    Your current income being unemployed is $0. If you file AOS after getting a new job, which pays more than the income indicated on I-864P, no co-sponsor necessary. Otherwise, you will need a joint sponsor.

    After the marriage or before, if filing K1, your spouse will need to establish residence in the US. Given your age, you probably don't have the minimum assets needed so she will need a job, etc. to prove her ability to provide as well as prove intent to be a USC and/or find a USC co-sponsor. If you marry and then immigrate, the process will take 12-14 months before you can enter. It's also quite expensive. Check out the guides on the website to learn more.
     
    She will also need to back file tax returns. If she didn't work or earn enough during certain years, she provide a notarized document to the effect or file a $0 income tax return. All USCs are required to file taxes in the US and report worldwide income - whether they're living in the US or not.

    I would suggest having your husband's family do the letter in one of the languages that could be notarized (or find a new notary). Then, provide a certified English translation. Do you have life insurance and/or health insurance? You could add him to that maybe.

    Usually the best policy is to bring it.  If they ask for it, you have it, if they do not, there is no harm no foul.

    As said, there is no cancelling of visitor visa if you file for them. Current wait time is roughly 12 - 15 years.
     
    They can continue visiting but they should be careful not to overstay or visit too often as it could lead to them either being denied entry or having their visitor visa revoked.

    Yes you can adjust your status to permanent residency and get your green card provided you’re the spouse of a U.S. citizen. Your status violation will be forgiven since you’re an immediate relative of a U.S. Citizen. You’ll need the following forms from USCIS and file all of them concurrently (I-130, I-485, I-765 and I-131). I-131 is advance parole which gives you the ability to travel while adjustment of status application is being adjudicated. Your I-765 (employment authorization document) will arrive within 60 to 90 allowing you to work as well while pending adjudication of status adjustment as well. You won’t be able to leave the U.S. until you get your advance parole document or green card. If you do your application will be considered abandoned and you’ll need a spousal immigrant visa overseas to reenter the U.S.

    The I864 is only his assets - not yours or your income. Only include his assets and income. Even with $12K annually, you'll be fine with a sponsor.

    Since you live abroad, you file to the Chicago lockbox, as noted in the link above. Your mailing address is merely that - a place where you receive mail.

    Hi everyone,
     
    Finally, after ~2 months on and off preparation and countless re-prints, we are going to mail out our application package today. Background story, I'm currently in valid F-1 status working full time with my STEM OPT extension EAD (will expire end of April 2018) and got married to a U.S. citizen (last week). Thank you to everyone who have answered my questions in the past.
     
    My application in a nutshell
     
    Filed for optional applications (I-765 & I-131) Photos are placed in ziploc bags and clipped to respective forms (Name and A-number (if any) written on the back with pencil). I organized my application package into folders Each form is paper clipped. Forms and evidences are binder clipped to the respective folder, so they won't fall out. My husband's family member agreed to joint sponsor, because my husband's income is insufficient. During the past five years, my husband had period of unemployment (full time student), so I went ahead and wrote "None-Student" on his I-130. In regard to the evidence of bona fide marriage, I definitely front-loaded our application package with plenty of secondary evidences. For example, list of all past shared trips and gifts exchanged.  I paper clip evidence from the same trip( i.e. hotel reservation, flight reservation, car rental reservation, photos) and made cover letter for it. Similarly, items included in my I-485 were not all required items per I-485 instructions, such as the entry stamps and copy of I-20s. Per page 11 #7 of the instruction document, I-94 Arrival - Departure record should be sufficient.  
    The whole package weighs 3 lbs 3 oz. and I will mail them with a priority mail envelope.
     
    Alternative scenarios:
    Instead of joint sponsor, I can use my income (intending immigrant) by showing proof that my income will continue from the same source after getting the green card.  I could have use my saving accounts by submitting bank statements covering the last 12 months.  Get the medical examination (I-693) done closer to the interview date to avoid the risk of a Request for Evidence (RFE) asking for a new I-693, if case is pending for more than one year from priority date. Certified copy of marriage certificate is not required, but I had an extra, so I am sending it with the I-130.  
    Please let me know if you see anything missing from my application package. Otherwise, hopefully these photos could help future applicants.

    1) yes, that was when you lived there. The other times, you just visited.
    2) I'd give the internship information but do specify 'intern' under 'occupation'
    3) it says 'if none, so state'. If he was a student worker, mention the student worker job. Otherwise, leave blank.
     
    Just curious, you mention USC fiance, but you are filing I-485. I assume you know you can't file AOS unless you're married and your spouse files the i-130/i-130a form simultaneously. He will also have to file i-864, affadavit of support, so if he's still a student you may need a co-sponsor.

    Yeah, that's how I did it =) in terms of maintaining your maiden name on your passport, just say you're still working on updating it. I'm actually on the process right now of getting a new passport with my married name but I don't think it would be an issue for you at the interview or collecting the paperwork for the AoS packet if your passport is in your maiden name.
     
    Regarding your last question, I filed the GC packet first but had updated my name for our bank account beforehand because it was a joint bank account. In terms of SS and DL unfortunately I can't update it without having my EAD so they're still in my maiden name. For the DL I was instructed by the DMV to drive with a copy of my marriage certificate in case I get pulled over or something. It's a bit of a hassle but just keep a simple copy in your wallet after you get married. Then when you get your EAD you can proceed to update the SS and then DL
