That section does not apply to you.  That's only for fathers petitioning for a biological child born out of wedlock.  In Part 1 of the I-130 form, did you select relationship "Stepchild/Stepparent"?  Do NOT select "Child was born to parents who were not married to each other at the time of the child's birth".

The required evidence to establish stepparent-stepchild relationship are "a copy of the marriage certificate of the stepparent to the child’s natural parent showing that the marriage occurred before the child turned 18 years of age, copies of documents showing that any prior marriages were legally terminated (if applicable), and a copy of the stepchild’s birth certificate." -- https://www.uscis.gov/sites/default/files/document/forms/i-130instr.pdf

Yeah, I double checked that I've selected child and then Stepchild/Stepparent. Still asked me for all these. I've just uploaded the birth certificate for the second time and submitted. Fingers crossed.

  2. My wife got GC recently and I'm US citizen. We want to file i-130 for my stepson who lives with his father now. I'm e-filing I-130.  The form asks me for the "Proof of parent-child relationship". I've already uploaded his birth certificate and the marriage certificate. What should I upload there?  Should I just upload the birth certificate the second time?

Here is the comment on the form:

    Quote

Upload evidence that the child was legitimated under the law of the child's residence or domicile, or under the law of your residence or domicile, before the child reached 18 years of age.

If your child was not legitimated before reaching 18 years of age, upload evidence showing that a bona fide parent-child relationship existed between you and the child before the child reached 21 years of age. This may include evidence that you lived with the child, supported him or her, or otherwise showed continuing parental intererest in the child's welfare.

As far as I know, she would have to establish legal residency in a third country for the interview to be moved to a new consulate, and keep in mind that could also add delays at the NVC stage. ...

I've read some success stories about transferring to consulate in Warsaw (this is what Moscow consulate recoments in their FB group) and people transferring their case to Kyiv before whole Covid thing. But official Warshaw is risky as the country is closed to russian tourists. Are you sure that legal residency is an absolute requirement, not something that up to the embassy to accept the application?

  4. My wife case is in NVC waiting for an appointment since May 2020. She is Russian and we selected Moscow consulate. The Moscow consulate is currently closed and it doesn't look as it will be conducting routing interviews any time soon.  Out 2 years marriage anniversary is in mid April this year.

What are the disadvantages of moving the case to a third country consulate? We are considering consulates that seems to be open enough to conduct even B visa interviews (e.g. Greece/Athens, Tajikistan/Dushanbe, ...)

Should we wait for our 2 years anniversary, is it a better chance of success after it when we move to IR category?

I'm living 50/50 in the US and Russia for about a year now if it is relevant.

I might have suggested this in a different thread.

For interviews, it might be worth checking the U.S. consulate in Mongolia.

A few years ago, a couple headed that direction and had a positive experience.

"As of December 22, 2020 visa services have been temporarily suspended. Due to the recent decision of the Mongolian State Emergency Committee (SEC) to declare a strict quarantine, the Consular Section at U.S. Embassy Ulaanbaatar has moved to a reduced operating posture. This change has necessitated the cancellation of some appointments that will be rescheduled to future dates as soon as possible. The Consular Section hopes to once again resume these visa services as soon as it is practical and safe to do so."

To answer both of your questions, you can attempt to get into Poland by getting an Italian Business Schengen Visa (approximately 700+ Euros), apply for a Greek Schengen Visa, and/or apply for Polish Student Visa. These are all methods that have worked for others. We went the Greek route.

Thanks! Did you enter through Greece or directly from Russia?  What about getting IR1/CR1 in Greece, Switzerland or other places that are open to Russians?

    Hello guys

yes we transferred our CR-1 case to Poland and within 3 weeks we received our visa. Message me if you guys need help with anything!

at the moment there are no transferable cases other than IR-1, CR-1, and other family based visa categories.

Were there any problems with getting CR-1 not at beneficiary place of residence? Did you need to do anything extra except  translating Russian documents to English?

Tiny update but.....who knows, maybe it means they are moving?? Now it says:

    • Both the U.S. Embassy in Moscow and the Consulate General in Yekaterinburg are currently processing a limited number of interview waiver visa renewals for C1/D, F, M, P1, and P-4 visas. For information on how to apply, please visit https://ustraveldocs.com/ru.

For reference, I looked it up and P visas are for athletes and entertainers, M visas are similar to student visas. Again, very random choice here, especially given the pandemic but...who knows? Maybe they'll add more visas to the list soon.

Edit: looks like they're doing renewals only but still, at least something new was added to the list. 🤷‍♀️

I bet it is because these visas can be "interview waiver". Mission critical list will make more sense otherwise.

  9. The wait time depends on when US consulate in Moscow will resume the visa processing. Nobody knows for sure, but I'm pretty sure that it will not happen till COVID situation in Moscow will be back at least to August 2020 level.

If your wife has a valid US visa she can visit you. A person entering US with B1/2 shouldn't demonstrate immigration intents. If she wants to visit US as a tourist and return back after a few weeks and will not mention her US citizen husband that shouldn't be a problem.

    Hello!

