    Hi Seihu. The notice stated "In order to speed up processing". It also stated "That office will notify you in writing when they make a decision on your case or if they need additional information." We continue to wait.

    Hello and thank you! It's good to know that there are others that have been approved without interview at NBC. I hope we're among!

  4. Hello everyone. My husband's I-751 was transferred from Texas Service Center to NBC. We applied August 2020. Early October USCIS notified us that old biometrics would be used. It was transferred November 10. We had an interview for AOS. We haven't received an RFE for ROC. The notice said it was transferred to NBC for faster processing. Case status online says we will assign the case to an officer. We will review your case and mail you our decision. 

     

    I've been told that all cases that go to NBC will have an interview. I've also been told NBC is now processing and making decisions on cases. From our case status is it safe to assume that we may not have an interview? Or is interview still possible? I figured if they want to interview us our case status would say we will be scheduled for interview. Any thoughts? Or anyone with a similar timeline/situation? Thanks

    Exceptions do exist for things like a military (or military or government contractor) spouse who are apart for work purposes without a simple reconciliation process, in which living apart is likely not a big factor.

     

    It's really a judgement call. Generally, i would not say to act based upon immigration...do what you need to do (within the law, obviously) first. If that means living apart temporarily to better yourself or your family, so be it. But yes, expect more scrutiny of the marriage as a consequence. Scrutiny does not mean denial by any means...living apart is just one factor in the totality of the circumstances. But make sure to have and present a solid case in all the other aspects - spend as much time physical together as possible, commingle your finances (including things like beneficiaries on plans and insurances, wills/trusts, medical purposes, etc.), etc.

     

    The overwhelming majority of ROC cases are approved. And even if not approved, you can refile up until a final order of removal by an immigration judge. So you would likely get at least a second attempt with USCIS, and at least another chance with a judge. It really takes a lot to have LPR status actually revoked due to ROC...it can take a very long time and be a hassle in the worst cases, but a true marriage should ultimately come out successful in the end (and very, very often on the first filing...not to scare you with the talk of getting even a first denial).

     

    Do your research. Make a call that works best for your family and circumstances.

     

    Is he on the deed? If so, just send that. USCIS doesn't need to see the mortgage necessarily...the deed is good evidence of commingling as well IMO.

    Now if he's not on either the mortgage or deed, it is what it is. focus on what evidence you do have together, not what you don't.

    Geowrian, we are going through the process to get him on the deed. We also have life insurance policies and medical power of attorney documents for each other. I feel we have done the best that we can. Our family would be in a bad financial situation without my income. Not to mention my mother's health could get worse being away from her doctors that know her well. We will see what happens

    I think the ill mother is a strong enough reason not to move. Plus, it's a temporary program, not permanent, correct? (Trying to also educate myself here)
     

    Hi emekaus!! Good to see you too :) Yes, it is a temporary 3 year program. It just didn't make sense for me to move, leave a high paying job, and relocate my ill mother to a rural area away from her specialists while also putting us in a financially insecure position as I make more than double what my husband makes. Hopefully they don't count it against us. We will be visiting each other when we can. It's frustrating and anxiety provoking having the thought that you have to live your life the way someone else things you should. I have a friend who's husband is doing residency too and they decided to live apart. Only difference is they are both American citizens 😒. I can't wait to be done with this. 

  7. I've read some older threads of couples filing while living apart from spouse but nothing recent. Especially during the pandemic. We are filing to remove conditions from my husband's greencard. He is a physican but needs to complete a U.S. medical residency to practice in America. He left last month to start residency. We've been married and living together since his arrival in 2018 prior to him leaving. I am unable to move with him for multiple reasons. Work, school (which work helps pay for), and I am caring for my mother who is ill. His residency is 3 years and he will return once he's done. We got an attorney who recommended making a statement explaining our situation which we've done. 

     

    We did not mention that I am in school and work is paying for it. Would it be helpful to add that I'm in school? Also we closed on a house last month but my husband was unable to sign closing papers because he had already left for residency. The closing company stated that he had to sign the documents in person to be on the loan so we couldn't have him on there. He is listed on home owners insurance and utilities for the new home. We have proof of bonafide marriage prior to his temporary relocation (lease agreement, utilities, bank statements, taxes, credit cards, etc). Are there any other couples filing i751 at this time who are living apart? Thank you.

    Yes, you are approved! Congrats!! You should get a welcome to the U.S. letter in the next couple of days. They will also update your online account with a tracking number for the green card once it's mailed out in the next 1-2 weeks. Take a deep breath and relax.

    At the interview, the CO didn't ask us for anything but our tax return. Of course, I gave her everything I could. She requested we complete a new medical even though our documents were still valid. He was given a letter permitting him to return the verification the same day. 

    We returned the medical the following week but hadn't heard anything. A few weeks later my husband had an info pass appointment. He was told they are still processing but the CO did receive the new medical. 

    I contacted my congressmen in August. He reached out and was given the same answer, to give it time.

    On yesterday we received a letter from our congressmen stating our case is pending review. However, he also included an email from the Nashville USCIS representative. The subject line states: "Fraud_Case under Review-Possible Fraud."

     

    The email includes her name and telephone number. Should I contact her? Should we hire an attorney?

     

    I have included a screenshot of the letter from the representative.

    I agree with the previous advice given. You should contact the Nashville USCIS rep first, but still look for an experienced immigration attorney in case he does not get an approval. My husband was approved after his AOS interview a week ago and has received his GC. My husband is Nigerian, so I do not think being from Nigeria is the problem. We provided all the same docs you did, except for joint returns since it is too early for him to have a return. From what you have discussed about your case, things should have moved easily. Prior to this, have you had any issues in this process? It seems very odd that this far into the process that the marriage could be considered fraudulent marriage. Cases are reviewed heavily for fraud at the embassy prior to and at the K1 interview.

     

    Hopefully you'll get more information after you call the rep. I would ask her directly if your case was under suspicion for fraud, and mention what you saw in the subject line. Good luck.

    I wasn't able to attend my fiances interview. I don't know if they would allow you to attend the interview, but you can enter the embassy since you are a USC. Try asking in the Nigerian portal section.

    I personally think you're gonna hear something by end of month or first week of October at worst! That part of the country is breezing by. It's coming dude! 😄

     Naija_glam- part of the new administration changes and why getting a GC is a hot mess is that apparently no one is waived for an interview for GC anymore. It's basically mandatory now. It's why offices like Houston and Philly are swamped!
    We had a few people go to Infopasses and the IO told them that so many cases that they thought could be waived for interviews cannot anymore and now they gotta find a way to catch up with the work load

    Oh snap, I didn't know they weren't waiving anyone anymore! Now I get why offices with higher populations are running so slow.

    Anyway i was happy to see your post this morning  because it means probably in MO we don't need to wait like 8-9 months or more to get an interview...

    You're right that an RFE can delay things, but you responded quickly. There always the possibility that you may be waived for an interview as well.

    Good to see at least somebody from the same state, even with different local offices. I think I saw one other couple from Missouri or Illinois but with an office in MO

    Thanks ineedadisplayname! I was told KC's office moves fairly quickly. STL's population is a little less than KC's so hopefully you'll be hearing back soon.

    I agree that people are busy living life. It has been a big process getting my husband settled, and between that in work, I find it hard to even log on to the site!
