Not sure why you think it's not her fault. Sudan is not the only country in the world. Plenty of other options (countries) to leave the USA on time.

U.S. is her first country she has visited and her first time traveling. Why would she go to another country alone? Where she going to stay? Who is going to support her in another country? She only has a Sudanese passport no country will let her stay that long. This war will go on for a long time.

Also yes it's not her fault. This war happened overnight sir. Even the U.S. and other countries were caught of guard. They never expected such thing.

And that's not the advice I asked for. Everyone advice was helpful except yours. You pretty much want her out the USA.

His his mother-in-law does not qualify for TPS  under the Sudan designation per the information in the site quoted in the post   (https://www.uscis.gov/humanitarian/temporary-protected-status/temporary-protected-status-designated-country-sudan).   One of the requirements is continuous presence in the US since April 19, 2022. The OP stated that his MIL arrived on December 25, 2022, clearly after that April date.  Applying for TPS under this designation would merely result in a denial and make her an overstay, subject to all the repercussions of that.

    Thank you for catching that.

I have applied for extension of the visa, safest way to prevent over stay.

Who’s taking care of her kids during the war?

Her husband is taking care of the kids. But it has been difficult for him because now he is currently not working. The youngest kid is 6 years old.

The whole country is on a stand-still. The war is between the official military and paramilitary and they are fighting in the middle of the cities, airports damaged, prisoners being freed because there is no food/water to feed them, etc. They are fighting over power. Just greed!

You should pay the $370 to extend her stay and you should research possibilities of TPS…DONT DO NOTHING because you don’t want to spend the money.
You don’t want to cut off the possibility of your MIL coming to the US in the future (as a tourist)  or stopping your MIL and her children escaping Sudan and moving here  because she overstayed and now has a ban from returning to the US….
The ability to pay a fee and extend the stay is because USCIS knows things happen and they are giving you the opportunity to keep your MIL in status.

    Thank you

This makes sense now. I will apply to extend the visa.

I will look into TPS as well, but does TPS relates to what is happening in Sudan now?

She came to the U.S. Dec 25th 2022. The war started last month.

not her fault but don't want an overstay and if u do nothing ,  an overstay is what she will get

she could fly to Egypt or another country near that is accepting Sudanese or u apply for the humanitarian protection

    but don't JUST DO NOTHING

Thank you I will apply for the extension.

Is an overstay worth risking her ability to travel to the US on a B visa again?

It is not worth it, but this is not her fault that she is over staying. In the future if she wants to return she can bring up the fact that her overstay was the cause of the war and airports were closed. Right?

My spouse is a legal permanent resident she came here in June 2019.

But my mother in law has no plan to stay there. She has kids to go back to.

Is TPS a good option? Or even related to the case in sudan. This war just happened last month.

  8. Hello everyone,

My mother in law is on a visitor visa (B1/B2) and currently in the U.S. The total stay is 6 months and June will be her last month.

She cannot return to her home country "Sudan" due to a war that broke out last month and all of the country's airport is closed. She is stuck in the U.S.

    Two things I can do.

Option 1) We can extend her visa, but I don't want to pay $370 to extend it, because she never planned to be here longer than 6 months because she has young kids back home to go back to, but she doesn't have an option but to stay.

Option 2) We can do nothing and just wait until the war is over or when the airports open up and she can leave then. But no say on how long that will take.

Help please. Any ideas or suggestions?

It is pretty normal to have the status stay "Case Was Updated To Show Fingerprints Were Taken" for a long time (over a year or more). Some people get the update "Ready to be Scheduled for an Interview" next, but some don't. Even if it does change to the "Ready" status, it does not mean you will get an interview or approval soon.

As for interview - it depends. These days it looks like most people who went through an AOS interview get their ROC interview waived. However, there are always exceptions and some people who did not do an AOS interview still get their ROC interview waived.

On the flip side, if you end up filing N-400 while your I-751 is still processing, you may never get an update on the I-751 but receive a "combo interview" to approve both the N-400 and I-751 (even though the I-751 becomes moot at that point).

The TL;DR - Yes it's normal and USCIS is inconsistent with updating the online status. You may or may not get an interview - just have to wait and see.

    Great information, thank you.

One more question, what are an AOS interview and ROC interview?

  10. My wife applied for her i-751 in May 2021 and went to her fingerprint appointment in October 2021. The status on USCIS says "Case Was Updated To Show Fingerprints Were Taken". It has been like this since October 2021.

    Few questions

Is it normal to be stuck on "Fingerprints were taken"? I know the process takes a long time, but it is stuck on "fingerprint were taken". Shouldn't the status change?

What is the next step? Is it immediately the interview? Or is interview waived due to covid?

  11. My wife Green Card has expired, but we applied to remove condition. She had her fingerprint appointment already but I heard the process could take a year for her to receive her new green card.

