  1. Spent the day with my 96 yr old father ( in Australia). Feb 14 th is my mothers birthday, and it was the first since her death in June 2024 😓
  2. According to the EO, Processing of refugee applications has also been suspended. An asylum seeker is one whose claim to be a refugee has yet to be determined. Im assuming you are in the US now on refugees status? Im so sorry. There is little you can do but do make sure you stay in touch with NVC every few months so you keep that application active. Stay in close contact with your community refugee support group and agency… link up with one of you aren’t already connected.. find above advocate groups and keep yourself informed as possible
  3. A scan of anything is a copy. The scan/copy does not bear the authenticating watermarks or raised seals that authenticate the document issued by the authority The scan /copy cannot be authenticated without comparing it to the one given to you by the authority who issued it.

  5. There is no limit on transfer amounts. It has to be deposited somewhere.. usually into a bank account.. All transactions over $10000 are reported to the IRS. The source of the funds .. savings, sale of a house, earned interest, withdrawal from a retirement fund.. and your status ( lpr etc) at the time of transfer will dictate what the IRS deems taxable income. US taxes some sources very differently to other countries and you can find yourself owing tax if you are not aware of the issues.

  8. They are looking for the certified copy .. Not a scan of it .. they only have a scanned cup copy on the NVC file and they want to see originally ( certified) of all that was electronically submitted. .

  10. Petitioners original documents are not required. Originals of beneficiary’s documents uploaded into CEAC are required. Plus hard copies of financial documents used for meeting the financial support requirements
  11. His visa expired the day he entered c the US. He is a permanent resident. The stamped visa in his passport is his documentation of this .. valid 12 months from entry and used as documentation until the plastic GC arrives
  12. As she has a valid current visitor visa, she will be allowed to board the flight. She will need to carry evidence that she is returning to her home country and it will be up to the CBP agent at Point of entry to decide if she is granted entry. But she cannot stay, cannot adjust Status. Not eligible for it and fraudulent use of the visitor visa as well

  14. Read the instructions for the I90 found on the USCIS website. As she has a 10yr GC, her lpr status is no longer tied to the initial conditions of being married to a USC. She will probably need her marriage certificate but it’s not for evidencr of ongoing relationship, it’s verifying information in her application and online
  15. As evidence of residing together out could be useful. Better documentation for this would be things that have the same address on them for both of you.. drivers licence, lease, bank statements etc
  16. Reread the instructions. If you answered yes for 16 then you fill out 17. By default if you answered no to 16 then you skip 17. This isn’t the same as leaving a mandatory question blank.. thats when you use NA .. not here

  19. You risk being seen as never having resided in the US if you enter and immediately apply for a Reentry Permit then leave. We have seen one case recently where reentry on the permit was denied for this reason. So you have two choices.. don’t even enter with the visa.. let it expire and reapply when you are ready to move.. or enter together, do as much as possible to strengthen your perceived ties to the US.. bank, drivers licence etc.. apply for the reentry permit and see what happens when you try to renter.

    Its not surprising that she was denied. Babysitting is considered work. Visitor visas are for visiting not working. It’s a hard fact but one which trips up many people.
  21. There are a limited number of visas which are made available each year and way more eligible applications each year. So the wait time for your application to get to the top of the pile and get an available visa will take a long time The visa bulletin shows the month and year of application that is at the top of the pile now. For many countries the top of the pile application was filled 20 years ago. You cant jump the queue by expediting. Once you are at the top of the pile out means “ a visa is now available” form your application.. and it is possible then to request edited processing of that stage. It culminates in an interview.
