Like @Pinkrlionsaid she will need a lawyer. From now until the approval she will need to present more paperwork. IMO this is not a DIY case. Legal advice will be needed, because looks like they are not un good terms about the custody, I'm right?

Just one question,  why didn't they (your sister and her husband) filed for the kids on the moment that he filled for her? Does she complete the information about having kids on her visa process?

Yes my sister Husband applied for the kids same time with her application 8 months still waiting on the kids approval

Who has legal custody of the children?  The biological father can file for his children, just as the biological mother can file.  Your sister needs to have her court order to show who has sole or joint custody.

No one has sole custody! He left her with the kids a few years ago and went to the US and got married to someone! She got married to someone too a year after, the kids is with a care taker back home. Will my sister get the approval first since she applied since September 2020?

  3. My Sister husband (citizen) filed for her 2 children 5 and 7 last September and awaiting approval!

My Sister children father went behind her back last week and filed his own application. What will happen to my sister pending application she filed last September? Will there father application interfere with the first application there mother sent? She's really confused and upset. My sister and her children father live in the US separately as permanent residents. The children live in another country while  processing

Employers do not need the GC, they just need proof that you can work. Your immigrant visa + stamp at POE is enough for that. If employers get confused about it, just explain it and show them the USCIS site. It's all here:

All employers want to see my SS card, not even the banks want to give me an account

It can take a couple of months to get your plastic green card and SS card.

Your endorsed immigrant visa is a temporary 1 year green card.  You can use that while waiting for your plastic green card.

If you move, make sure to update your address with USCIS and SS.

I would print the page from the USCIS website and show them this. In particular the paragraph that says that immigrant visa arrivals do not have an I-94.

    https://www.uscis.gov/forms/all-forms/form-i-94-arrivaldeparture-record-information-for-completing-uscis-forms

All persons need a Form I-94 except U.S. citizens, returning resident aliens, aliens with immigrant visas, and most Canadian citizens visiting or in transit.

I went back Show them this info and got the State ID. Thank you.

You can start work without the SSN card. I did. Most employers cannot add you to their automated payroll systems without an SSN so your wages may be held back until the card arrives. But she has work authorization already and the only reason she doesn’t have the SSN card is because of the time it takes the SSA to generate them and the time it takes USPS to deliver them.  It’s not a question of eligibility in her case.

OP there is no I-94 record if you arrive with an immigrant visa. Surprised to hear that you are being asked for it. I started work before I got my state ID and SSN card. All I had was my passport and endorsed visa (I-551 stamp). I didn’t even have a bank account.

According to my state ID office, Everyone should have I-94 record but there's none for me on the site but they won't listen to that

  10. I'm planning My Final Transition to the USA in a few weeks. My Mother in Law Hate for me is getting more Real. I'm worried and afraid that when I arrive there I will be homeless. The Plan was to live with her until we save up enough, build good Credit and Get an apartment. My Husband don't have any Savings, he has one Job he is struggling with and trying to find another. My Mother in law don't want me at her House. We have never had a problem, no fight, arguments nothing. My Husband is White and I'm Black. My Husband has lived with his Mother all his Life, he's the only Child. My Social Security and Permanent Card will be going to her Address. I feel Lost. I booked My Flight a while ago but I don't want to tell my husband the date because I don't trust my Mother-in-Law but she keeps asking, My Mother in Law and Husband are the Sponsors on the Affidavit.

Nothing has Changed between my Husband and I, Just my Mother-in-Law Constant Nagging suddenly about me living with her and she don't want me at her house. It's Frustrating my Husband. She really dont want him to move out either, she's past Retirement age but she works and he's all she has. Who Experience this?
