    From your wording it sounds like you have a joint sponsor. In that case, YOU still have to sign an I864 and provide 2021 tax transcript or a letter explaining why you haven’t filed taxes.

  2. Here are the things that my wife will bring to the interview. Also some questions about a few documents are needed at the end. 

    Please advise. 
     

    Applicant

    • 2 photos
    • Passport + 1 copy
    • Police Certificates + 1 copy
    • Marriage Certificate + 1 copy
      • Letter explaining why we don't have the required marriage certificate. (Long story, see my previous posts.)
    • NVC Interview Letter

     

    Petitioner

    • Copy of my passport
    • Copy of my birth certificate (Does the applicant need this? Does she need an original?)
    • Proof of Domicile
      • Bank statements
      • Offer of Employment
      • Cell Phone bill
      • Renewed Driver's License

     

    Financial Sponsor

    • 2021 Tax information (the sponsor did not have 2021 tax info when we submitted I-864.)
    • Copy of birth certificate (Is this needed? Is the original needed?)
    • Proof of Domicile (Is this needed?)

     

    Questions

    1. Do I need to provide an original birth certificate for me, the petitioner?
    2. Does the financial sponsor need to provide an original birth certificate?
    3. Do we need to print a copy of the DS-460 (the immigrant visa application)?
    4. Am I missing anything?

    She did her medical a couple of days ago. She has the sealed folders b/c the digital system was down. Her interview is Nov 30.

    We rescheduled my wife's CR1 interview.  I sent them emails once a week for the request.  The first two responses from the embassy was that there were no dates available.  The response from the 3rd request detailed 2 earlier days that were available, and they instructed us to use USTravelDocs website to reschedule it ourselves.

     

    Thanks! Was the rescheduling pretty smooth? How much earlier was it?

    Also, technically a person can have the medical as early as 5 months or so from the interview.  The limiting factor is that if approved, the visa expires 6 months from the medical date.  This does not give someone a lot of time to travel to the US before their visa expires.

     

    Yes only 2 doctors in France. Both in Paris. Unless I'm missing something?

     

    We're trying to have a family Christmas in Texas so not worried about validity of the examine.

    I'm trying avoid two trips to or a lengthy stay in Paris. Just got notice of interview date today for the end of November and will try to have the medical next week. Thank you!

    I would hold off on any further steps/planning until you receive your interview date. It might be as early as November or as late as next January.

    Yes, we need to be back in the USA by mid November for other reasons. What I am aiming to avoid is a long, unknown length of separation. The kids are still pretty young and will miss their momma. 

    4 months! Man, that seems long. I hope that's b/c of summer holidays. France has quite a long vacation where most bureaucratic things just stop. Not sure if it applies to the US consulate as well.

  9. So my wife was DQ'd and is now waiting for the Paris consulate to schedule an interview. I'd like to thank a few people, namely @Crazy Cat, @pushbrk, and @ROK2USA for all their help answering so many of my questions. There are others, but those 3 have really been there for me and for that I am very grateful. Thank you! 

    So...what comes next? We were DQ'd on the 6th of September. How long until the file is at the consulate in Paris? How long until the interview? How long after the interview until she has her visa (assuming, of course, everything goes smoothly.)?

    I'm trying to avoid a lengthy family separation. In your opinion, if I buy a ticket to the USA (we're long time expats!), for myself and the kids on November 10, is it reasonable to think that my wife would be nearly done with the process by then? I know that these things are not an exact science, but I'd love to hear what you think.

    Ok, thanks. Yes, I was assuming we'd bring the updated I-864 to the interview. No pay stubs, but the pension and Social Security documents I provided and that were approved are up to date, I believe. 

    So I'm not going to do anything until after DQ'd, and then I'll replace the documents. Is 'replace' a choice or am I going to be submitting them as an "optional" document? 

     

  11. In April, I submitted all the NVC paperwork. We have a joint sponsor. Among the paperwork was an IRS extension for 2021 taxes. That extension is valid until October 15th or so. 

    In June, our paperwork was rejected by the NVC b/c we did not have the right marriage certificate. All of the financial paperwork was listed as 'Accepted' in our CEAC dashboard. 

    As of yesterday, the joint sponsor has filed the 2021 taxes. 

    Question: Do I have the joint sponsor fill out a new I-864 with the current year taxes or do I let it be?

    The IRS extension is good until middle of October and our documents will be looked at late August or early September. 

    Another rejection by NVC would be really bad for us so I'm reluctant to roll the dice on new paperwork, but I'm also not sure if they will now reject the I-864 b/c the 2021 taxes are still not there.

    I follow your argument and thank you again for the help. I just don't know what ACTION i'm expecting from the congresswoman. I'll look into appealling. Why not? Thanks!

    I'm writing to her again right now, though the person who was looking at my case is out of the office until Friday. I'm sending an email to someone else in the same office. 

    What EXACTLY do I want to ask them to do for me?

    Your translations ARE not the document, the originally submitted and rejected m/c needs to be looked .

    Thanks, I wasn't expecting expedite to be approved either, but I thought it was worth a shot. 

    So the Congresswoman has said, "this closes your case with our office." 

    I'm currently drafting an email to my Senator, Ted Cruz, to see if he can try. Or stick with the Congresswoman?

    So I just got word from my Congresswoman's office and basically, she's been told that they will look at my document in the order it was received. So absolutely 0 help. Also got rejected for the expedite.
