  2. Hi! So my husband's interview is scheduled next month. The officer at the airport took his medical documents upon entering the US (he comPleted his medical in Manila on Oct 2018). I was wondering if he needs to complete a new medical for next month's interview? I do not know if they forwarded his medical document at the airport where they took it to the office where the interview will take place.

    Well technically you got married during the 90 days so you did your part of the contract and respected the conditions of the Visa. Never read anything from the USCIS saying that the AOS must be filled during the 90 days, it is just that you don't really have a status between your Visa expiration and the moment the USCIS get your AOS Application. I am not a specialist but never heard about anybody being in trouble filling a few times after their K-1 visa expired. 

    Ive been googling about it too and its stressing me out. Thanks for makig me feel better. We will send the applications for AOS, EAD and AP this tuesday or wednesday.

    You'll need more documentation for you interview, but the USCIS web site says the Boston field office averages 7.5 to 11.5 months for AOS, so you'll have time to put it together.

    Thank you! Its just coz his i 94 expired on dec 3 and most probably we will be sending the AOS this week. Im nervous that they will have some issues since we are filing with an expired i94 😭😭

    Everyday that you do not file AOS beyond the 90 days, you no longer have lawful status and you are accumulating days of overstay. While most days of overstay are forgiven after you apply for AOS because you have married as you were supposed to, during that time of unlawful status, you can be brought into immigration proceedings. While most judges will only force you to file for AOS at that time to avoid deportation, with the current government, you never know what new policies may develop.

     

    So if his i 94 expired, is it still helpful to file EAD with AOS?

    • I'm only submitting a copy of my husband's income tax returns for the current tax year (2016), since I understand copies the past years' tax returns is not necessary.

    Hi! My husband is from the Philippines too. We are currently filling up forms for AOS. I was wondering since he doesn't have a copy of D 3025. When did they give you the D 3025?

    Last December my foreign fiance applied for a tourist visa and was refused when he went to the embassy for his interview date. No interview, he was just given a piece of paper saying that he hadn't provided sufficient evidence of ties to his country. Ok, it was worth a shot to spend Christmas together. In January we submitted our application for a fiance visa.

    So does this count as a refusal of a visa? I would think it does, it's just that this question sounds so serious; it lumps being refused a visa along with being refused entry once you got to country, which sounds like when you've done something wrong. There weren't any problems with our application, no fraud or anything like that (!), we just couldn't provide enough evidence. Is there anyone else here who was refused a tourist visa and then applied for a fiance visa? How did you answer this question?

    So I just want to be sure that we're answering this question correctly. Has he ever been refused a U. S. Visa, yes or no?

    Hi! I am having the same problem. So my fiance got denied for a tourist visa under section 214b. We are trying to fill out DS 160 for the interview. So of course we would select "yes". However it asks us to explain. I honestly dont know what to write. Is it okay if we just say he got denied u der section214b?

  8. My fiance got denied of a US tourist visa under 214b in 2016. So we are filling out DS 160 and there's a question that goes "Have you ever been refused a US Visa?" So of course we will choose "yes". However, there has to be an explanation. I am wondering if we would just simply say that he got denied under 214b. Would that be okay? Below is the letter given to him when he got denied.

  9. @Hank_ @javadown2 @LunarGazer Hi! So I called NVC and got our MNL#. I am just so confused where to start. I tried reading the links but still my brain is not in its normal state maybe. I told my fiance to print the payment form and go pay the visa fee on monday. So after paying the fee, can we schedule an interview date (i plan on attending the interview on the 2nd week of august) even if the status of our case is still "at NVC"?

  10. @Hank_ Hi! I got our case# this morning by callig NVC. I know that in the philippines we can start paying and scheduling for the interview without the hard copy. I just dont know the steps and what to do first. Also, is it safe for us to schedule the interview 1st week of august?will we receive the hard copy before the interview?also, im planning to fly back home for the interview since last month, fortunately i requested 1st week of august as my vacay that is why we are eyeing on that week for the interview.

  12. Hi! So we received pur NOA2 in the mail on June 18, 2018. I know i still have to give atleast 2 weeks before calling NVC. I just want to ask you how it took for you to get your MNL#? TIA 😊

     

    Also for @Hank_ , do they get the i 134 form before they start the interview or will they just ask for it if they need to see it? TIA😊
