So he hasn't met her yet, plans to go for a casual drink in Mexico, take some pics, and he already knows he wants to marry her?  That sounds like a green card arrangement to me.

That's his concern also (that in the eyes of USCIS it will look suspicious). But there is no money involved. He thinks he's madly in love with the lady and is willing to take a risk.

There is also an issue of an age gap (he is 72 y.o. , she is 32 y.o).

The communication is through Skype only (calls and video-calls). How can they prove those?

  2. I ask the wise people of this Forum on behalf of my friend. He is a US citizen who lives in Arizona. He's been communicating for a few months with a lady from Mexico whom he found on a dating site. The two plan to meet for the first time in Nogales, Sonora (Mexico). My friend will drive himself to the border, cross the border on foot, spend a couple of hours with the lady in a bar or restaurant in Nogales, where they'll have a drink, chat, take photos of each other, then part their ways. After which (provided they liked each other in person) he plans to file for K-1/K-2 for her and her little child.

Question: What evidence of their personal meeting (apart from photos) can he submit to prove it happened within last 2 years? Obviously, there will be no boarding passes, hotel receipts, or things like that...

  3. Thanks for the responses! They live in Arizona. I checked the link, thanks! Why $30,170 for the family of 5 if in the link it's 100% of poverty guidelines. Isn't it supposed to be 125% for IR-5?

5    and depends on where they live    As long as they don't live in Hawaii or Alaska, its $30,170.00 for 5 people.

Here is  link to the poverty guide lines

  4. A question from my friend. She is a citizen of Uzbekistan. Her daughter is a U.S citizen. Daughter wants to file I-130 for mother. The family size of Daughter is 4 (Daughter+husband+2 babies) and total income (Daughter+husband) is roughly 60K.

My friend is confused: Will they have to count her as their family member, too? If yes, then the family size will be 5, right?

Will the income be enough to sponsor Mother or a joint sponsor is needed?

From the I-129f instructions.  Feel like I am posting this every day.

Translations. If you submit a document with information in a foreign language, you must also submit a full English translation. The translator must sign a certification that the English language translation is complete and accurate, and that he or she is competent to translate from the foreign language into English. The certification should also include the date, the translator’s signature and printed name, and may contain the translator’s contact information.

Okay. Then define "a document" and if a chat log can be considered as such?

  6. My husband is French (beneficiary of a pending CR-1) and lives in France, and the interview will be in Paris.

In the past he worked and lived in Switzerland, so he has to produce a police clearance certificate from there.

Question: Can he request this document to be issued in the French language (rather than in German)?

How much time does it take to get this document (in paper by mail) obtained?

  7. My husband who lives in France (beneficiary of a pending CR1) will have to provide police clearance certificates from all countries where he lived since the age of 16, correct?

In his case it's France, Portugal and Switzerland.

Of course, the documents will be issued in French, Portuguese and German.

Question #1: Will each of the documents have to be APOSTILLED and TRANSLATED into English?

How "fresh" each document should be on the day of the interview for CR1 visa?

  8. I added photos of screenshots of our Whatsap chats, and they are in French language, and I did not care to translate them. What the heck.

Their purpose is to show the ONGOING communication between the couple. Nobody at USCIS is going to read those chats, anyway.

If the chats do not carry any weight in proving a bonafide relationship, they are not going to harm our case, either.

Sure.  But unmarried children under 21 always count in your household regardless of any of that.  What happens if the other natural parent dies tomorrow?

And what about the unmarried children under 21 of the BENEFICIARY? They are STEPchildren of the USC petitioner, and it's CR1 case. Are they counted as members of the household for I-864 if they are NOT immigrating to USA with their parent (and instead stay in the custody of the other parent in their home country)?

She can work from the minute her passport is stamped. Even before the SSN has arrived. The company likely will withhold her pay until the SSN number is verified but she is legally able to work from the moment she has her passport stamped.

I started work less than 2 weeks after I arrived. I would have started sooner but I arrived just before Christmas and my line manager was on leave over Christmas and so I decided to wait for her return to work. My SSN arrived around 10 days after I started working. My employer withheld my wages until I showed the card and they ran the number through the verification process.

Will ITIN substitute SSN in this case (getting paychecks)?
