We had employer-funded legal support and were, honestly, pretty disconnected from the green card process as the heavy lift on Information and document preparation was already done for the O1, except for some new/updated recommendations. Sorry not to be more helpful, but I did want to respond as O1/EB1 are such a small group on VJ.

Were you successful? I'm going from o1a to niw, given how stringent the criteria fro eb1 are

Case was with Nebraska and my I-140 got denied after RFE. Hopefully  i will get positive response from USCIS.

I also have an niw case in Nebraska.  How long did it take for them to send the rfe? When was this? Best of luck. Definitely cheering for you

    Thank you for your reply.

Yes i had appealed for I 140 decision. Am i going to get official letter of the decision of my case from AAO or USCIS is going to review my case again?

    Thanks

Either way, seems like you have to wait.... I know how long and frustrating that can be.

Was your case in Nebraska or Texas? How long did the first adjudication take (before rfe or denial)? Thanks so much for the input.

You don’t need to leave the US if you can find another job before a bit your interview.

If your i485 has been pending for more than 180 days and if you can find a new job with similar position and duties, you can continue getting GC under current i485.

If its pending for less than 6 months and you find a new job, they will have to file a new i140 for you but previous i140’s PD is retained.

Depends on whether this is an eb1a, b, or c petition. Eb1a does not require you to wait 180 days, unless the applicant was your employer on your behalf.

Question: did they schedule the interview before the pandemic started, or under the assumption it would application centers would open?

    Congrats.

Does the card have any biometrics on it? If so, seems like they reused either the ones from the visa application or POE (more likely the latter).

Hi Geowrian, my card has my photograph and it says "fingerprint not available" where my thumb should be. It also says "Terms and Conditions: None." It's a combo card.

Are we suggesting to split that forum (it covers both immigrant and non-immigrant work visas).

This is the work visa forum description:

"Discussion on Work based visas to the USA. H1B, H2A, H2B, H4, L1, L2, O, P1, P3 and Q1 Visas. Hundreds of thousands of people enter the US each year and may even choose to immigrate to the US."

it is not clear that it is also intended to cover employment-based immigration.

Maybe add the employment-based immigrant visa category as a subforum?  Should probably audit the existing forum to estimate the potential traffic in a new subforum.  The entire Work Visas forum seems to be one of the more lightly trafficked forums now.

In terms of being lightly trafficked, that's why I mentioned the DV subforum and I believe I saw TPS and military. Are those also more heavily trafficked than work?

But if this is and issue, though, should the work section actually be  "employment-based immigrant and nonimmigrant visas" do those who followed paths similar to mine know for sure where they should be posting? The problem with being in the same subforum as family-based aosers is you end up with a lot of irrelevant information,  quite a deal of misinformation,  and even some nastiness.
