    You actually went further than your suggestion about lawyers in your posts when you said:
     
         "A record of a crime ,for which u have been issued clemency or pardoned, can not be used against you by uscis..."
    And,
         "I'm trying to be positive and I'm don't going to argue with u .but a pardon for the crime would solve his problem."
     
     I don't want to be argumentative, and do not discount your personal experience.  However, unless your pardon/clemency was for a drug trafficking offense, your experience is not relevant to the original poster's case.  There is one very important point that your posts don't acknowledge -- that is, whether tbere is a conviction for drug trafficking (selling drugs or aiding someone to do so) is irrelevant.  A conviction is not needed for the finding of ineligibility under 212 (a)(2)(C).  Suggesting in any way that hiring a lawyer to change the status of the conviction will make a difference likely provides false hope -- especially since this is for a Diversity Visa and the OP now has no apparent path to immigration.
     
    OP -- as I said earlier, there is no waiver of the ineligibility for an immigrant visa.  At some point in the future, if he is found eligible on all other grounds, there is a possibility (slim at least for now, IMO) of a waiver of the ineligibility for a non-immigrant (visitor) visa.   He will first have to also overcome the assumption that he is an intending immigrant -- which has now been strengthened by his family's DV applications.  I know this all sounds harsh -- which it is -- but it's the apparent reality of your situation.

    Legally , Sir, there is a very big difference.. trafficking is a much more severly  classed offence  compared to a simple sales charge.  And if you have been aquitted, fully pardoned or given clemency is his best and only shot if he were going to spend money on legal fees...a standard immigration lawyer isint going to help his situation . A full pardon and a sealed record would be a better use of his funds ...and , I stand by that original statement.. i don't claim to be a lawyer or offer legal advice.. my original comments are my oppinion as related to personal experience .thanks tho.

    Ok well , I'm not here to argue with you about my personal experience with immigration and a felony for which a full pardon from the King was issued .. but I will again remind you .. what I was saying originally was "IF THEY ARE LOOKING FOR AN IMMIGTRATION LAWYER "( WHICH THEY WERE)  THE MONEY "WOULD BE BETTER SPENT "  and have more of an impact if spent " IN HIS HOME COUNTRY" ON GETTING A PARDON OR EXPUNGEMENT. I said it's a better use of funds ..meaning it could benefit his life AS OPPOSED TO spending the money on an imigtation lawyer to get around a conviction as that spent money would not likely benefit him in the end at all.. I only said "ITS HIS BEST SHOT"  going the pardon, EXPUNGEMENT route rather than immigration lawyer route..Again thanks tho

    No I'm not an attorney . But have had personal experience with lottery visas.
     
    A charge for which u are found not guilty , aquitted , fully pardoned for or given clemency should not interfere with tourist or lottery visas and as such would be her best chance .

    Hi, it's a terrible feeling to be held back and forever punished for 1 past  mistake. Especially isolated events.
     
    Youthful transgressions often resurface years later falsely painting the individual as something he/she is not. 
     
    Lawyers , will take your money and try to get him in but most likely will just get your money..
     
    Keep your head up tho!. There is one suggestion I have for you..
     
    If u have money for a lawyer, please use it in your home country. Your one shot, as I see it, is to petition in his country for clemency, or a government pardon, or expungement of record...
     
    If he made a mistake as a youth and has gone on to become a productive rehabilitated member of society he may be able to remove or expungement the conviction on humanitarian or other grounds. 
     
    The key would be to have it done in the country that the offence originated in..
     A record of a crime ,for which u have been issued clemency or pardoned, can not be used against you by usics....
     
    I hope this gives you some comfort , as it probably, in my opinion, is your only chance for him...

    Yes, that was a regular book binder type of album...
    Well, I called USCIS right away and asked if I needed to resend just pictures.
    They said no, if anything extra was needed, they would send RFE.
    Thank you though.
    That was my bad, I did not know they put everything in file.
    I just feel super worried, you never know WHAT to expect and WHEN.

    Congrats...it shows they have touched your case. I got mine since March 2021, but has been dead silent since then. Hope we get our approval soon.

    If it makes you feel any better I haven't received anything after the receipt notice, not even biometrics, and I'm from EAC so... Nothing we can do right now other than wait patiently

    Oh wow..
     
    A few things..
     
    1. lawyer.
     
    2.  Her overstay is what got her deported.. not the red light.  If she gets a interview for a visa in the future and she blames her deportation on the red light, I'm sure the consular officer will laugh at her.
     
    3.  2+ years (about 2 years was overstay) in the US, you had more than enough time to marry and file for a greencard.  Possibly even enough time to have removed conditions 😅
     
    4.  As others said, getting married most likely won't save her from deportation.  I think the best thing to do would be to try for a k1 or spousal visa with the appropriate waivers once she returns to  Canada and keep your fingers crossed that the waiver is approved.  But expect it to be denied. 2 years is a long time to overstay.
     
    Possibly look into moving to Canada would be the easiest route.
     
    And definitely consult a lawyer as waivers will be needed for deportation + overstay.  You might have to take out a large loan to pay for it.
     
     
    Would've been cheaper and easier to just get married. 😅
     
    She should've been on a k1 or cr1 visa when she first came over 2+ years ago in my opinion.  Everyone going through this process has to be apart from their significant other for this process for long periods and coming over on a tourist visa to skip that line... Not cool. 😅
     
    Canada also is right next to us.  You can visit every other month if you can afford it. 😅  That's what I did for my wife in Mexico. 🇲🇽

    Lawyer up. I believe she's getting deported for being in the country illegally, and not because of the red light.

    Apparently if we want expidited service  and free USCIS paperwork then all we need to do is withdrawal our legal paperwork and show up at the boarder claiming asylum. Free lawyers, no paperwork fees, no health check or imunization requirements, no need to prove financial  stability and no agreement not to accept public assistance,and only a few days to wait untill they pay for a ticket to the us city of choice.  You want to know why the backlog is growing ? Look to the southern boarder and see where imigration resources are concentrated...then contact your senator and let him know how u feel about the line we've been waiting in and the otherwhelming mountian of paperwork and fees ! Hang in there our time will come ! Most of the wait is over for the majority of us here at this stage.  So please, don't get discouraged,

    Just want to share with you I submitted my paper in late October 2020 and I got my new card last week. I cannot believe it is only 5 months. I am in Texas by the way.

    My timeline here:
    07/22 mailed to TX via USPS
    07/31 Checking account pending
    (08/03 2 years green card expired, still working without questioning )
    08/06 Received NOA letter in mail
    08/26 Fingerprint waived
    10/22 Transferred to another USCIS office
    11/10 New card is been produced
     
    We don't have a lot of pictures, we don't have children, we haven't brought house yet. Just followed USCIS instruction, provided everything they need you to prove that the marriage is real. Hope those info will help any of you guys.

    Hurry up and wait is the game we play, seems every single moment is a blessing belayed.
     
    Never let it bring u down, never lose the thought,
    that the day will come we reap rewards of struggles that were fought. 
     
    When I feel down,  i try to remember to count my blessings not my burdens..
    Always, I find, more blessings than burdens.
    This has yet to lift my spirits when I needed it.
     
    Hope someone else may find it lifts theirs as well..
