  1. For the driver's license, funny enough I literally had a piece of paper about car importation that happened to have my name and address on it. I didn't know I had to have evidence of residence at the DMV, so was lucky enough to have that with me. They accepted it, but honestly it looked like something I could have printed out with MS Word.

     

    I don't really care about sending the CC, even with the numbers intact, if that's what it takes, so I'll likely just go that route.

     

    It just seems odd to expect that there will be bills in my name when, while I'm filing the AOS and EAD, I don't have permission to work and gain an income in the US, plus getting most of these services in your name require a credit check which I guarantee I have no history for (so wouldn't be approved for) based on my shiny new SSN.

     

    Beyond that, they can always drive down to the house where I will happily greet them at the door. :P

  2. If you file I-765 along with the AOS forms, a lot of the evidence it asks for in duplicate such as passport or birth certificate with photo ID.... since those are already included with the initial form, I would assume that copies don't need to also be submitted?

     

    Yes - I know that photos are an exception and I have provided a total of 4 color photos for the AOS + EAD application.

     

    The special instructions say that the I-94 is not required under C(9), even though it's provided with the AOS.

     

    Any other evidence I should submit in duplicate apart from the photos?

  3. Yeah definitely no lease / bills jointly in our names. Even so, in today's world we pay 100% of our bills online.

    Either way the bills come out of our joint bank account, but again I'm wondering if that would be good evidence to support the address.

     

    I do have one paper credit card bill that comes to my address here, but do I really want to include the entire credit card statement? That seems like a bit of an invasion of privacy for me.

  4. The answer is yes.

     

    Even if your fiance makes $0, you can include a form that says that. The primary can definitely make less (or nothing) and still be the primary sponsor.

     

    At the interview they will then look at the co-sponsor form that you file with it (from your cousin or brother). If there is an embassy that will look at the joint-sponsor alone, it still really doesn't hurt to bring both forms from both individuals.

    When filling out the I-134 form a friend of mine consulted with a lawyer about it. They followed it BY THE BOOK and the resulting I-134 form was dismissed at the interview because it didn't include all of the evidence that the consulate needed despite what the instructions said. Goes to show you that sometimes lawyers actually complicate things. 

     

    I remember there was an article here long ago about an interview with the USCIS. Once of the questions was "Do I need a lawyer" and the answer was "for what?"

     

    If you ever have questions - ask them here and you'll get the correct answers most of the time.

  6. Hi there, I'm working with my spouse to complete the Affidavit of Support and we hit the part about income.

    I, the beneficiary, currently DO have an annual income and it WILL continue after I have become permanent resident.

     

    On the instructions it says that I do not have to provide an I-864A but that I must provide evidence that the income will continue AND that I am currently residing in my spouses residence. 

     

    Getting the first part is easy. I am working to get letterhead written up that will show income via foreign source through the year, AND I am working on obtaining the job offer I had in the US.

     

    How though I can prove that I am at the same residence as my spouse? I do have a drivers license that shows the address... is this considered enough if I provide both of our drivers licenses as proof of our address?

    I also have a US joint bank account with my spouse that I believe will show our address if I get them to do a printout of the account. Is this necessary with the above?

    No. Purpose of Visa is to get in and marry within 90 days which you did. You did not violate that even if you are now beyond that period.

  8. I would bring it with you in your CARRY ON. That way, you can freely (and you should) disclose it to security as it goes through. Expect to have it examined in line.

     

    Huge amounts of medication, even with your name on it, can easily raise red flags about the sale and distribution of prescription drugs. If anything, it may get seized as quickly as a large bottle of water.

    That said, if you can do without it and think you can get new prescriptions filled while in the States, I think we both know what the easiest course of action really is here.

  9. You are definitely free to say "see part 8" rather than cutting off information. In fact, I'm sure they'll prefer that.

     

    Photos are ALWAYS secondary evidence and are not really considered during the I-129f filings. They can show that you both were at a location at a certain date IF it is also backed up by I-94 entry, credit card statements, boarding passes, etc..

     

    For example:

    A photo of you and your fiance taken at London Bridge at what looks to be summer time. Included primary evidence includes boarding passes at London England airport in August.

    A photo of an engagement ring. Included primary evidence would be an engagement ring receipt.

    A photo of you both having a fancy meal together. Included primary evidence would be a receipt from the restaurant on the same date printed on the back of the photo.

     

    Include as many photos as you can. Even just a couple are fine. Remember they are secondary and should be backed up by primary evidence!

    Each photo should be on its own page with the names of who appears in the photo / date / location listed on the back of the photo.

  10. I would advise against the above suggestion to just get married and overstay on the visa. The entire point of the K1 visa is to allow families to live together while adjusting status.

     

    The CR1 and IR1 visas for marriage the foreign spouse must remain overseas while waiting for the visa to process. I'm not even sure it would be approved if you were truthful on the forms.

     

    Speaking of which, you're absolutely right... visiting on a tourist visa and getting married is usually pretty sketchy. Expect to be grilled.

    Not stamping the passport is more common at land crossings than anything. Is this where you're seeing them leave out a stamp?

     

    Either way, your I-94 record should be getting updated even if you receive no stamp. The stamp is simply a second entry record / travel visa admission.

    I agree and would add that you should double-check with the courier as to what date it will arrive. "Next day" shipping is often NOT set to arrive on the next day.

     

    For example when we first tried USPS next day, they told us it would not arrive for 5 business days at the earliest. UPS was legitimately overnighted, and FedEx would have also offered a similar service. You pay more, but you get the documents right away with tracking info.

  13. As a bit of additional info, they do not cash the check until they have transferred it (successfully) to the CSC in California for processing. The Texas service center do a very quick check for missing signatures, etc, and send back the check without cashing it along with your application package if they had issues.

     

    That doesn't mean that there isn't something that will be caught later, but there was nothing they noticed was obviously missing.

     

    You've passed the very first step.  ;)

  14. For me I had more choice in booking the medical than I did with the interview. Booked interview 2 weeks later, and fiance send all the documents overnighted, even though we had 2 weeks.

     

    You could wait until you have all documents before booking an interview, the but Letter of Intent must be signed with 30 days of that interview, and again, interview dates aren't always all that flexible or available. Booking a few weeks out will give you PLENTY of time to get things sent over.

    You have 6 months of validity on the medical. You'll be fine.

  15. Don't over think the location.

     

    Write the date and the location ie: State, city, country. You don't have to specifically list what address you were at when the photo was taken.

     

    The only pictures they need at this point is to establish you have met in the last 2 years and that a relationship exists. You do not need to submit photos of proposals, though you could. Videos are absolutely ignored, HOWEVER, I too submitted photo still frames from a video and was fine with it.
