    The RFIE was regarding Affidavit of Support and i had to do a lot of paperwork to get the right documents and also i was waiting for a co-sponsor to provide me with their documents so it took a lot of time

    Firstly, I would like to thank you and everyone who helped me and secondly, I missed coming here...I mean I was in such a bad mood that I didn't want to come here and give wrong advice to people.
     
    My response to RFIE via USPS reached NBC last Friday which is January 26th and yesterday my status for I-485 changed to "Request to USCIS Request For Initial Evidence Was Received" and this afternoon status for I-765 changed to "New Card Is Been Produced" 
     
    Since the processing time went wayyyyy beyond the normal times so I guess as soon as they received my documents they approved my EAD. I am sure they will do the same with your case

    You also made the very good point about people updating their timelines. A lot of users here don't. I haven't even filled mine out. So once again, VJ's accuracy is questionable.

    I did not say VJ users are not applicants. I said they are not 100% of USCIS' applicants. VJ is a popular site but I don't think we even make up 50% of USCIS' total applications.

    VJ users do not make up 100% of USCIS applicants. I've read the ombudsman 90-page reports as well as the charts listing all applications from all field offices and their breakdowns of approvals, denials, and still-pending. VJ is not the end-all and be-all of USCIS statistics either and that is what I have been saying in my other posts about this particular point about EADs.

    After searching ~ 3000 cases around my number case, I realize that most cases (i131, i765) which were filed on Aug have had “Case was received” status.

    @mushroomspore and I have both been waiting for a long time with no response, and considering you got your EAD/AP in 77 days, I think it could be really nice if you recognized that fact and perhaps were less aggressive about forcing your viewpoint.

    Umm no. Lawyers have told me they used to tell clients 3-4 months for EADs. They are now telling their clients 5-7 months. USCIS reps have also told callers 5-8 months.

    I don't know where you're getting your info but the 60-90 day standard is inaccurate and USCIS has purposely said they are not accountable to it anymore because they know it's been taking them longer to adjudicate EAD/AP. Also, I have been following several forums and MANY people have gotten their EAD/AP after 120+ days without an RFE. People whose EADs are taking a long time doesn't mean they're problematic cases and saying so is inaccurate and presents the wrong picture of what's going on. It has to do MOSTLY with USCIS' work pace that has slowed incredibly over the past year. @Hamilton getting an RFE this late is an outlier, not the average.

    Hi friend i received this update yesterday afternoon from my local congresswoman office.  Cynthia ****** ********** ******* Form: I-485   Thank you for your follow up inquiry regarding this constituent’s immigration matter.  This case is awaiting interview scheduling by the Phoenix Field Office.  Once the field office schedules this case for an interview, the applicant will receive a notice stating the date and time to appear for their interview and the NBC will forward the file to the field office.

    Shortly is good! When I got that exact note I got the EAD a couple of weeks later.

    If not for yourself, then I really hope you heed everyone's advice and pursue legal immigration for the sake of your son. It would be a shame to end up with a long-term or permanent ban and end up unable to visit or immigrate to the U.S. for the duration of your son's childhood.
     
    Like others, I question your lawyer's advice regarding CR-1 vs. IR-1 visas. ROC sounds like a headache, but surely not more of a headache than raising a child while living in a separate country from your spouse. I assume this is a bona fide relationship and you intend to be together long-term; as such, having a CR-1 visa for a few years shouldn't be that big of a deal.

    I am confused by the lawyer's advice and your August intentions.  If you are using a lawyer and the plan was to move to the US permanently in August 2018, the lawyer should have known that the file would need to be submitted 12-14 months ahead of that (i.e. should have filed in May/June 2017).  As to the lawyer's advice to wait and file so you get a 10 year GC and avoid the ROC, sure people do this, and it does save some money and the headache of putting the ROC package together, but is it worth being apart for an extra year or so?

    My spouse, young son and I tried to enter the US with a U-Haul and I was denied entry. I was told to complete the immigration process in Canada. 
     
    Are you aware you cannot spend more than 6 months out of 12 in the US? Your biggest hurdle could be the amount of time you've accumulated. You need to spend as much time outside the US as you have spent inside. Which is why customs probably told you to stay away for the next 6 months.
     
    Your US citizen spouse will have to sponsor you while you wait in Canada. As others mentioned your child can visit the US. The border has always told me my son is welcome to the US anytime despite the fact we had to apply for IR2. Does your child have a US passport or birth abroad certificate?
     
    So far the process has taken me a year to complete. I set up shop in Canada and waited about five months after our fiasco to cross the border. I signed up for a couple courses, put my son into daycare, signed a lease, etc. The first time I went to visit my spouse customs was very intense. They allowed me to visit but I only stayed for about 12 days the first visit. Showing you are completing the process legally is crucial if you want to be allowed entry into the US.
     
    I would not delay filing for the i130 to start the process.

    Agreed. Sorry to be blunt, but you were abusing your privilege to access the US by living in the US. Canadians are allowed to visit the US without a visa, not live there. CBP’s decision was justified, even though I do understand the hardship you are now going through. They need to follow the laws.
     
    Moving forward, you need to wait out the immigration process. He can try for a waiver to visit you, or you can spend time in a third country. Those aren’t great options, but it’s something.
