    From what I have read online since your visa at one point said ready , this might just be a temporary refusal then it might go back to ap or   To ready . My k1 visa was refused and then I got a refusal email stations that we are eligible for a waiver . I am new to all this and have many questions about it myself but I am guessing that the difference between a Dinial and a refusal is that with a refusal they might give you other ways to re qualify for the visa while denied is a plain no . Good luck with everything I know exactly how you feel .

    I'm assuming after he waiver is aproved he would have another interview ? Is the process similar to the k1 visa process which they ask for paper work from the beneficiary and medical exams etc

    I-601 application fee $930.  If you use a lawyer to prepare your waiver packet, which I highly recommend they can charge anywhere from $3,000-$10,000 for a good, experienced immigration waiver attorney.  Do not use just any lawyer.  I highly recommend Lizz Cannon.  Her rates are reasonable in the waiver world.  Our waiver took 10 months to be approved.  If you make a profile on immigrate2us.net they have a spread sheet that you can see.  It works similar to timelines here to compare others processing times.

    This shows that they are currently working on May 26, 2016 filings.

    It takes around 10 mo the for just the waiver to be aproved or if all is good the visa to be granted as well ?

    Yes , unfortunately it was because of that . It's really sad and frustrating because the whole process is very confusing with time and money but , I love him and will do anything I can so we can be together . This is another unknown route for me the whole waiver thing 😩😩😩😩 I have no idea how it works or how long it would take .

    Update on my case , they said we are eligible for a waiver ... how do those work ? Is it a long process ? I will get a lawyer this time .

    When they need additional documents/information, such as the court papers, the application is temporarily refused under Section 221g of the INA while waiting for that information.  Once the information is received, it will be reviewed and the final decision made.  If the conviction does not result in an ineligibility, the refusal will be overcome and the visa issued.  If it does cause an ineligibility, then the visa will be refused under the appropriate part of the INA and information about the possibility of a waiver will be given.  Right now, you need to wait a bit longer while they review the court information submitted....hang in there!

    The paper work that the embassy requested the day of the interview was sent to the interview and I got confirmation that it was recived and on ceac the status was admistrative process now it says refused I don't know what to do :( I have not yet recived a refusal email or letter from the embassy and the case was checked again today but status still says refused .  Could there be any chance whatsoever ever that it might be a temporary refusal ?

    If as mentioned in other post about the previous robbery, the court records they asked for could have been the reason for denial which could involve a waiver.

     

    You may need to do FOIA if you can't find the specific answer as to why it was refused.

    He will need to find out the grounds for refusal and whether a waiver could apply to his case. Has he called the embassy? 

    I just saw it says refused in the website now once I type in the case number . It says to review the paper that was given to him the day of the interview , but the day of the interview they didn't tell him it was denided they just told him to bring court papers which he did 2 weeks later .

    He had a robbery charge from 3 years ago but hat was the only thing he had on his police report . The case was dropped and they gave him one year of community service which was dropped to a fine of less of 35 dollars in his currency . I was thinking it could had fallen under the petty office exception . What can I do now after seeing this what are my options ? 

  11. It's been over a month since my fiancé had his interview and due to a petty theft charge he had 3 years ago they requested for court records and kept his passport at the embassy . It's been 3 weeks since he took the paper work that was requested to the embassy and the case has not been updated since the week he turn in the paper work  . I am very stressed out because we have not heard anything and it's been many months since the last time we saw each other . I was wondering if it's too soon to contact the embassy and ask them about he case or would it be better if I go there to his Country and go to the embassy and check the status of the case personally but would it make any difference ? I am so desperate don't know what to do or have any idea of what the outcome could be. Them holding the case for this long could it be a good sign or a bad sign ?

    As long as it takes. :P But to be a little more specific, probably a few weeks to a month or so. I don't want to get your hopes up in case it's not that, but it's probably closer to a few weeks to a month timeframe.

    What happen was he had a petty theft case 3 years ago but since he didn't have any criminal record they extinguished the case and at first they were going to give him one year of community service then decided not to because he was working and going to school so they agreed for him to pay the equivalent of 40 dollars at the time in his currency for the damages of the incident . I know nothing is for sure at this time but I a new to all this and it's so frustrating 😭😭😭😭😭😢😢😢😢

    AP has no fixed amount of time, but if the only issue was missing documents then usually a few weeks is common. Sometimes longer, depending on what the documents are and the need to verify them.

    It was court papers of an incident that he had 3 years ago , how long would it take for them to determine if a case falls under the pettty of fence exception ?

    Ive been working for CVS for two years now and i am full time. Anyways i didn't make the 2015 125% poverty line requirement because i was part time, but i did for the year 2016, will this hinder anything if they notice i didn't make the requirment for the 2015 year but i did for the 2016 year?

    Depending on which state you live but if you make around 17000 a year you should be fine with sponsoring your fiancé without a co sponsor . Good luck !

    So a waiver will be necessary no matter what ? Even though it's the only thing showing in his record couldn't be put under the petty exception ?
