  1. So they are landing at 8:05 PM and I found a direct flight at 11:45 PM, otherwise next available flight would be the next morning at 6 AM. 

     

    If we go with the 11:45 PM flight that gives us 3 hours 40 mins.

     

    You all think that is enough time to go thru POE, collect bags and go to check in counter for next flight so they can check in their bag, and then finally back thru TSA?

    I never said there was any malice or intended offence.  It just goes to shows the reality of the world we live in today when we all want to express our opinions on something that in reality has nothing to do with a question.  That was my only point.

  3. The funny part about all this was a simple question was asked, and it was answered.  No can someone please explain to me why everyone feels the need to hijack a question to start talking about personal preference on which airline they like?

     

    The part that is frustrating is has everyone lost the ability to think and realize the post has nothing to do with your personal choice of an airline?  There was never a question about which airline to pick just about POE process.  

     

    Sorry for the rant but honestly I find this a joke people always need to inject personal thoughts on something not even in question of the thread.

  5. Hello again,

    I have a couple questions about POE.  If there is a connecting flight which POE will they need to go through.  Ideally they will be flying into San Francisco or LAX and then have a connecting flight to Minnesota.  Which POE will they be going through?  Ideally having the POE in Minnesota would be ideal (will save on luggage cost in the long run).  I have looked at flights that have a layover in San Fran...2-3 hour layover but if they need to go through POE that will not be enough time.  

    I believe for connecting flight you do not need to but would like to know others experiences and thought or knowledge on this.

    SLEC is walk-in only.  No appointment.   You can pre-register your information but it is not an appointment 

    I know that it is a walk in clinic,  the confusion comes from Subsection D and E.

    I am a little confused here and hoping I can get some guidance.

    Sub section D states letter with case number and sub section E stated interview appointment confirmation if available. 

     

    For sub section D, is this the email we received from the embassy correct?

    And finally for sub section E we are setting up the appointment online so I am assuming they will email something or it is something we need to print when we set up that appointment.

    My fiance has a daughter that is 19 years old, will she still need consent from her biological father?  I have read that single mother have sole custody.  My fiance was married but it was annulled as he was still married thus the marriage was null from the start.  However since the child is 19 years of age and I know in the USA that is considered an adult.  So back to my question will she need consent from her father whom she never see or has contact with?

    So the question comes from here.  When setting up the online profile so we can set up the interview.  There is 2 spots that can be confusing.  Do we create 2 profiles one for the K1 and then a new profile for the K2.  Keep in mind the K2 is 19 years old.

  11. Hello,

    When doing the online registration to set up appointment for interview I am a little lost.  There is an option to select which type of K visa it is K1 or K2, but later on there is a question for any children accompanying.  Since the K2 child is 19 will she need to create a separate profile or do we add her to the accompanying section.  I know there is a separate fee for each to be paid.

    That makes sense as I recall reading the status does not change until the event has happened.  So in theory tomorrow it "may" get updated to in transit since a case number was assigned already and the julian date was before the typical cutoff shipping date.

    That would be odd since I need a case number to track it in the first place.  It could be no invoice id assigned yet but that is just a guess.  I am also thinking since I do have an attorney for all this (I know I could have done it without one but I wanted to be safe)  based on the info I found it is waiting on form DS-260 which I believe we fill out online and not the attorney, so not sure about that.

     

    Sadly nothing any of us can do but wait.  However once I do find out I will share the information for your tool box of knowledge.

    As a K1, when checking your case online at CEAC.state.gov you have to select "immigrant visa" as it is treated like as such even though it is a "non-immigrant visa".

     

    Technically the K-1 is a non-immigrant visa but it is treated like an immigrant visa because of the AOS. It is kind of a ba$tard. Non-immigrant treated like an immigrant. Other non-immigrant visas do not usually end up with green cards!  The K-1 on its own is a single entry, short time limit visa that expires 90 days after POE. You are a non-immigrant (90 days limit) with immigrant intentions (GC). That is why it is a non-immigrant visa treated like an immigrant visa.

     

    You have three stages 1) transit - shipment is in the air or soon will be, 2) received - physical case file is at the Embassy and 3) ready - your case is ready to schedule and complete your interview.  These will be your current state or status to your case file once you have received the case number.

    I may have found an answer to my question.  I was able to locate the following information and thought I would share it.

     

    Once entering the details, applicants will see the status of their petition. This status may appear as follows:

    No status

    This status is shown on online applications until the interview is completed.

    Ready

    The status indicates that information (such as photographs and fingerprints) need to be taken or that an interview needs to be scheduled.

    At NVC

    The U.S. authority has not yet opened the case or the DS260 form has not been submitted yet.

    In Transit

    The case arrived to a U.S. Embassy to schedule an interview. You can find out more about scheduling an interview by visiting the USCIS website.

    Issued

    The visa application is completed and approved in the final processing phase.

    Refused

    You can find out more about the refusal by contacting the U.S. authority that handled the interview.

    Administrative processing

    Further checks are needed. This process can take up to 60 days after the visa interview. If any documents are missing, the U.S. consulate contacts the applicant. Once this stage is complete, and your application has been accepted, your visa will be sent to you via mail in two business days.

    Expired

    This notification signals that your registration for an immigrant visa was cancelled. Any petition approved on your behalf was also cancelled. Your application may be reinstated if, within one year, you demonstrate that your failure to pursue an immigrant visa application resulted from circumstances beyond your control. Note that your registration record and any petition approved on your behalf, as well as supporting documents, have been destroyed and any U.S. Department of Labor certifications have been returned to your prospective employer. If you still want to pursue an immigrant visa, your petitioner should contact the U.S. Department of Homeland Security's (DHS) Office of U.S. Citizenship and Immigration Services (USCIS) to file a new immigrant visa petition. 

    Expiring Soon

    Section 203(g) of the U.S. Immigration and Nationality Act requires the cancellation of registration and any approved petition if you don't apply for an immigrant visa within one year of being notified to do so. If you do not obtain an immigrant visa during that time, and you fail to notify the USCIS that you haven't obtained one, your application and any petition approved on your behalf will be canceled. 

    Your application can get reinstated and a petition can get revalidated if, within that one-year period, you can prove that your inability to get an immigrant visa application was due to events beyond your control. You'll need to give a written statement to the U.S. Embassy or U.S. Consulate that details those circumstances and notes that you still want to pursue a visa petition.

    I am thinking there may be 4 statuses then.  When I check ours online it says "At NVC"
