As long as your feet are on US soil before the expiration date within your passport expires you are good to go. With a fiancé in the military, your situation is easy to explain away and I am pretty sure you won't have any problems. BTW, don't fly the day before you visa expires as delays do happen along the way and you don't want to be outside the country when your date expires.

     

    Keep in mind that the expiry date for the visa is based on the medical exam date. So schedule the exam date as close to your interview, within reason, to maximize your time from visa issue to when you need to step on USA soil.

    Thank you so much! My plan is to have my medical on July 31st so it will expire on January 31st 2020. And I plan to fly on first week of January.

  2. Good day guys, I would like to ask something about my k1 visa. A friend of mine chatted me and told me about her experience at the immigration of her POE. They filed last August 2018, got approved by January, got approved on her interview by March and VOH by April. Her flight was June. She said that the immigration officer checked her I129f packet inside the yellow packet and saw that her packet will be expiring in 1 month and 1 week, and why she only decided to fly in US by that time. So she is very concern about my situation, I am a January 2019 filer and plans to fly to US by January of 2020, the reason is, my fiance is a navy and currently on his deployment and coming back in US on October. And he's planning to celebrate new year here with my family. I'm planning to have my medical by July and interview on August. I'm so confused, why does the immigration asked her about the i129f packet, I thought what matters is our visa that we need to fly to the US before it will expire. (Within 6 months) Please enlighten me. Thanks!

    With a document so important as your NOA2 coming to you I'd want to make sure there was no doubt no mix up that it would get to me at the correct address. USCIS is going to send the NOA2 to the last address they have on file. It's up to you to make sure that address is valid.

    Thanks for answering my question. He's in deployment right now. He used his mom's address for our noa2 for some confidential matter. Hopefully it will be sent to his mom 😅

    NOA2 was Feb 13. Now waiting for NVC to get our case

    Oh,now I'm kinda stressed. Because my fiancé had a car accident last 2016. 😞 And he did not indicate it on our I 129 form

    In your scenario, its highly possible their case will sit at the embassy for about a month because hes deployed and cant submit to her his affidavit of support on scheduled time and in mine she might have to come about a month sooner without him being here so it's all a gamble and it's up to them what they want to do.

     

    You mentioned earlier in the thread you tried expediting multiple times and were told they arent expediting due to deployments so if that's the case then theres nothing to worry about and this discussion is a moot point. They wont lose anything by applying for it and getting denied. Their timeline will continue the same. But if they do get approved and it does help them in some way, that's great. So may the chips fall where they may.

    Thank you so much guys for the information, I really appreciate both of your opinions and suggestions. Maybe we will get our NOA2 by May or June, I just hope that we don't have any RFE. We also thought about expediting our papers but he was very worried that I will be alone for 6 to 7 months because of his deployment. Btw we also got an option on how will I get his affidavit of support. 🤗

  8. My fianceé will be having their deployment on April till October this year. He was not allowed to tell anyone which country they will be at, means that he was not allowed to send me the documents I needed. In this case on that time frame of his deployment, most probably (hopefully!) We're about to received our NOA2 (January Filer) is it okay for him to send me all of the documents that the petitioner's need to send for the beneficiary's interview by March(before his deployment)? I'm worried about the date of his signature on some of the documents that needed to be sign. 

  9. Hi guys, I would like to ask is it okay that on page 7 part 2 item 45a to 46, Address in the US where your benificiary intends to live will be changed into different state? My fianceé (American Citizen) is a Navy and they will change their port on March from Virginia to San Diego, would there be any problem? The one we've used on our I129F is his Virginia address. TIA 🤗

    You can submit the actually filing 1040 with all schedules so yes all 90 pages. But, with that many pages, you can also go to the IRS website and request a copy of the transcript which is no more than 3 pages tops. Same day printing and FREE. At one time it was reported the site was down do to the shutdown, but recently as a week ago people are reporting that it is open for business again. Here is the link.
