RFE on I-864
K1visaHopeful replied to CZ Sam's topic in Adjustment of Status (Green Card) from K1 and K3 Family Based Visas
I864 RFEs are generic. You could have one issue or many. The RFE will not tell you directly but if they have included many details, you likely have many mistakes. Household Size is definitely an error but likely not the only. W2s are not needed IF a return TRANSCRIPT is included. You submitted a TRANSCRIPT, correct? 1. a GOOD read through the instructions will be helpful. 2. Reading through the many many threads about I864 RFEs on VJ will also be helpful to you. Only you will know what's wrong with your form as we cannot physically read it nor SEE the supporting financial documents you include nor KNOW what financial documents are required for YOUR extremely individual situation. -
You stated in your post/ comments that you are NOT outside of processing times at YOUR LFO. That information is PARAMOUNT and the only thing that matters. If you KNOW that information because you know how to easily look it up like anyone can that's all you need. You cannot compare her case to anyone else EVEN at the same LFO. Why? Because you moved. You moved from one LFO to another LFO with LONGER processing times. Moving was your mistake. And while USCIS will never admit it, you likely got a BIT lost during the paperwork shuffle (and I'm not exaggerating a bit because FL LFOs are usually long to process). What you can do and what it sounds like you have been doing by your responses: Use the website like everyone else to monitor to monitor processing times. Once outside of normal processing times, use same website to place an outside of normal processing times enquiry. It will give you a time period for their response. Wait it out. Place a second one. Wait IT out. THEN if no response you are eligble to contact your government rep for assistance. All of this talk of lawyers makes no sense because you've clearly stated you know you aren't outside of normal processing times for your LFO because you've looked. Ppl are missing that and are responding to that only. WoM helps only when you are outside of normal processing times and never forget that it only forces them to open your file. And if they see that you've simply not waited the allocated time that they post publicly they can respond with a simple denial and you'll have to file AOS all over again

Same forms. Select renewal options. Can reenter UaS up until expiry on AP. And you've both filled out a change of address AR11 within 10 days as legally obligated to every time you've moved and confirmed the change by waiting 30 days afterwards and contacted Ask Emma to make sure they changed your address? Explain what you'd be expecting from a lawyer? If you aren't outside of normal processing times for your LFO, a lawyer can do nothing. Pardon? If she has EAD, she can work. You said earlier she does. All she needs to do is renew. Can continue to work while renewal processes. One can also study. A GC is not needed for that.

Yes. Reading the household section of the instructions will be helpful to you for understanding also. It explains who to include and why to include them. No. Not likely. Most recent year is paramount while three most recent is mostly used to ensure taxes have been filed for three most recent years and are similar in income. Third most recent is less relevant however your adjudicator can use the totality of any financial situation and can ask for anything they want to. Unlikely. Most likely. If you want however amounts will need to be listed for the last year with lowest balance used. SSN will come in the name that you apply for the AOS form in. If you want your GC and EAD to come in your new married name, you apply for those forms in that name. SSN follows in same name. That's why you apply NOW like the others have said in your maiden Name. Ensure you've both checked out the VJ guides about common topics and joined your Monthly AOS Filing forum to get basic support from concurrent filers.

Regardless of age, a K2 will apply for the above forms separately. You are not part of the K1s biometrics appointment. You'll receive your own Noa1s and Biometrics appointment notice separately. By chance it may be at the same time/date but that's irrelevant. Your notices are your notices. Notices are currently taking 8 to 10 weeks. Anything sooner is luck.

Are you referring to the I485 and I765 and I131 receipt notices that you will file for yourself as all K1s and K2s need to file their own appropriate forms to AOS/Work/Parole accordingly/they are no longer "derivatives"? If you've filed those for yourself, you'll receive your own Biometrics appointment notice. Please fill out your VJ timeline in reciprocity.

ID from DMV
K1visaHopeful replied to Gary Rich's topic in Moving to the US and Your New Life In America
Driver's license rules vary by state. You (or anyone reading this) can look yours up by Googling "Driver's License (your state) non US citizen". In most states, a K1 will not be allowed to drive passed day 90 on a state obtained DL. That's just one of the down sides to the K1 process. Had driving been required by the immigrant, a spousal visa is the better route. *K1s cannot use International licenses in most states either as they are for visitors not immigrants. -
Ensure you read the I693 instructions for the K1 exemption rules. You have a DS3025. Photocopy it and submit that as recommended (but not required). Your IO will obtain your Afile for the interview where your medical exam is stored. Please join your monthly AOS filing thread on VJ to find easy answers to filing questions from your fellow peers.

Civil Surgeon's are not employed by DHS. They are a private practice who apply through the CDC to be eligble to complete immigration medicals for profit. They have no reason to tell you anything. Most are just here to take our money. It's up to you to determine your necessity to have a medical completed. For others reading this thread silently, please ensure you understand your requirements as a K1 by reading above and how to know (through reading through your DS3025 for completeness) if you need one or not.
-
I693 and another medical is likely not required for K1s either if you 1. COMPLETED your medical abroad AND 2. are filing I485 within one year of the date of that medical AND 3. your DS 3025 is MARKED complete AND IS complete. Read through the I693 Instructions before spending money on another medical.

K2 AOS timeline
K1visaHopeful replied to GinoNiña's topic in Adjustment of Status Case Filing and Progress Reports
At this time, it's normal. Subscribing to your AOS filing month forum on VJ is your best source for current info on your path. -
It IS an "IF ANY" question. It could not NOT be an "IF ANY" question because not everyone who files I485 has an A number when filing. K2s for example, do not have A numbers. It won't be rejected for that reason. Plain as day, A Numbers do not start with double letters and when it doesn't matter if you filled it or not it cannot be rejected for that reason. They will look it up themselves after they cuss you for your error. No biggie.

While it is only RECOMMENDED to submit a PHOTOCOPY of the DS3025 with I485, Panel Physician's are REQUIRED to provide a personal copy of the DS3025 to the patient. The CDC states so. I've remedied, in several cases, to provide a link and quote the website to your PP via email or letter and remind them that you are eligible to file a complaint directly to the CDC for PPs that are not following the procedure for their patients. Link to follow.
