A waiver approval time frame depends only on uscis or does the home country has any effect on the approval and time frame?

You will need pictures , plane tickets , hotel recipts . You will also need to write a story on how you guys met and an Intent to marry letter from each one of you guys , also records of conversations over the phone as WhatsApp screen shots , Skype screen shots that show the date and the length of the conversations . Good luck with everything ! If you have proof and your significant other is healthy and has a clean record with the police in his country in 6 months you will have your loved one with you !

I once asked this question and somebody told me that the person does not have to pay for the second interview . I am about to start on a waiver for my fiancé and I also wanted to know for sure if he would have to pay for the second interview .

How did the interview go ? Mines was in so for over a month and then it was refused .

From what I have read , most of the time the reason why the visa gets sent back it's because they didn't believe the relationship was real . It could be many reasons why they didn't believe the relationship such as , age difference , might think you guys are related and just doing it for adjusting status , haven't seen each other too much , etc etc , also some countries are harder to grant fiancé visa you might have to get married and sponsor him as a husband .

Depending on which state you live it changes but most states if you make around 17000 a year you can sponsor a fiancé , maybe get a part time job while going to school and work for a year ? Because as the other comments said it will be a waist of money to apply and you not having a stable income , automatically they will think your fiancé will become a public charge once they are here and the visa will be denied or put on hold until you get a sponsor or a stable income .

Have the petitioner contact he embassy or nvc and she has to ask them why exactly did they send the application back . You guys might have to seek the help of a lawyer to advice you on what to do next but maybe what will work better for you is to get married and have her sponsor you as a husband . Certain countries seem to be more strict than other to provide k1 visa specially when the male is the benificery .

Usually when they say that the petition it's sent back to nvc it's a diplomatic way to say it's refused . Can you give us some details of your case such as is there any big age difference or such thing that could had been a red flag for them sometimes also they send the petition back because they didn't believe the relationship was real .

This week I will finally consult a lawyer to start my waiver process but I would appreciate some advice.... I don't suffer from a major illness just the whole k1 visa process caused me hypertension and vertigo and I have a permanent job here in the state that I live I have qualify for affordable health care and my I also have to take care of my mom . Does it sound enough hardship for a waiver to be approved ?

I only showed my most recent tax return my employer letter and as long as you make more than17000 a year you do qualify to sponsor a fiancé unless you claim more people and depending on which state you live . As long as they still have your passport and hey haven't said no officially I believe there is still a chance .

Contact the embassy directly and have them tell you exactly where your visa is or when it will be issued .

Have the petitioner contact the embassy through email or phone and ask in detail why was the visa refused , also since they kept your passport they might try to debate something about your case and then they will give you back your passport with the actual refusal letter .

Pardon my ignorance just because people from Spain and Italy I have seen enter the USA with just the Spanish or Italian passport without a problem . What would be the point for applying for visa to come here ?

I think from the beginning he approach you as a girlfriend he did fraud he knew what he was doing . These people are actos and they allure people to use them some how . they are looking for a victim , but he will get his karma . Do everything in your power so that he doesn't get his green card .

There is no way to send somebody back home. All the OP can do is 1) withdraw the I-864 so he cannot AOS, 2) divorce, and 3) provide evidence of fraud to USCIS (so hopefully they won't have a basis for a VAWA claim). Once his AOS is denied and he loses authorized stay, he can choose to go back home, file for VAWA, or to stay in the US illegally and face the consequences. But at that point, the OP is out of the picture (except maybe the divorce finalizing).
Good to know , I guess try to move on and life itself will punish him .

I feel strongly he is living with his cousin but he did not leave a forwarding address and he does not talk to me. He completely ignores me. Two weeks ago When he left for 2 days with no word he was leaving and not coming back I started searching all over the house for his AOS receipt number and not only did I see no sign of it I couldn't find any paperwork pertaining to his k-1 visa or any immigration paperwork which was mailed to me not him. He took everything. But I did find a 21 page documentation he wrote about me in November 2016 when we were separated for 2 months. 21 pages of how much he despises me and hates me. It seems he will attempt to file a VAWA for all the mental, emotional and physical abuse he says I caused him detailed in the letter. I guess he thinks when he kicked me because I picked up his phone that was my fault. Or after he hit me several times while I was driving because I touched his headphones and I hit him back to defend myself I wasn't supposed to because I caused him the stress that made him hit me. So in return he smashed my windshield which cost me $950 to replace and he told his family I did it and blamed him cause I'm an alcoholic according to him. The most I drink is socially once a week and I can only handle 2 martinis. Sorry for the rant but I don't think he will come with me.
Could you contact ice on him so they send him back to Jamaica ? I hate it when people use other people , it's funny how when you used Togo visit him he didn't notice all those things that he claims about you but now that you guys live together he is saying all this stuff about you . Do everything you can do he doesn't get away with this talk to whoever you need to talk to because what he did is obviously fraud .

Is it posible she can go to the interview with him and tell the officer in person all the horrible things this man has done to her ? I'm very sorry to hear about what happen to you , I have been through something similar in the past and nobody should ever go through something like this . Good luck with everything .

If a waiver is approved and then the fiancé or husband gets a second interview at the USA embassy of his home country do they still have to pay the fee for the Interview as they did when they had the k1 visa Interview ??

Not sure exactly for Dominican Republic but my fiancé is from Latin America as well and around 275 dollars sounds about right .

How much did she make in 2014 ? If she made more than 18,000 that year it will be fine even if the lawyer wrote the wrong amount , if anything just the day of the interview take a copy of her latest income tax returns that testify how much she makes . By the way I don't know how t will be in your embassy but my fiancé had to get photo copies of all original documents and one for them was my last years tax returns if it's the same for you then there they will verify your wife's latest income total . I don't think it should be a big issue. Good luck
