Irish and South Korean police certificates are available to those who are required to have them.  In your wife's case, upload a letter stating that the requirement is not applicable because of the short duration of your wife's stay.  Note that the interviewing officer has discretion to ask for the police certificates anyway, but that's rare.

Thank you. So upload the letter at CEAC in lieu of the Police Report at this menu? (See attached photo).

    Upload it under "Upload Document'?

We uploaded a detailed letter indicating that based on the State department’s website, a new certificate is not required. And we included the screenshot from the website. We added my husband’s old expired certificate showing the date of the previous certificate, along with a lease from the new country we were in to show he lives in a new country.

Sorry to hear you had to go through that. Hopefully all finished now?

My husband and I are examples too. We submitted a screenshot similar to yours showing that if we moved from a country after the last certificate was obtained and haven’t been back, we don’t need to submit an updated one from that country. Well, we got an RFE.
If it’s possible to get one, I recommend getting one.

    Thanks.

What did you upload to the CEAC site in place of the police certificates that it was looking for?

Do not select "Not Available" for police certificates, unless your wife never lived in France (country of nationality) or Taiwan (country of current residence) for more than 6 months after age 16.

    We have those police certificates.

She lived in Ireland at 18 for 7 months and Korea 15 years ago for 10 months, but we do not have those. We did not get them b/c they are clearly outside the bounds of the guidelines set out by the government.

For Ireland and Korea do I put 'Not Available'? I've read others writing an explanation letter and submitting that.

i did not read in any of his responses where he told us where she currently lived and if this was her country

he says it will be difficult to get but he does not ID embassy ,  her country and give enough info for a good reasonable response

our embassy request 2 clearances (criminal report and driving record) and clearance from any country lived in for 6 months

Our case is currently scheduled to be interviewed in Taipei, but I have submitted an email inquiry to the NVC to move the case to my wife's home country of France.

Yep,, from the following site US immigration site:

      INSTRUCTION FOR IMMIGRANT VISA APPLICANTS

    https://travel.state.gov/content/dam/visas/Supplemental/RGA - Riga.pdf

    5.POLICE CERTIFICATES: Each visa applicant at least 16 years of age, must submit an original police certificate:  from the police authorities of the applicant's country of current residence if the applicant has resided there for at least six months after attaining the age of sixteen;

I'm sorry, but that clause is for "country of current residence." The country I am talking about is NOT our current residence nor is it the applicant's country of nationality.

NVC is unpredictable. Just to give you an example, NVC also states in its instructions on I-864 that if IRS transcripts are submitted then W2s are not required. However, many here on VJ have reported getting RFEs for W2s even though they clearly followed the instructions on the AOS form.

Long story short: Submit a police certificate if she has lived more than 6 months.

That's a very tall order at the moment. We followed the instructions according to the travel.state.gov website on civil documents and now we are not in a position to get more certificates without undue hardship.

Do you agree that according to the photo linked (from the travel.state.gov site) that they are not required unless living 12 months or more? I'm just making sure that I am reading it correctly.

  7. So I just submitted my wife's DS-260 and now I'm looking at the civil documents.

My understanding is that police certificates are not required for any place that she lived less than 12 months.

So do I just select 'Not Available' on the Civil Document upload menu?

I'm attaching the Travel.state.gov flow chart that clearly indicates 12 months or more as the bar for police certificates

Btw, this is potentially an important question. USCIS, for example, has a new policy of rejecting forms that have any fields left blank for some visa types (see this article in the Washington Post a couple of days ago). It's worth being careful and keeping an eye on how the Dept of State / NVC is handling such frankly minor / irrelevant aspects of applications.

I'm planning to manually write in "N/A" everywhere on the I864EZ form when I print it to sign, but would love to hear if others have had any experiences or received any advice related to this. This would all really be much easier if the I864EZ form allowed one to enter "/" and comply with instructions...

    From the WaPo column:

Any updates on how this went? Did you write N/A or NONE in every blank space?

Some countries they will require a new I 864 and 2021 tax transcripts before they dq them and send to embassy

but others say take the new I 864 with tax trancsripts to interview

U will need 2021 for both u and joint sponsor  by interview time (as your interview will not happen before the 18th of April)  or case will go into AP while the CO waits for them

Thanks, any idea how to figure out which countries? We are interviewing in Paris.

  10. I'm about to file the paperwork for my wife at NVC

My dad is the joint sponsor.

We will file before April 15 so technically the most recent tax year is still 2020.

Question: will NVC send me a checklist for updated tax info when they review our paperwork in ~2-3 months time (by then the 2021 will be the most recent) or will my wife just be required to bring it with her to the interview?

Alternatively, my dad will probably file an extension. He retired in 2021 and has letters of declaration for his retirement income that is more than enough to qualify as a financial sponsor.

    Hello!

Sorry if this has been asked elsewhere, does anyone know the wait time for an interview at the Paris embassy after DQ, cr1 visa?

My husband is French, we are currently in Ireland and have just been DQ'd. We are thinking about moving back to France and transferring his case to Paris. I've looked at timelines on here and it seems some people have only waited a couple months for an interview recently but it's hard to tell if these were expedites or special circumstances.

    Thank you! 😊

How long did it end up taking you?
