    just out of curiosity, I know you can find the field office’s mailing addresses on the USCIS website, but how did you know the exact officer?  Or did you just put “Attention: Immigration Officer”.  Or did you make it out to the office director? Can you please share some of those details?

    Hey!

    Well he’s the officer that signed our denial notice. That’s how we knew his name.

    we just put ATTN: his name and the field office address. We overnighted the letter on Thursday and we got a call on Monday :)

When we got back (on October 26th) I noticed that we still didn't get a new date so I started worrying, but then I thought it might just take longer, you know how it is...

    I let a couple more weeks go by and then I file an e-request (this was last week) saying that I requested a reschedule but stil l didn't hear anything...
    Well, yesterday I check the damn mailbox and we got 2 letters from USCIS, one for me and one for my husband saying that the case was denied because I failed to appear for my initial interview and didn't notify USCIS...

     

    ARE YOU (removed) KIDDING ME!?!??!?!?!?!??!?!?!?!??!?

    Of course it says that, if you think the decision is wrong, you can file form I-290B (notice of Appeal or Motion) and pay the designated fee of 675$, SIX HUNDRED AND SEVENTY FIVE DOLLARS AFTER I ALREADY PAID 2 GRAND TO FILE AND GOT WRONGFULLY GUDGED.

     

    I am LIVID and FED UP and it's things like these that make me want to pack my little family and move back to Europe :(

    I called USCIS again this morning and they escalated my call to a Tier 2 officer. I am waiting for a call back, which who knows when I will get...

    Anyways this is my situation atm. Any words of encouragement are appreciated, I'm so over it :( 

    If anyone has ever been in a similar situation please share your story.

    Thanks everyone for your positive words.

    I talked to a Tier 2 Officer yesterday and she told me that there is nothing else I can do at this point but to follow the instruction on the denial notice and file a I-290B to get my case re-open. I asked if I could get an infopass appointment but she said that I can't because a decision has been made and my case has been closed. She said that I could try to mail a letter to the office that denied me explaining the situation and see if the would reconsider their decision but she also said to be careful because if I wait around for an answer to that I might miss the deadline for the I-290B :(

     

    At this point I think I am just going to give up fighting and pay the 675$ fee for the I-290. It's a crappy situation and it makes me really mad that I have to go through this for a mistake that wasn't mine. Hoping that they will even consider my motion to reopen the case....

    You'll almost certainly get a re-scheduled interview, this exact thing has happened many times before. Some people have even gotten a denial letter for failure to appear without ever getting an interview appointment notice. It'll be a hassle and you may need to wait, but you're more than likely okay. In the absolute absolute worst case scenario you'll probably have to refile the I485. Hang in there.

     

    You are lucky the I485 wasn't denied while you were away, as that could have caused issues re-entering the country on Advance Parole.

     

    This exact situation is why most lawyers will advise against leaving the US until the I485 is approved unless it's an emergency.

    Thanks for your words of encouragement. Yeah I was thinking too that I got pretty lucky with timing, but yeah it's a pain now to try and get the case reopen. Still waiting for my Tier 2 Officer callback so we will see.

    I see you're in LA. So am I. Mine took 14 months to from filing to approved at interview. It hasn't been a year for you. Sorry but all you can do is wait. Most people wait about a year for the interview date.

     

    For EAD renewal, I believe you can apply 90 days before the expiration.

  6. Hello all. 

    I’m just wondering if anyone has a similar timeline as me and is also waiting for an interview date.

    I got married in October and filed for an adjustment of status from an F-1 visa in November and got my EAD card after 5 painful moths lol

    I was really hoping to have my interview date by now but still haven’t heard anything. Online is still saying that my case is ready to be scheduled but that’s it.

    Anyone else going through the same thing?

     

    Also in case I’ll have to renew my EAD card, how long in advance should I do it to avoid work gaps?

    Yeah my online status is updated to "your card is being produced". But it said that on April 3rd and now it updated the date to April 9th, but it's still saying the same thing. Shouldn't take a week to produce a damn card

    ugh! I am sorry you're going through that too! It's been two weeks for me and nothing. What number did you call?

    When I passed my drive test, I made sure to ask about the upgrade from a DAC card to a State DL. States vary- we all know that! In Nevada, she said that once I had my EAD, I can upgrade and bounce back and forth between a DAC card and State License (considering variable such as when my EAD expires + date I obtain my GC). I know CA may differ as per state but I'm pretty sure it does have something similar to a DAC. Maybe, it could be a temporary 'fix' until you get your EAD in order to prevent your DL expiring? 

     

     

    Thanks so much for sharing your experience! Yeah I think I found something similar. It's called AB 60 License and it's a license that they give you if you don't have all the required documentation for a regular one. So I'm gonna try and do that and then switch to a legit one once I get my EAD card.

  10. Hey guys!

    My driver's license is expiring March 1st and I am trying to figure out a way to renew it. On the DMV website it says that I need verification of legal status but I still don't have my EAD card and I don't even have an approval notice yet. The only thing I have is the I-797C receipt. But they don't mention anything about them accepting that as proof.

    What can I do? Anyone had the same issue before? I live in California.
