    Why can't my spouse get his own private plan?  I have a low deductible plan for myself and our 2 children, and we just couldn't afford to add him when I'm finding individual non-subsidized plans for him starting at $300/month... 

    Catastrophic plans are only available for individuals under 30 years of age FYI

  2. Am I reading this WH proclamation right? - You have to prove at your visa interview that you will be covered within 30 days of entering the US... yet it doesn't tell you how to do this? 

    So my husband, the applicant, doesn't need to be covered now; we can wait until he qualifies for special enrollment (change of status) upon entering the US with his visa? 

    So how does he prove at his interview that he will get coverage within 30 days? 

    My first thoughts - he brings a printout of the plan he intends to enroll in, and a print out of our bank account proving funds are available? 

    I really wish these policies were clearer :(

    Hello!  Your 601a petition to waive the 10 year ban is sent to USCIS for approval, is that what you meant?  

    NVC is a completely different entity that takes care of your visa application and interview date.  It should take about a week for NVC to close out your case once they receive your ds-260, I-824 and civil docs.  Then up to 10 months to receive a visa interview date.  You can expedite for an earlier interview date if you meet the qualifications to do so on the NVC site.

    Wow sounds like you have a shitty attorney - they should obtain these documents for you - what are you paying them for?

    Well I haven't gotten anything in the mail. But then again I never got my receipt or biometrics letters.

     

    I called my lawyer and he is out until the 17 of this month.

    All the good luck to you!!  I'm sure it's an easy request.  I've seen more often than not, RFE's are usually for outdated evidence that just needs to be updated, now that agents cannot send out frivolous RFEs.  Do you receive emails in addition to your attorney?  Maybe the RFE will be something you could easily send in yourself?  So you wouldn't have to wait for your attorney ;) Or something his paralegal could take care of quick. 

    I am not working with a lawyer now (did for our I-130 years ago) yet our receipt and biometric letters went to our old attorney.  Called USCIS to correct but who knows if they actually did... making me nervous I will miss correspondence.

    Ugh I'm so sorry!  What did they ask for?  My receipt date if 9/20 and I use the USCIS tracker... I see the case before mine was approved weeks ago and the case after mine received a RFE...  why nothing on mine?? I really hate this waiting.

    I'd call USCIS and let them know you'd like your email address added to your case service list in addition to your attorney's.  That way you are always in the loop and know when you need to take action on anything immediately.  

  8. Does anyone know how long a B1/B2/Border Crossing visa permits a non-immigrant to visit the US?  I can't believe I can't find this on travel.state.gov

    2 or 3 weeks? 

    Can anyone tell me what "ties" they used when obtaining this type of visa for a Mexican? I see they advise not even getting plane tickets until after a successful interview 

    How does my MIL provide evidence that I am paying for her trip? An affidavit from me?

    Yes lol I would agree with that.  I'll be 50 when my kids hit high school :0

    She is not technically employed.  She is a full time caregiver to her blind husband.  Will get a doctor to provide a report stating this. 

    Getting her passport now; can't hurt to try.

    Has anyone seen this article? Anyone with experience in getting an elderly relative in Mexico a B-2 recently? 

    We had been told years ago by immigration attorneys that my mother-in-law in Mexico has no chance of obtaining a B-2 visa to visit us in Chicago for a few weeks but then I read this... 

    A little background - my husband is undocumented and we are waiting on our 601a decision before his visa interview in Juarez.  

    My mother-in-law is 52 years old, and she/my blind father in law own their condo in Tlaxcala.  

    With property ownership, roundtrip airline tickets, me covering all of her costs,  daughter/grandchildren/sisters/brothers and blind husband who she is full time caretaker for waiting back in Tlaxcala, could she obtain a B-2? 

    She would interview/fly from Mexico City.  I'll have to get her a passport.

    Ok so I'm a dumb dumb.  I've followed the NVC links to the federal police certificate to be requested from an office in Mexico City.  Anybody use a power of attorney in Mexico City to get this record? He doesn't a relative there.  

    I hope this is what NVC is requesting from us.  Tlaxcala didn't provide us with a prison record or a court transcript; not sure how else to get those items if the state police themselves sent an affidavit saying he has no criminal record UGH 

  12. Allow me to rant guys... I knew this would happen... NVC just emailed about our recently sent 260 doc packet - asking that we send his criminal record for it to be complete.  (My husband was arrested on his 17th bday and served some time before his family could save enough to pay his fine). 

     

    Months ago he went to the Mexican consulate here in Chicago and together they requested his criminal record from his hometown in the state of Tlaxcala (where he was convicted).  We in turn received a certified affidavit from "TLX Tlaxcala State Government, Office of the Procurator - General of the Nation"  stating "That after a thorough search in the State files of this Division, there were no Criminal Records registered against [Husband's Name]" 

     

    So... how can we produce something to NVC that doesn't exist? 

     

    The NVC request letter specifically says "criminal record" … am I missing another document all together?  Is there something on a "national" Mexican level that we can get? Like a whole Mexican country criminal record search? If so, how do we get that? I would of thought the Consulate would have requested that as well...

     

    My hubby is calling NVC today :(

    Absolutely! I've been checking back here almost everyday now that I am towards the "end" of our supposed waiting period.  Thankful for this forum.  I wish you all the best of luck and success. I too hate to talk about this with my hubby, I  know he is extremely anxious about this whole thing, coupled with the fact that if we are successful, he will finally be hugging his parents again for the first time in 20 years.  So much pressure on us, you know?

    Hi!  Of note - I've spoken to a few lawyer friends who advised that even if my husband were to get re-vaccinated here before going to his Juarez appointment, the interviewing agent or medical examiner in Juarez is under no obligation to accept the US record he would bring down and could still be requested to complete his vaccinations during his medical exam.  (Of course, do what you are comfortable with).  

     

    Up until a minute ago I had thought we had NOT received any update yet BUT, and something I just became aware of... you cannot see an "update" on your case unless you actually sign up/log into the USCIS website... I hadn't "signed up" my info/email until just now and all of a sudden my case status reads "updated 2/12" !! Awesome.  When I just searched my case number without signing in,  my status only says fingerprints accepted.  :) :) 

     

    I just completed our DS-260 yesterday and my I-864 packet should arrive at NVC tomorrow)

    I've done some more research, and it is my understanding that my husband will have to undergo a medical exam immediately prior to his interview in Juarez... if we aren't able to produce proof of his childhood immunizations, he will receive vaccinations then in the Juarez clinic he goes to :) Hope I am right...
