    Your original post made me chuckle...and was spot on!  Unrelated note, why are there "government shut down" clocks that include the weekend?  When the federal government is closed on the weekend, not much impact there, but it sounds much better than "well, the government shut down for a day and then they got on with agreeing to a budget..."

    What state are you in? A lot of states do not issue permits to conditional residents. Even though conditional residents are supposed to be treated the same way as permanent residents, there is some other naming in the database. They may refuse you on that basis, and there is nothing you can do about it until conditions are lifted.

    Received my biometrics letter today! From the filing to biometrics, it’s over a month? Takes a while. Will update the list later, but here are the dates:
     
    I-751 delivered: 12/18
    NOA 1 date: 12/18
    NOA 1 received: 12/26
    biometrics letter date: 1/6
    biometrics letter received: 12/13
    Biometrics appt: 1/25

    You can change to a divorce waiver at anytime once divorce proceedings have commenced.
    However, once you have requested the waiver, the I-751 cannot be approved without having a final decree. You will be given an opportunity to present this - usually by RFE, or if it goes that far, to an immigration judge as any denial and subsequent removal proceedings would be stayed pending the final decree.
     
    Not just still married...the exact phrase USCIS use is 'living in marital union' 
     
    Firstly, there is no guarantee that you would get an interview.
    Secondly, if you were to be scheduled an interview for a joint filing, your spouse must attend. If they were to not attend, you would be denied, unless you requested a switch to a waiver at that time. As above, you can switch to a divorce waiver without being divorced, but it cannot be approved until the divorce is final.
    Would love to be a fly on the wall with you being honest to the interviewer sat next to your spouse who you were reliant on for the joint filing - not a great place to find out that your affair has been rumbled.....
     
    Thirdly, should your joint petition be approved without informing USCIS that there has been a major material change in your circumstances, you can subsequently be denied your N-400 at a later date, even under a five year filing. Paging @charmander who has the link to someone on here who experience exactly that, somewhere in his rolodex
     
    As I posted above, both joint and divorce filings are adjudicated on the evidence of bona-fide-ness provided.
     
    Either back to CSC, or will remain at the local field office that it has been sent to for adjudication with the N-400, for adjudication by itself.

    You are getting too stressed out over some things you really shouldn't.
     
    They are separate applications and are still treated separately. 
    Yes, it is true that the N-400 cannot be approved until the I-751 is approved and it forces adjudication of it usually at the same time, but it still remains a distinct and separate petition. It won't somehow be cancelled or disregarded because you are no longer N-400 eligible at this time.
     
    Stop stressing out over stuff you cannot control in any way.

    I know there are two schools of thought. One is a self-sufficient applicant who can file it themselves successfully. While that's true, I want to believe that it's safer to work with an attorney. Those are very important documents, and your life depends on how well you prepare the package. The attorney may not be super useful in the initial filing of I-751. However, an attorney familiar with the case from the start may be very helpful in case you need them later. 
     
    In the end, nobody can tell you what to do. If you feel comfortable having an experienced set of eyes look through your documents, then attorney is a way to go. If you want to file yourself, you should be able to do that, too, without any issues.

    You can find immigration attorneys through the American Immigration Lawyers Association. I'd also check on your state bar association website whether the attorney of your choice has a clean record.

    Hi everyone. I have made a few improvements to the list with timelines. It is now sorted by date of I-751 submission, so we can quickly see how we are tracking compared to other members.

    I have also added two additional columns, namely NOA 1 received (by us) and Interview date. This cleaned up version will allow us to more accurately see what's going on.

    Happy new year! I'd say that it varies case by case. It definitely doesn't hurt to send a few pictures to substantiate your paperwork. Pictures and social media posts may serve to show that you are transparent and open about the relationship, and that I wanted to forge a life together.

    LOL! I initially prepared a packet like this, too. I spoke with the attorney about the size of the package, and we decided to do a quarter of it. He drew my attention to the fact that IOs need to go through all the documents you submit. There are many schools, but it might be better to send a thinner version first, and let them decide what else they needed through RFE.
