    Took exactly a month (put in the request on Sept 10th). Asking the Congressman did not help, as they told me that my application for expedite was rejected. Nevertheless, super excited that my card is here. I can start work at my new company! :)

     

    Told you that aide was a bit confused. Your congressman very likely helped since put the request in officer’s eyes again. I would get back to that aide and let them know, clearly they do not know the power they wield.

    Depends how much the IO has. Truly if the officer said they were going to approve they should have approved the i130 very fast especially since you got the ROC files. You are going to have to make an infopass or reach scott peters/senator/ombudsman. Maybe IO went on vacation or taking time to check something hopefully otherwise they do actually want more information.

     

    Based on experiences seen in SD office, those not approved on the spot still got their i130 approved very quickly. The i485 took a bit longer.

    Maybe your reason for expedite will be stronger than mine and it gets approved. What reason did you use for your request?

    You can try your senator next to try to see if can get a better response. Truly that said your caseworker seems a bit incorrect, possibly if the application is at an officer that means it has reached someones desk and the expedite worked. Now how that officer deals with is a question and maybe its at the bottom of thier desk. But many people who got that response had their case approved in 2 weeks or so.

    Thanks so much for your message , The officer gave us the paper of “Removal of Conditional Status” The officer told us if she needs more evidences will ask us to mail her within two weeks..  The interview was in Aug 27.  Our update is still not change in the website, it does not show approve or deny or anything.  We feel the interview went well. Just don’t know why it did not update  yet 

    Is your i-130 approved?

    We were SD too. What did the officer say? Did you get the 2 slips for ROC and sign it? Have you got an approval notice for your i-130?

  6. Would it be fair if someone who did not have children or any interest in it, was your interviewing officer and showed bias? Would it be fiar if someone who has raised multiple children and considers its the main evidence, was your interviewing officer and showed bias? Would you welcome a scenario where there is a 50/50 chance one of those two situations occurs?

     

    I highly doubt you do, and truly hope you undersand that USCIS officers are trained to follow the manuals in place and assess every part and the entire case they are given. As well the procedure is to evaluate the case as a whole with the evidence given to them, while ofcourse anyone being human can show bias this is not exactly a situation anyone on VJ should prefer. The fact that a couple officers told you that "oh children is a very strong from of evidence I consider", just hope they had a bad day at the office cause that is not exactly a very good answer by them. Previously when have seen on here a few chances where people have posted discussions with senoir USCIS staff they met randomly, the majority of the respones was similar to "no one peice of evidence breaks/makes a case, they evaluate everything in totality."

     

    This process is not to show a family unit, how much two people love each other, how romantic you are, how intimate you are. While a few examples of stokes interviews, have shown pressure questions where an IO has asked about these things, intimacy as a example it is not the focus of memorandums or anything can find about USCIS procedures or bulk of interview experiences. The goal again is to judge if you have a "bonafided marriage" through honest respones and various evidence. 

  7. Dinged, does not mean denied right away. Just the IO asks for it and starts to get annoyed, many people without any bank accounts have got through the process fine. You have to evaluate your whole case all together and see what works for you. Just may not want to expain why you the account does not exist and just start to show joint insurance or so.

    Try to stay calm and just call later that week and ask your questions directly. Truly those poor people have a very job now since they are overwhelmed daily. But that said majority of them are not very good at their jobs.

    447 pages, I started to skim it. But the media coverage and headlines versus what I can see as reality seem different. We are adding forms? So the total cost of AOS will go up?

    So the i-864 will continue to exist then we add a whole new self-sufficency test? For sure this will slow down the AOS process longer.

     

    The test automatically passed if you hit 250% of poverty guidance. They are doing this all cause they could not force changes to the i-864. Just madness.

    You had to do all thar financial engineering because after 2008, banks not encouraged to offer secured credit card structures that often anymore. Anyways that structure while costing you a bit was probably more worthwhile, a loan vs a secured credit card would move a long your credit history faster. Bit confused how you cannot purchase a home with over 690 credit rating that said...

  11. Truly its all fake news. If you are overly concerned sell all shares as somome mentioned. I know lots of people who are actively involed in the capital creation industry for cannabis and spend tons of money multiple times a year in various USA cities. Their spouses even in work/study visas in the USA while they are helping grow the industry in Canada.

     

    That said the US CBP should never publicly say this, that would be rather silly and a slipperly slope. Nor would any cannabis venture capital person who carry a pound of kush on to the plane now.

    Many countries have totally different systems and in many countries credit is not as widespread as in the US. Not to mention that there's the potential for religious discrimination - many religions don't allow the use of credit. 

    Again, way I read it this only for people who have USA credit history. So lets say someone on a student visa who has really bad credit due to certain reasons and now is doing the AOS process, is that valuable information for an IO? A new immigrant who has never lived in the USA would assume to be ignored by this proposed rule.

     

    Anyways no way the rule passes. But again I think they already judge harshly on varuous things, asking why your credit is poor seems a minor one.

    I know Equifax uses a number of criteria (name, phone, address, etc.) that doesn't necessarily have to include an SSN, but the vast majority of the time they use an SSN (or ITIN) to associate a user to a credit profile.

    (Just thinking out loud...I don't expect an answer. I've done quite a bit of Identity Proofing with Equifax servers for various projects, private and public sector).

    Just more thinking out loud here...but certain banks will give more leeway to certain immigrants in hopes they are a valuable customer later on. Having proof that said person has a banking history and their spouse has history with the financial institution, may allow to give more more credit/access to begin. Which then ofcourse allows you to imrpove your credit drastically faster. 

     

    My firrm at the time had a corporate relationship with the bank, so just proof of my visa/income/firms name was enough to qualify for a decent credit card right away. So took only 6-8 months to build my credit. I assume a bank would consider same things when it comes to a persons name being on past banking history with them.

  14. It is easy to get a good credit rating. It is super hard to get a great credit rating. It is easy to get an average rating. It is super difficult to get a crappy rating.

    Truly not outrageous to ask why someone with a poor rating has a poor rating. They ask way worse stuff already.

     

    Also way I read it a new immigrant would no rating, it would be ignored. 

  15. Greencard option is a great suggestion. Based on current trends many middle eastern countries currently have zero hope to get any visitor visa for many years. As well the culture is not one where everyone takes a major holiday to party in a hotel. These family, elder especially want to experience how day-to-day life is with their family. The ability to see the bedrooms, the schools the community their grand kids are being raised in, the ability to see the playground they go to. The ability to have a big family lunch at home is what they seek.

    That is strange if the IO thought your marriage is bonafided, approving the i130 should truly be clicking 1 button. The i485 since is more crucial to check some records I could see a delay, in our case she had to verify all my border crossings. Truly sounds like the person disappaered off to vacation and forgot or so. Yah for sure reach out to your Senator, its easier to reach out now since the IO may remember you and truly you have a good memory of what exactly was told in the interview.

     

    The 120 day rule has to do with employment green cards while marriage could be years actually, so seems your field office making up their own rules to not get bombarded with people that is rather unfornate situation. Also something also to let your senator know.
