Hello, the wife's mother can file for her and both application can be concurrent, because you can have two application with the USCIS. As soon as one is ready to be adjudicated, you'll withdrawal one. I had to withdrawal my green card renewal application because my naturalization was adjudicated before the green card extension was. This happened because I joined the military, while I was at my citizenship interview, I had to write a withdrawal letter same day, so I can become a citizen. I hope this will help you. Cheers

Yes the mother in law can file . .as others indicated.
Doesn’t seem like much of an advantage when you look at the visa bulletin between the two categories. ..especially assuming the F-4 petition is at least 2 years old already.

Volserv reacted to Timona in Enquiry:Advice on AoS for Inclusion of Derivative in F41
You have to mention that you're married in your application.
They can follow to join or you can file for them once you're in US. Follow to join seems like the best option

You only pay one AoS fee but additional IV fee for husband, in case that was not clear.

1. Pay the fee and update the Petitioner/Sponsor I-864 to show you and family member/ husband ( both of you get included in the same updated I-864 form)
2. I think you are asking about the Sponsor qualifying income …see link
https://www.uscis.gov/i-864p
3. Don’t miss out on the opportunity to ADD your husband NOW and risk being separated for years ..just get some help in getting it done and uploaded. If your Petitioner /Sponsor doesn’t make enough income to qualify for the two of you, get a Joint Sponsor.
****They will NOT treat your case better if you leave your husband behind. So ask your Petitioner to do everything possible to add your husband now***

Volserv reacted to SusieQQQ in Help! F4 Applicant and I Wish to Marry My Fiancee Now
If you immigrate without your fiancé it will probably take at least two years before she can join you. You will have to petition her yourself once you have a green card (and once you are married). No such thing as “short time” for this situation.
You and your siblings will need to figure out from the i864 income guidelines whether there is sufficient income for sponsorship. You haven’t given enough information for anyone here to figure it out.

If you’re the principal beneficiary then all you need to do is marry her and add her to your case as a derivative, and she can get a visa the same time as you. They will probably want to see proof that it is a bona fide marriage at the interview considering the timing involved.

Volserv reacted to Enie in Help: Submit Button Not Working (F4 Category)
Oh! That's strange then. Perhaps someone else can help with this issue. And the quicker you submit, the quicker they work on your petition.