We received a letter I-797, Petition to remove conditions on residence. The letter states that she can use this letter and expired green card as evidence of your status and work authorization.

But my wife is going out of the country to go visit her family. Can she travel with the letter and expired green card? Will she have issues at airports outside of America? Please assist. Are all the airports outside of america know about this or will some not understand? I don't want her run into issues or be stuck in another country.

  12. When can we file for I-751 Petition to Remove Conditions on Residence?

My wife has a greencard through marriage to me (U.S. Citizen).  It was issued in 2019 and expires June 2021. Can we file for i-751 to remove the conditions now? Or do we have to wait 90 days close to the expiration date? It expires in 8 months.

Also after the condition is removed how long is her greencard expiration will be next? 10 years?

And final question when can my wife apply for citizenship based on the dates I provided above starting from the original issue date in 2019.

  13. Please note, I am a naturalized U.S. citizen. I became a citizen under my parents when they got their citizenship.

I have a U.S. passport and had it for a while now, but I never had a certificate of naturalization and not sure how to get one. The reason i am just now needing the certificate is because my passport is getting ready to expire and in order to get it replaced i need to provide evidence of citizenship.

How do I apply for the certificate ONLY and how much will it be. I am already a U.S. Citizen. I looked everywhere on the USCIS website, but its hella confusing. Pretty much I have had my passport for almost 10 years and it expires soon.

  14. Hi all,

Does the beneficiary need to print the whole ds 260 package and take to the interview or can they just print out the barcode page (1 page).

This is what I found on the state department website "You should not bring your application with you to your interview. The interviewing officer will have full access to review your application online."

    source: https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/forms/online-immigrant-visa-forms/ds-260-faqs.html

Let's go back to my question because I have heard people take the whole package to the interview. Does the beneficiary need to print the whole ds 260 package and take to the interview or can they just print out the barcode page (1 page).

  15. I just sent my expedite request to the NVC..their email is: NVCExpedite@state.gov

Hopefully i can hear back from them soon..

I heard if they approve it they will send your case straight to the embassy..they will send you instructions by email..

Explain everything and note what date your case arrived to the NVC and explain the delay is on the NVC side. The better you note everything the better they will approve it.

I noted for them the days each step was delayed.

also include: your name, beneficiary name, date of birth, case numbers, invoice number, uscis receipt number.

example of what i sent to them

NVC received my case from uscis on XXXX (put the date)

NVC put my case in admin processing on XXX (put the date) only put this if your case was in administrative processing when it arrived to the NVC

Total time wasted: XXX (put the exact number of days/months that was wasted)

NVC case number created and sent my case number on XXX (put the date)

NVC CEAC log in issue occurred after my case number was sent

Total time wasted due to the ceac log in issue: XXX (put the numbers of days)

Total time wasted since case has been received at the NVC and until now (put the total number of days/exact months as well)

what did they say over the phone about that? I was also waiting for my log in to work until yesterday. will they speed up if asked or do you have to ask for a formal expedite?

    KJ2,

what I meant by calling them to speed up the process is...

after each time you submit a task like submit a fee or submit the ds form, i would call them and tell them can you process it on your end because I have already been delayed by the log in issue. I have not personally called them today, but i will tomorrow. I read on other topics on visajourney that the more you call them tells them you had enough of waiting and someone may process it for you on the spot..there was a user on here who said his payments were stuck on processed for weeks and he called them and they went ahead and accepted it while on the phone for him..all because a simple phone call.

they already delayed us, so they we have every right to speed things up by calling them on the phone. sometimes you will get a representative who will do what you requested..it is all about the person you end up talking to. some are helpful and some are not. keep calling and get someone else if it doesn't help.

  17. Glad everyone can log in,

here are some tips for people who can't log in: Call them everyday don't stop calling them. Their job is to help you. So bug the ####### out of them..

here are some tips for people who can log in (like me): Call them a day after you submit your fees or forms tell them if they can go ahead and speed the processing because you already had to wait almost 3 weeks for them to fix the log in issue..i will be bugging them for sure to speed up the process after i submit any form!

Guys, for those who haven't been able to login yet. If you reported an issue it should be on your case, ask the customer rep whether your case was escalated to the Supervisor, I believe they might be fixing the affected records one by one. Because I literally was just able to login not an hour ago. I believe they're actively working on this.

I agree.. if you haven't reported the problem i would send them an email and also call them.. it is good if they put in notes on your case so that they can get it fixed and they don't leave anybody out..

    Did you use internet explorer?

    I used Chrome worked fine.

If you can't log in i am guessing they are going through case by case to assign them the invoice number so you can pay the payment.. so i am guessing you should maybe be logging in today or perhaps tomorrow. Keep trying.