Since you mentioned transfering case to Kazakhstan, seems your docs is ready and you filled the DS-160 form?

Can I ask may be silly qustion. I'm a bit confussed.

Most of guys from Russia here mentioned that they filled the DS160 form.

I started to fill up my DS-160 back in March 2020 but at the very last step there was a question, something like "Have you read the brochure IMBRA that was sent in package  by the US Embassy?" and the answer assumed only "YES". But since I havn't gotten anything yet from the Embassy and coudn't say "YES". So no accomplished DS form.

Did you guys fill the DS-160 form anyways or you got the package from the Embassy to get ready for interview?

I would really appreciate your answers.

I'd suggest to find IMBRA brochure online (https://www.uscis.gov/sites/default/files/document/brochures/IMBRA Pamphlet Final 01-07-2011 for Web Posting.pdf), read it, check the box and finish the form

  11. Russian version of the text on visa page changed to:

    Quote

    English is still:

    Quote

Out of concern for the health of our Russian and American staff and the public in light of the global COVID-19 pandemic, the U.S. Mission to Russia has reduced visa operations and routine American citizen services.

Consulate General Yekaterinburg has begun to accept a limited number of interview waiver visa applications for C1/D and F visas ONLY.

since then my husband started threatening me on whatsapp, he is saying that he is going to get the marriage annulled based on green card fraud and that he will report me to the USCIS so I'll never be able to use my green card to come back to the states.

He also said that if I want a simple divorce then I should send him money for the rent on his apartment,

    ...

    Sounds like extortion to me.

I wonder how a person who has no income can afford a decent lawyer? Sure he will get a free consultation, but will he be able to hire one?

Depends on the embassy. Belgium's gotten to the "let's just open all stores and malls and pretend people will stick to the rules" portion of reopening a few weeks ago and the embassy still isn't interviewing people. It'll most likely depend on what the Department of State says, instead of the situation in other countries.

I bet we need Department of State decision to open according to the situation in a country (we need both)

Thanks in advance for any help. 😀  Sorry if the questions seem stupid but I want to make sure I'm doing everything correctly.

    1. My wife has been to the U.S. 7 times in the past as a tourist.  The previous U.S. travel history section won't let me make a 7th entry.   I've tried different browsers (including IE on windows) and it won't let me make a 7th entry.  Is it maxed at 6 entries?

She is a certified nailist in Japan and plans to get a license in the U.S eventually.  I want to make sure I'm answering the following 3 questions correctly.

I believe this would be a yes?

I believe this would be a no?  Nail school isn't medical school as far as I'm aware.

I believe this would be a no?

I currently live in Japan and will be returning back to the US permanently in early August.  In the petitioner section I'm assuming it would be best to put my US address. I will be initially moving back to my brother's condo in Chicago.  I'm pretty sure I should list this address.  It would be nice if I could make a note in the application telling them this, but there isn't.  In the i-130 I made a note about me being currently in Japan but moving back in August, so there is a record of it.

Hope you and your family are healthy and safe.  Thanks again for any help.

    All 3 should be "No".

    2. I hope, her purpose of entry is to be with her husband, not to perform "skilled or unskilled labor" - otherwise it looks like a visa fraud/fake marriage for entering US and work purposes

3-4. No, as her purpose of entering in not to work and being a nailist is not considered to be a healthcare or medical services profession in the US

It's the less infected countries that infected the larger one.

But that's irrelevant, all it takes is one person to cause an outbreak, but you don't care, you only think about yourself.

The past tense is the key. The outbreak is already here and we are talking about now, not about some point in January-March applying 20/20 hindsight.  There is more sense in quarantine after riding NYC subway than after visiting Europe and taking all precautions possible. How about quarantine after a trip to a local supermarket? Are you sure that there less chance of contracting  it there?

So maybe instead of labeling people irresponsible by default one should think of a context that may differ from a remote village?

I'd love to see some recent data about %% of infected passengers from the international flights

Thanks for the response and my wife is American :)

I can see everyone's point that its unlikely for them to go to video calls, however the longer the lockdown and pandemic continues the more all businesses (and even government agencies) will have to look at alternative ways to do things.  Maybe the video call could be done in neutral 'hub' away from the embassy but where the identity of the applicant can be checked (this would mean less people having to travel to London which even when the embassy reopens is going to be an issue for some time) , a town hall or something?  We have fingerprint technology on phones so surely there is a solution to do this remotely.. logging into the portal to do it with a code sent directly to the applicant from the embassy.  I suppose this doesn't stop someone fraudulently trying to use someone else's fingerprints (for whatever reason they would do that). I would think though the number of people sending someone else to do the interview or trying to use someone else's fingerprints are in the extreme minority, extra checks could be added on to mitigate as much as possible the chance of this happening...  checking fingerprints at the port of entry and they have to match the ones provided to the embassy, if they don't instant 10 year ban for instance...

This "hub" is called a consulate :) Some of them have glass booths with microphone-speaker and a drawer do pass documents. IMO, unfortunately it is more likely for the embassies to just stop issuing visas than go to some unprecedented measures to continue issuing them.
