    A question regarding the i-865: my husband filled the form and it asks for the effective date of change of address - this is June 2021. Reading the instructions, we noticed that the sponsor is supposed to notify USCIS within 30 days of the change of address, and if they fail to do so they can incur in "a fine not less than $250 or more than $2,000". Does that mean that we might need to pay a fine?

    We had to file an I-90 for Kid2 because their greencard was issued as a CR-2 instead of and IR-2.  Same thing happened - got a reminder to file ROC after we'd already received the corrected greencard.  Nothing has happened.  We're still keeping calm and carrying on.  Haven't had any issues and we've traveled out of country and back again.

  3. I ended up calling USCIS this morning and the first representative I spoke to told me that I shouldn't have the 10 year GC, and that I should have filed for the removal of conditions. They escalated me though, so now USCIS is calling within the next 30 business days and they suggested me that meanwhile I should seek legal advise since I am already out of the timeline to file the removal of conditions. I, then, called USCIS again and this time another representative told me to disregard the notice. I am so confused!

    Ignore it.  Your marriage certificate, I-485 approval notice, I-90 approval are more than enough proof that you are rightfully entitled to your 10-year GC.

     

     

    Did your USC husband also mail in an I-865?  If not, he should, so you have more paper trail that you did everything required to update your address info with USCIS.

    My husband hasn't filed an i-865 - I will look into filing. I also realized that when I filed my AR11 online I haven't linked to any cases, since I didn't have any case pending at the moment (my AOS was approved and I had my 10 year GC) so maybe that's why it got sent to my old address?

    I currently have a 10 years green card that expires in 2031. At the time of my adjustment of status interview I was married to my US citizen husband for more than 2 years, but after the interview they wrongly sent me a green card that was expiring in 2 years. So, I filed a i90 and requested to replace the 2 year green card with a 10 year one, since the conditions shouldn't applied to me because when I became permanent resident I was married 2+ years. My i90 was approved and they sent me a new 10 years green card after a couple months and I have been using that one since. Today I received in the email a notice that says that I should apply to remove the conditions on my permanent resident card. Unfortunately, this was sent back in September but they had my old address on file (even if I filed an AR-11 as soon as I moved almost 2 years ago) and the notice got resent to right address only in January. What should I do? Should I contact USCIS? Or should I ignore the notice, since I have my 10 years green card? 

    I am afraid that in their system I am a conditional permanent resident and I am outside the time of filing for the removal of conditions. I have been a permanent resident since January 5, 2021.

My wife called on January 19th and spoke with a Tier 1 for the same reason as you (i.e. has pending I-90 and is requesting ADIT stamp in passport).     I ended up getting my appointment (even if way after 7 business days) and got the ADIT stamp. Hope your wife got it too. In fact, I have a question: the officer wrote under the stamp things like my alien number, the i-90 confirmation number and I think also the date when I became permanent resident. But it is wrong: instead of 01/05/2021, it looks more like 01/05/2011. Do you think this is a problem?

    I called USCIS on Wednesday 01/13 to schedule an appointment at my USCIS office to get an ADIT stamp, since they made a mistake on my green card. When I called the USCIS officer told me I would receive a call within the next 7 business days to schedule the appointment. I still haven't received it. Should I call USCIS back on Monday? Or should I keep waiting?

I politely told him about the error and we're already married for 2+ years. He noticed the marriage date and we received a 10 year green card. 

    Hi. Thank you for sharing your experience. I was just thinking that I should have highlighted that we were married 2+ years during the interview and asked if that means I will be receiving the permanent card. But we talked about our second anniversary at some point and the officer also asked us the date of our wedding.  Also during the interview, I was pretty nervous and a lot of things I wanted to say I didn't say. 😬

    I just filed the i-90 online and along with it I attached:

     

    - a copy the green card;

    - a copy of our marriage certificate that shows that our wedding occurred more than 2 years before I became Permanent resident;

    - a copy of the NOA2 for the i-485 showing that has been approved more than 2 years after our wedding;

    - a copy of my passport (biographical page).

    - a cover letter explaining the error and why I should have received a Permanent GC.

     

    I hope I sent enough documents. Now I just have to wait about another year to have the GC corrected.

  10. I am sorry to disturb you again. But I am filing the i-90 online and there is a question I am not sure about. The question is "what is your current immigration status?". I don't know if I should click on "Lawful permanent resident" or "Conditional permanent resident". I should be a "Lawful permanent resident" but my card shows wrongly that I am a conditional one. What to do? Thank you

    File for I-90 online, so you don't need to send the card right away. When they're ready to issue the new card, they will send a RFE requesting the old card. And before you send the card, you can get a stamp if you need it for something.

    This morning I called USCIS and I spoke with a very nice representative that told me to file online, and even if I don't send the physical card I cannot use it (he said that once i file the i-90 that card is voided). So after i file the i-90 I should call USCIS again to get an appointment at my local office and get an ADIT stamp on my passport.

     

    Thank you all for your responses! It is a bummer that after waiting for more than 2 years for my green card, now I cannot even use it. But today I am definitely more positive, because I know there is a solution! :)

  12. Okay. I already saw that in case of error I have to send the original card with the application. This is incredible! Can I use my EAD meanwhile (until June when it expires) or should I just go ahead make an infopass appointment and get the i-551 stamped in my passport? Also, I saw people talking about expedite requests for i-90. Does anyone have more info on that?

    I just received my Green Card and I am beyond surprised that it expires after 2 years. I am guessing it is a conditional green card. This doesn't make sense to me. I thought that if at the time of the interview I was married more than 2 years with my USC husband, I will be getting a permanent green card that lasted two years. Are the rules changed or am I not remembering correctly?

    Also, photos certainly don't hurt. In my experience, immigration officers like looking at photos

    I agree. Me and my husband never got rings. Not for the engagement, not for the wedding. It never came up, not during the K1 interview and not in the AoS interview.

    Let me see if I understood correctly. Your friend didn't end up doing the I-693, had the interview and they didn't even ask them the I-693?

    I would say it's because if you do your medical in the US, you have the option to take it straight to the interview. So if you chose to do it too early, it's your fault if it's take too long to get the interview scheduled. 

     

    For K1s, AOS is a continuation of the process started in the embassy, so it doesn't make sense to require a new medical, therefore it doesn't make sense to blame us for the long wait to get the interview scheduled.
