Oh, I see how the same name can be confusing for both you and USCIS...

Send for both and write a cover letter explaining who is who and who's removing conditions etc.

I would send the documents for both, just in case. It won't do any harm.

Just curious: did you include everything in your original package?

No I didn’t, Just my little one birth certificate, I understood bad and assumed they didn’t need those documents again .

Is this for Adjustment of Status (I-130 & I-485) or Removal of Conditions (I-751) ?

I did not understand anything from your message. Are you saying RFIE is for a person with a different name?

It is RFIE for I751 and I am not sure if they are requesting for birth certificate and Id from my husband or little one because they both have the same name , so I would like to know if you all thing are there issue if I send that information from both my husband and child
    thank you

  5. Hello, good afternoon everyone, I received a RfIe requesting a copy of the marriage certificate, a copy of my child's birth certificate, I believe, and a copy of my husband's ID, however, how in the last two they mention Mr. Grooms' documents bothers me. I doubt if the documents are not my husband's, I am thinking of sending what concerns my husband and my child, but you think there is some problem that sends information that you are not requesting, I also just changed my status 4 days ago and I will send a copy of the lease contract for this change

Thank you in advance for your comments.

    deadline is in February 2024

  8. Good evening everyone, my status changed to Request for initial evidence RFIE) on 11/22/2023, today I received the letter and they requested
    Copy of marriage certificate
Copy of our baby's birth certificate
    Copy of my husband's ID

sent the birth certificate but not the other two documents.

I live in Texas and the office I was assigned to is Texas too, priority date 07/07/2021, at the beginning of December I am going to move to another state and in the letter they ask me to put when I send the documentation they ask me that in case If I have changed my address, put the new address there, I was thinking that when I send the package ( When I Move just in few days ) I will put my new address and attach a copy of the rental contract as proof.

Could you please let me know if this is good idea ? Do you think this affect the times in my case

    thank you

    Hi.

I was filling out the K-1 form last couple days, and was speaking to my girlfriend and needed all of her beneficery information.

But the conversation got cut short, when she declared that she "spoke to a friend" and found out her current valid B-2 visa would be canceled upon me filing a K-1.

Is this true? It does not even make logical sense to me if it is true.

She had a 10 year visa before that, all entries/exits in very good standing.

When we filled our visa K1 I had tourist visa and I continued used it while the process , the interview day the officer hold and canceled and my tourist visa , I am from Mexico , I am not sure if in another countries this happen also

My point is pretty clear.  Your life....your choice....your risk......take the risk or obey the law as written.

    https://www.nolo.com/legal-encyclopedia/do-i-really-need-carry-green-card-me.html

"If you are 18 or older, you do have to carry your green card with you. Section 264(e) of the Immigration and Nationality Act (I.N.A.) requires all lawful permanent residents (LPRs) to have “at all times” official evidence of LPR status.

Failing to have your green card with you is a misdemeanor and if you are found guilty you can be fined up to $100 and put in jail for up to 30 days. (I.N.A. Section 264(e).) A copy is not good enough, because the law does not use the word “copy” or refer to “other evidence” of LPR status."

Thank you everyone for your opinions , I think finally I follow the law and I will carry my GC all time  because I would not like to be a situation where I could have issues for that and more because the letter and the law mention that like mandatory

    thank you All again

    https://www.uscis.gov/policy-manual/volume-8-part-b-chapter-3

    "4. K or V Nonimmigrants Applying for Adjustment [26]

K and V nonimmigrants applying for adjustment of status are not required to repeat the medical examination if the application was filed within one year of the date of the original medical examination, and:

The medical examination did not reveal a Class A medical condition; or

The applicant received a conditional waiver in conjunction with the K or V nonimmigrant visa or the change of status to V and the applicant submits evidence of compliance with the waiver terms and conditions. [27]

If a new medical examination is required and reveals a Class A medical condition, a new waiver application will also be required. In such cases, the officer should determine whether the applicant complied with the terms and conditions of the first waiver, if applicable. Such determination should be given considerable weight in the adjudication of a subsequent waiver application. [28]

Even if a new medical examination is not required, applicants must still comply with the vaccination requirements if the vaccination record was not included as part of the original medical examination report. If the vaccination report was properly completed at the time of the overseas examination, the officer may accept the vaccination assessment completed by the panel physician.

An applicant’s overseas medical examination report completed by a panel physician should already be in the applicant’s A-file. If it is not in the A-file, the officer should request the medical examination report through a Request for Evidence (RFE).

If the applicant was granted a change of status to V in the United States, [29] the medical examination report completed by the civil surgeon should be in the A-file created at the time that the change of status was initially granted."

If you complied with the above and filed AOS within one year of your overseas medical exam date, the I693 and its procedures/policies do not apply to you as a K1 applicant. It does not matter when your AOS interview happens, as long as you filed AOS within one year of the medical exam date (and you meet the above conditions), your medical will never expire.
Submit a photocopy of your personal copy of the DS3025 Vaccination Record with I485 and bring your personal copy to the AOS interview as back up.
Your actual overseas medical exam documents were collected at your POE as they were IN your sealed K1 Visa packet and will be sent from CBP to DHS for storage in your A-file.
Your interviewing officer will collect your A-file for review at your AOS interview or shortly after and confirm that your previously submitted K1 medical exam and vaccinations meet the requirements.

So the two big questions are:

    1. Is your DS3025 marked complete? Check the bottom left corner for the checkbox that says "K1 Visa applicant voluntarily completed vaccination requirements"

    2. Will/ has USCIS received and issued you a receipt number within one year of your overseas medical date to have complied with the one year submission requirement?

If yes, you have completed the medical requirements to adjust status.

Thank you very much for your help
