  1. Birth cert I have, I have house insurance docs for the last 3 years and car insurance for the same period. We have joint bank accounts but only one of our names appears on the statement which is annoying. We also have credit card statements which show me making payments to her account. The statements are not in a joint name though. 

  2. I'm preparing evidence of marriage for my N400 (filing under the 3 year rule).  We don't really have any many bank or credit card statements with both our names on.  We do have 3 years of IRS tax transcripts showing that we filed jointly though.  Are the tax transcripts the "gold standard" here?  Other things I can think of that are in both our names are car title and maybe the car insurance docs.

     

    Oh we also just had a baby...so I guess that's evidence too :)

    Yes that sounds correct. Your K1 medical will be fine if you filled the I-485 within one year of the visa medical date.

    We had our interview last Friday and it was nothing like I expected. We were in Philadelphia and we got called into her interview. The guy was great and friendly. He asked for credentials and basically needed that to log in to our case. Once he was in he saw she came over on K1 and asked if we for married within the allotted time and of course we did and gave him our marriage certificate. He talked a lot about his job and all the people he’s helped. He asked our story and asked about proof of relationship after the marriage. She just got her social security card due to getting her EAD beginning of the January and told him I just finally got her on my bank account and the only proof was a email from the bank that was on my bank app. And the only thing else which was pretty convincing was her first sonogram of our baby. So he only asked for my pay stubs and said you got your card. Didn’t take any of our papers other than a copy of the baby pic. We just got confirmation I797 today in mail. Only 20 minutes total. Hope this helps anyone out there if you go to Philly.

I remember when my wife did the K1 Visa and had all that stuff with her and they didn't ask for any of it. They asked one question and talked a little and that was it. Everything they ask for on the interview letter we have given them already when we filled for the AOS. We're going to Philadelphia to interview if that makes any difference.

    They took all the evidence of relationship off me, looked through it, asked some questions about it and then kept it for their file. They took our passports and and birth certs and looked at those too. They also looked at my EAD stuff and my divorce stuff. To be honest most of the items I took are off the list of things they tell you to bring in the letter inviting you to interview. You may not need all of it, it depends on who you get but I figured better safe than sorry.

    Also, what should we expect at the interview? We've been together since 2016 and everything is documented through the embassy. And we've been living together for a year and some change now since I got here. What more "proof" of bonafide relationship do they need?

    Our interviewer was extremely laid back and it felt much more like a conversation than an interview.  She asked us for some of the documents upfront, specifically both of our passports and driving licenses.  After that she asked for all of the information we had brought which proved our relationship was legit (photos, bank statements, car titles, house deeds) she skimmed through the photos then put all of that in our file.  She also asked to see my EAD cards  She did not ask to see our birth certificates, my social security, my decree absolute or any of the details relating to my employment.  I think because they were either irrelevant OR already in the file.  That doesn't mean you won't be asked though, this was just our experience.  She asked us about how we met and also some follow up questions relating to that, she asked about the wedding, she asked each of us to tell her our birthdays (i.e. what is your partners birthday), she did the same with our place of birth.  Oh she also asked for the medical forms from when I submitted my K1.

     

    In summary, providing you have a legitimate relationship and the correct documentation, you shouldn't have too much to worry about.

  8. So nearly two years after our AOS NOA, we finally have our interview (next week).  These are the docs I plan to bring, I'd love any feedback on obvious omissions or errors:

     

    • The letter inviting us to interview
    • My passport and Birth Certificate
    • Spouse passport and Birth Certificate
    • My decree absolute (I have a previous marriage)
    • Marriage certificate (certified copy)
    • My two EAD/AP cards (one expired) plus all related documentation (NOAs etc)
    • All other NOAs I've rcvd. 
    • Copy of my medical form I took to my K1 interview in the UK (filed my AOS within 1 year so no need for I-693)
    • My social security card
    • Details of my employment (letter from company) plus recent payslips. 
    • Evidence of relationship
      • Letter from bank stating we are joint account owners on two accounts
      • Homeowner Insurance statement with both names
      • Certificate of Title for the two cars we own, with both names on
      • Copies of our drivers licenses showing same address
      • Copy of my benefits statement from work showing spouse as beneficiary 
      • Copy of 401k's stating each other as sole beneficiary
      • Deed of trust for the house with both of our names on (I'm not on the mortgage but I am on the title).
      • IRS tax return transcript showing us a married filing joint for 2020
      • Photographs of us together 
        • travel photos 
        • general photos with friends 
        • some wedding photos but we just did a courthouse so they're pretty basic
    • Copies of all of the above

