These retrogressions happen almost every Aug or Sep for ROW. It's normal and nothing to be concerned about (end of fiscal year). Oct 1st it'll be back at current for ROW EB2/3.

I would normally agree with you, but this is exactly what happened to eb1 last year. It was backlogged around this time of year and then never went back to being current since. Hopefully you are right though

Oh because I went through NOIR, my ESTA was revoked. Can never travel to US without a visa again so Consular Processing in London is only way for me. Others have used Belfast for non immigrant petitions.

I’d have been spitting feathers had I been denied. Since my interview I’m owed $26k in producer fees, have one current and one future film producer credits and a deal to write/direct one more of my own.

There was at least one VJ member who cyber stalked me over my original interview experience. Nice to prove doubters wrong 😉

If you would like to speak to a lawyers at a lawfirm that has helped me a lot on O and now niw, let me know

My PD is April 2017 and I’m affected by this too, as my petition just got reaffirmed.

My attorney said to me that he expects the retrogression to resolve by October bulletin. That’s the next fiscal year apparently.

best of luck. i will file an eb2 and need final action date to be current for adjustment of status as well

It' interesting how that sort of issue never comes up with countries like Sweden, which the president so much admires

Anyway, if you don't recognize racism in America, I recommend any history book, tv show, radio show, anything really

Pakistan complicates matters because of its security procedures and specifically, the problems involved in background checks when police, prison and military records are unavailable. This is why AP is an issue. Strange how people are willing to throw racist labels around  (easier than trying to understand procedure I guess) yet still want to move here.

Everybody goes through AP, Pakistan obviously complicates matters.

The country is racist and doesn't even try to hide it. Hopefully no AP this time. Hopefully it wasnt the case that they confused your name with someone else's in the previous AP? Are you also looking at NIW for physicians as your next step?

    Hello everyone,

A brief introduction about myself.  I am a physician, and I have been in US since 2008. I came on a B2 visa, and took all my USMLE exams, got The ECFMG certification, and started working as a post-doc research fellow on H1b (status change), till 2011. I then began my general surgery training, and again changed my status to J1. I completed my general surgery training in 2017, and took my boards this year to become board certified General Surgeon. At present I am completing my thoracic surgery fellowship (still on J1), and will soon be board eligible for ABTS, this Dec. I now have a job lined up, in a thriving practice, and they specifically hired me based on my expertise in robotic thoracic surgery. I am a published author, with numerous publications, I have given lectures and talks at various national scientific meetings etc.  I hope my O1 petition gets approved soon, filed as premium processing.  I have a family here, wife is undergoing GC processing, and two kids who are US citizens.

Heres the the tricky part, and the reason behind multiple status changes in US.  I once, long time back, in 2008 had to undergo administrative processing and lost the residency spot at Cleveland clinic, due to the delay.  Now, having to go through the same process of leaving the country and applying for visa at US consulate in my home country is scaring the out of me.  I gained some good insight from

reading about other people’s experiences here, and I am thankful for them to share it here. I will do the same, and hopefully may help myself and some future O1 applicants.

Thank you you for reading, I wish you luck in your endeavors as well.

    Status:

07/12/19 - Date of filing O1 petition ( premium processing)

Best of luck to you! What country are you from, if you may share? I had the same fear as you wjen undergoing consular processing

    Hi ladies and gentlemen,

I have got a question. My partner has applied for O1 visa 2 weeks ago through the standard process. Since we are in a bit of a hurry we are thinking to change it to a premium process. But we also have heard that the premium process is more difficult to get approved. Just wanted to know your experience with premium and standard process, is that a correct statement and the approval of the premium visa is really more difficult than the standard process or they are not different at all. Appreciate your responses.

I would wait two more weeks and then update it to PP. The problem with PP is that sometimes they run short on time and send an RFE, but otherwise it should be the same. Giving them an extra month (two weeks in addition to 2 weeks already given) should give them plenty of time

As we were confident to meet EB-1A requirements (or as confident as one can be given the vagaries of immigration) we did not consider NIW nor did our lawyer suggest it. We used premium processing and the 15 day timeline for approval was met. The frustrating wait was to receive the AP for travel. Interview was about 1 month after that and then a few more months to receive GC in the mail from our lawyer. Sorry not to be more helpful on the process. It was all done behind the scenes via counsel. We never bothered to check status online, just waited for him to call with updates at various inflection points in the process.

Thanks for your message! Im actually quite confused as marriage gc and perm process are also possibilities 🙄 Happy to hear of your success! All the best

O-1A with premium processing was about 6 weeks in 2017 from initial filing by our lawyer to getting the passport delivered back from the embassy post-interview. It was a ton of work on the front end to ask for letters and consolidate them and other evidence, but easy and fast after uploading it all to the lawyer to handle.

The EB-1 process was more frustrating in 2018. That was more like 4 months from filing to EAD/AP combo card, and 9 months total to have the GC in hand.

Good to hear! My O1A was filed in june 2018 and I got the visa in Sept with premium processing after an RFE. Did it with a lawyer

Would you describe the EB1 process? Was there much more scrutiny? Did you consider NIW and reject it? Thank you

    Hello,

i got I-140 approved (EB2-NIW) and I am applying for AoS. my lawyer alerted me that my last DS-2019 still had 212(e) ticked even though I received J1 waiver at an earlier date. He claimed that this voided the waiver and urged me to reapply for the waiver to cover all my DS-2019s. I do not trust him because I used the same J1 waiver and all my DS-2019s to apply for H1B and I successfully got it. Can anyone’s provide a second expert opinion on this matter?

Hello, were you  able to solve this?

It was an O1b visa (for artists). The reason for the EB1 denial was that I wasn't quite accomplished enough to satisfy the EB1 standard.

Here is a very encouraging extract from the Foreign Affairs Manual:

"DHS has determined that the approval of a permanent labor certification or the filing of a preference petition for an alien shall not be a basis for denying an O-1 or O-3 petition, a request to extend such a petition, or the alien’s application for admission, change of status, or extension of stay.  The alien may legitimately come to the United States for a temporary period as an O-1 or O-3 nonimmigrant and depart voluntarily at the end of his or her authorized stay and, at the same time, lawfully seek to become a permanent resident of the United States."

EB2 is more relaxed than O1? How?

I always think EB 1/2 are the most stringent than O visa.

Looking at the requirements for O1 it looks like you would have to be an internationally recognized figure with an advanced degree from University

    Hi Mesden,

Did you get this information from a lawyer, from experience, or is it an opinion? I have o1a and want to do niw, but i am worried that i wouldn't qualify, especially before i publish something in English.

I very much look forward to hearing from you and ijj on this matter
