  1. Hello all, 

     

    First off a little information. I moved here last year with a K1 visa in August, my wife and I were married in September and our NOA1 for my AOS paperwork was received December 3rd, 2018. 

     

    We received an RFE today stating that my wife is under the 125% federal poverty guideline for our household size as per the documentation we sent with our original packet. The letter we received talks a lot about a "Joint Sponsor" however, since filing taxes for the latest year (2018) her income due to promotions and assets now exceeds the 125% poverty guideline. We are absolutely able to find a Joint Sponsor if needed, however we are both 150% confident we do not need a sponsor at all due to wage changes. 

    The part where we need advice; the letter does not clearly state whether or not we are able to reply with the current financial situation and squeak through with that, rather it asks for a latest year tax slip + information pertaining to a Joint Sponsor. 🤷‍♂️

    I plan on calling and hearing what they have to say about this and will update, but was curious if any one else has been in a similar situation and which way is the correct way to go about it. 

     

    If I left out any vital information in this post please let me know in a reply and I will correct it.

    my pd is December 5th and nothing changed since bio, meh...

    Thanks! Us as well. I am unsure what it could be,  hoping it's as easy as an error on the affidavit of support that we can quickly fix. 

     

    Also I looked back and noticed my NOA for i485 was actually December 3rd (I'm on mobile and it's not letting me edit my original post), so hopefully you hear from them soon! 🙂

  3. Let it be known I am also one of the Dec filers whose case status still says "We received your fingerprint fee". I went for prints at the start of January. (We were originally scheduled for prints on Dec 24th and made the 3hr drive to Yakima, WA to find it closed.. Merry Christmas right?)

     

    The wait for EAD is excruciatingly tiring. 

     

    On the other hand, our yard looks pretty nice and kept. 😁

  4. I have browsed through google and found a few conflicting answers about the filing fee (and a massive headache) for EAD while filing the AOS paperwork. 

     

    I am filing from K1 status. 

     

    Do I need to have the $495 fee for the EAD while also concurrently paying the $1225 fee for AOS? Or is it included in the AOS fee?

     

    We are mailing in the AOS tomorrow so I am looking for a quick answer if possible. 

     

    If the answer was already here on forums, I apologize for an extra thread. I did look and was unable to find anything. Thank you for your time!

    Through the case status on the USCIS site. Should arrive in her mailbox by end of week if it is as fast as NOA1. 

     

    She just came home for lunch and I decided to check it. Such a huge smile on her face! We both had teary eyes. Skype is a wonderful thing!!! lol

     

    Timeline was the first thing I updated. :)
