I imagine a lot of desks with tons of applications that are reviewed by officers, since they have physical files there's no guarantee that applications will be reviewed in a particular order 🤷♀️
Actually, the cases received are getting scanned into e-format by USCIS. So they must be reviewed on a computer. Unless a certain page is badly scanned, and the officer wants to see the original in a physical form.

Thank you, DGF! Exactly what I wanted to know.
-
That’s the whole point. K3 gets denied, and I-130 approved. Right there!
-
If I knew it back in November (my PD is 11/14/18) that it’s gonna be a « stuck case» scenario, I would have filed a 129F for K3 right after my I-130. Just for acceleration, what the heck.
-
Sorry for making myself unclear.
I am talking about CR-1 visa, there is no wait for the visa number to become available.
I am talking about comparing similar cases, of the same category, the same processing center, and the same PD month.
-
Thanks for the responses! Whatever the USCIS says about their processing times, is a bs for me. I am inclined to believe the reality, i.e. the VJ members timelines. And yes, I understand the difference between say, Potomac and Nebraska😀.What I see among my I-130 fellas of TSC following their timelines, is what VJ told me in its weekly email, Your approval is past due.
Who can explain, how does it work there, and what is the point in the « Priority Date » then??
-
A question to the experienced here: If it takes too long between NOA1 and NOA2 and your case is clearly past due (comparing to other VJ cases with later PD that get approved but you are still waiting), does that mean that USCIS works on your case, but your case is too complicated and/or trigger special attention (red flag, whatever) in the eyes of USCIS?
In other words, if it takes abnormally long, does that mean that you should wait for an imminent RFE rather than a late approval?
I just don't know what to think....

Now, case tracker apps shows they sent for RFE. Not sure what they are looking for. Did anyone go through the same situation. Any idea how long would take this process?
Normally RFE slows down the process for a month - provided USCIS accepts your response quickly, you'll hear back from them in a week or two.

The word is "MUST" in the petition instructions and I gave instructions on how to get passport photos of your loved ones. It's simple and easy.
Can you please direct me to your instructions ?
-
I am confused. K3 application is the same as K1. It asks for passport photos of BOTH petitioner and beneficiary. But if my husband (beneficiary) is outside the U.S., is his photo still necessary ?
-
I think no matter how long the marriage was, there is always a chance to try VAWA in case there are signs of abuse. And evidently there are quite a few from what is written here.
If I were you, I’d consult a lawyer experienced in VAWA.

VJ is more accurate because it’s estimate is based on actual people’s timeline.
-
Also, can K3/K4 be filed online? On USCIS website if I opened an account there?

You guys are mistaken go to uscis and look under i-129 and then special Instructions. Hopefully you all take from this.
All you need is copy of nao1 and marriage certificate. NOTHING ELSE whatever extra you want to add sure.
While filing K3/K4 (for a spouse and a stepchild), should it be one petition or two separate ones?
Also, if a beneficiary has multiple children but only one will be immigrating together with him, should all the children be listed in K3?

Now it actually reflects reality. But I don't look at this page anymore, they just put on whatever they want. VJ's data is more reliable.
What is killing me is why do they keep sending applications to Nebraska? Isn't there someone who is overseing all the centers and who would realize that there is a problem and an easy fix would be to stop sending applications to Nebraska for a while?
Exactly. Reasonable sense and USCIS are two different things.

Sure, its called "CaseTracker." It has a picture of the American eagle coat of arms in a circle with the American flag behind it. All you need is your NOA1 recepient number and it'll show you the status. You can search too and show the next x number of cases before your number. Or you can put in an earlier number to see how other cases are doing.
Thank you! I didn’t find Case Tracker, I found Visa tracker. Downloaded it but it only lists E and F visas🤔

I'm using an app too where you can see the 'queue' of applications. It seems that End of October and early November is still largely under review. I wouldn't worry about being rejected. It seems they check the application for improper filing when they first receive your application. RFEs on the other hand, I don't know.
Can you please tell me what app do you use and if I can download it on my IPhone? Thanks

Is it too late to contact USCIS to send them an updated I-130? Or an addendum to it. We did not list all the children of beneficiary and I am freaking out they would deny on the basis of misrep.

I had a priority date of November 2nd at TSC. No sign of a change on the online case status, I got e-mail today saying we are still reviewing your case....can I expect to get real-time online updates? Or only in the mail?
I don't think there should be any problems. I provided a mountain of evidence and neither of us have ever been divorced.
Waiting for it any day now. Trying to resist the anxious thoughts. 😞
I didn’t know they do this kind of emails. Actually nice, like « don’t worry, be patient, we didn’t forget you ».
In my situation I think I’d be glad to hear anything, but this deadly silence...

I hope you guys get it soon!
Clap, clap, Cony! Happy for you.
Let’s see if this week brings good news to others🙏

Yay! I got my approval too!
NOA1: Sep 20, 2018
RFE: May 29, 2019
REF received by USCIS: Jun 17, 2019
NOA2 Approval notice sent: Jun 20, 2019
NOA2 Approval letter received: Jun 24, 2019
Online still remains "" Response to USCIS' request for evidence was received "
Congratulations, Allison!
What was the RFE for?

I get that you're worried, waiting for the I-130 petition to be approved so that you can move on to the NVC stage. You want to be with your husband, the love of your life. We're all going through this and it's painful. The waiting really sucks, and you start to wonder why it's taking so long.... Hang in there, you'll be approved soon. TSC is taking at least 7-8 months. Be grateful that you didn't get assigned to Nebraska! Those people have been waiting almost a year for just the petition adjudication. If your relationship is bona fide, your documents are all good, and there are no problems related to inadmissibility, your petition will be approved. It's hard not to worry but try to focus on the next stage and get all the documents ready to upload as it goes so much faster after the petition is approved. If you have any red flags like a big age gap then side-load additional evidence of your bona fide relationship like financial co-mingling and visits since filing the petition at the NVC stage. It only took us 4 months from the petition approval to receiving the CR-1 visa, so before you know it, you'll be together. Good luck!
Thank you so much for your kind words!
And yes, I am aware of the unfortunate of Nebraska. I think it’s unfair, and that USCIS workload should be distributed among processing centers more evenly.

You might want to give specific case history.....It's difficult to answer such wide, hypothetical questions........
EDIT: Does this question involve a bar in Mexico, by any chance?
No, there is no question of bar.
No age gap, no criminal history, or previous misrep. Bona fide relationship, multiple visits.
But also multiple previous marriages for petitioner (including one with a foreigner). Petitioner also sponsored two people with I-864 (both committements ended by now) and filed I-130 for a sibling (petition approved but visa number is not available yet). And there are multiple children for beneficiary. And we didn’t include all kids in the petition, we thought only minors should be listed (less than 18 y.o).
Now someone on VJ says, it’s not so.
And we are nervous. We understand that our case is not simple. And it’s bothersome to see more and more petitions approved with a later PD.
We just want to be together desperately and be able to start life as a normal family😪