     

    We submitted the I-864 with the initial application and rcvd no RFEs, my spouse's income has increased significantly since then so I might bring an updated I-864 to have in my back pocked but I don't think it's really needed.

     

    What am I missing? Please jump on this thread and let me know!

  9. I’ve never had a problem getting back in to the country but be plan for a long wait, especially the first time you use it. 
     

    Im sure it’s location dependant but at Seattle (SEATAC) you get put in a special line. That line moves so slowly it’s painful. Expect 20 people to take about 2hrs. It’s longer if lots of flights are landing because it’s the same line cabin crew and pilots use and they cut to the front all the time. Once you clear that line and answer basic questions, you’ll be taken in the back where another person has to do something (not sure what) before you eventually get a stamp, that second part is usually much quicker. They parole you for 1 year so in theory the next time you come through using the same AP card you don’t go through the second part of the process, if you renew your AP card you’re back to square 1.  It’s taken me between 2 and 3 hours each time I’ve flown internationally and that was during COVID (so not that busy). You’re standing the whole time, there are no bathrooms.

I filed my AOS back in 2019 and the status has been “As of October 2019 Case is ready to be scheduled for interview” ever since. However I just changed address (same state, same office dealing with the application). When I changed the address the status changed to “As of February 2021 Case is ready to be scheduled for interview.” 

     

    Is that normal? Should I read anything in to the fact that the dates changed even though it was just a change of address?

  12. This might sound crazy but given the current wait times, maybe not. 
     

    im filing in Seattle where the wait times are currently some of the longest in the country. I’ll hit two years later this year and I’ve seen other forum members who are in danger of making it to 3 years.


    Can you start the process of getting a US passport in year 3 without having had your AOS case approved and a green card issued?

  13. I just went through this process.

     

    Used these covering letters (but amended the list of enclosures).  It may not all be required but when in doubt I usually just send it so put copies of the marriage cert in if you feel you need to.

     

    For I-765 I sent this

     

    Form I -765, Application for Employment Authorization

    Form G-1145, E-Notification of Application/Petition Acceptance

    2 x passport photographs

    Copy of passport and current K1 visa page

    Copy of I-797C, Notice of Action, receipt notice of pending I-485

    Copy of my current Employment Authorization Document that expires within 180 days

    Copy of I-797, Notice of Action, approval notice of current I-766

    Current I-94

     

    For I-131 I sent this

     

    Form I-131, Application for Travel Document

    Form G-1145, E-Notification of Application/Petition Acceptance

    Copy of I-797C, Notice of Action, receipt notice of pending I-485

    Copy of my current Employment Authorization Document that says "Serves as I-512 Advance Parole" and expires within 180 days

    GET THE LATEST COPIES OF THE FORMS FROM USCIS AS SOME OF THEM HAVE BEEN UPDATED.  OLD VERSIONS COULD BE REJECTED.

    I'm at about 525 days.  I've just renewed EAD and AP, it's fairly easy.  LMK if you need any help.

    I’ve been waiting nearly 2 5 years and still don’t know when I’ll get my GC interview. You’re going to have to get comfortable being uncomfortable. One thing I’ve learned is that the seasoned contributors on this forum are rarely wrong. Take their advice.  

  16. For those going through the same process here were my timelines:

     

    Sent renewal forms (AP & EAD) - 01 Nov

     

    Forms noted as received by USCIS - 04 Nov

     

    Received NOA (employer accepted this as right to continue working in US) - 18 Nov

     

    Received notification of approval - Dec 29th

     

    Received combo card - Jan 8th (same day old card expired).
