true the EAD is a like a combo card that works as your AP. You should still not be worried about the missing I-765 NOA anyway since you received a receipt number for it in a text anyway. Worst case scenario it got lost somewhere, but it is still processing. I always like physical copies too like everyone so hopefully you get it soon.

Oh I see. It was odd not to receive all three when everybody here I saw received it all. Guess I have to wait after one month to call them as what the site states.

    1 minute ago, Bars&Saqi said:

Hey sorry for the confusion, I meant the biometrics appointment notice combines the EAD and AP biometrics. However, you should still receive three separate NOAs for all three.

It’s okay 😊. Just worried where my wife’s NOA for EAD went.

To those who have gone thru their biometrics appointment can you please provide the timeline? I know I saw somewhere on the thread but it was gone maybe because of the merged thread.

    Thank you for responding!
