  1. @Mohd Al Said I also recommend contacting your Senate rep. My representative was VERY helpful and was able to push things along. They have a direct back channel to communicate with the embassies and they generally respond to them very quickly and positively. 

     

    I just read all 14 pages of this forum.  My K1 status changed from Administrative Processing (about 2 months) to Application received today. it states:

     

    "Your case is open and ready for your interview, fingerprints, and required documents. If you have already had your interview, please check your status after two business days. If no interview was required, please check back in two business days for the status of your application."

     

    Our 'case opened' date also changed to today. I thought it would just go from AP to Ready then Issued.  is this normal?

    Dear all, to give you guys a quick update... our status changed from Administrative Processing to Application received today. it states:

    Has anyone else seen this? is this normal?  Our case opened date also changed to today. I thought it would just go from AP to Ready then Issued.

    i also got the ds5535 for after my interview they told me it will take 2 weeks to 3 months of course i was scared i was calling them every week and emailed they were just tell me to wait its on AP got 2 upadates after calling them, then exactly after 2 weeks i got a email from them saying my visa is ready but i was still on AP untill i got my visa then it turned to issued. you guys just relax i know its not easy bt ull get your visa

    Thank you all for the kind words and advice.  We also got a g221 document request right after the interview which we sent over to them quickly. they then immediately sent us the DS5535. My senators office was also very helpful; then made several inquiries on my behalf which probably kept things moving along. 

     

    I hope you all are right!! 

     

     

  4. Hello all - My fiancé has been in AP for about 2 months on a K1 visa. We just received an email from the embassy 2 days ago: 

     

    "We are pleased to inform you that visa is approved.

     

    To avoid any delays in final processing of your visa, you are required to promptly submit your passport along with two new photos (5×5 cm) through our courier service (UMAKS, 27 Amiryan Street, Yerevan), Monday through Friday, 09:00 to 18:00, excluding Armenian holidays..."

     

    I believe they received her passport this morning but the status still says Administrative Processing on ceac.  Has this happened to anyone else? 

     

     

     

  5. Dear all - it has been a few months since I last posted here but wanted to give everyone an update. My fiance attended her intervene in Yerevan on march 22nd. Sadly, but predictably, she was not given a visa due to the Trump Travel Ban. the Officer told her that she was otherwise qualified and that he would have given her a visa on the spot if not for the proclamation. They handed her a piece of paper stating that she is refused but will be considered for a waiver, eventually.

    Just wanted to share a quick update. We were invited to interview at the US Embassy in Yerevan a few days ago. the website took a few days to give us an appointment date but it finally gave us an opening on the 11th.  However, we will not be interviewing for now per my lawyers advice. She has not heard of a single applicant that has been given a visa, including spouses and children.  No iranian immigrant has received a visa (all categories) since the trump travel ban took effect on December 4th. Our lawyer advised us that the best thing to do is to try and extend our NOA2 expiration date as long as possible until the laws change. We are praying that the 4th circuit appeals court and the supreme court find this whole thing unconstitutional before our NOA2 expires. Otherwise, we will have to start all over..

    Yes, unfortunately I have been hearing constant bad news. I have heard that they are not even considering waiver requests altogether. my Fiance and are actually thinking we may move to dubai instead!

    Yes- I have heard of fathers, mothers, brothers, and even children being denied visas from Iran since the ban went into full effect. Our plan is to wait as long as we can until we get some good news, perhaps when the courts help sort his madness out.

     

    Did you ask the embassy to extend your USCIS NOA2 expiration date? I think I will need to do that too.

    I’m a member of many forums and from what I heard this past week, fiancés are getting denied on the spot, even though many possess waivers! It’s a really bad time to go through any interview with this ban in full effect and if I were you, I would possibly try to delay an interview as long as possible! Or at least until the Supreme Court makes their verdict. 

     

    Also, I highly recommend a good Facebook group called, IMMIGRANTS UNITED. This group has over 14,000 members, and most are also impacted by the ban and have valuable advice to share. Here is the link:

    What waiver would they possess? The waive of these travel restrictions is determined by the CO during/after application (i.e. the interview), not via a form or letter presented, AFAIK.

     

     

    From what I understand, I believe @geowrian is correct.. the CO is tasked with determining whether or not an applicant is eligible for a waiver on the the spot and we must provide them with whatever we can for them to make that determination.

  10. So my K1 visa was just process at the NVC and sent to Yerevan for an interview. I also received an email from the embassy with the instruction on how to schedule my appointment. Unfortunately, the website where I am supposed to pay for the interview fee and schedule states that there are no upcoming appointments available at this time. I called the embassy and they told me to keep checking back until the consulate section opens something up. 

     

    considering that the travel ban is in full effect, we have to qualify for a waiver in order to get our visa. My lawyer said that they will determine if a waiver can be granted on the spot. 

     

    Is there anyone else here at this stage in the game?

    Online status did not update still shows received, oddly enough it did not show up in my informed delivery email notifications also. 

     

    @Trinab80 Check your mailbox if you haven't yet. 

    @Naes You were right it would just show up one day without updates.

    Does that mean you have already submitted your DS-160?

     

    If it says ready I assume you are good to go but I would call the embassy and ask them.

  13. dear all - 

     

    I called NVC again today. They informed me that my case is in "administrative processing." They told me that there is no set timeline for AP and I was not aware that AP can happen at the NVC stage. 

     

    Ive become numb towards this process with all the ups and downs. on the bright side, I hope this means I do not get AP after the interview when we get there. 

     

    Regarding the travel ban stuff, I spoke with my congressional rep again. She told me that they are still waiting on instructions from the State dept., and that no one really has any idea how the ban is going to be implemented yet. she said she does have some contacts at the state dept., but that contacting them will be useless because they are hugely under staffed. I have also hired an attorney to help navigate through the travel ban stuff. It seems like providing a written statement on why we should qualify for a waiver at the interview stage is what we have to do.

    They told me that they have not yet received any guidelines from the state dept. in that regard. They said that its business as usual for now. 

     

    I found this a bit odd bc the state dept made public announcement last week the it was going into full effect on december 8th. but I found some stuff online saying that the waiver determination will be made at the time of an interview.

    Ours was circumstance of meeting and evidence of meeting and approval came through 20 days after response received even though on the approval notice it's actually about 15 days. 

    They asked for evidence we'd already sent and we sent back the exact same stuff only with updated letter and we got approved.

    Congrats, finally! I thought K-1 would not be affected by the travel ban though. :huh:

     

    You would think so! it was not effected under the bona fide relationship standard, but the the Supreme Court did away with that as well.  With the exception of Student visas, all visas are suspended from Iran indefinitely, unless we can get a waiver. There still is a lot of uncertainty for my Fiancé and I but if there is 1% chance/hope that we can convince an officer to give us a waiver, we have to go for it.
