    I have my documents ready i believe,  but just wanted to re-visit this question before I send them off. 

     

    Regarding putting my wife's married name on I-485, without having changed it with social security, etc. 

     

    I read this on another forum, and it has me confused:

     

    "You fill it in with your current legal name. If you legally changed your name as part of the marriage, then the new name is now your legal name. Not all people legally change their names as part of marriage. If you changed your name, then the marriage certificate should indicate that, and the marriage certificate serves as proof of legal name change. For your I-485 you will need to provide both your birth certificate and proof of name change (marriage certificate) because your current name will be different than the one on your birth certificate. It's okay to use documents in your former name as long as you use them in conjunction with the marriage certificate which proves the name change."

     

    On our marriage certificate is her maiden name, which I thought was standard on any marriage certificate. Here, in TN, we just take the marriage certificate to the social security office to apply for name change, and that's that. However, I failed to do that within the 90 days for the I-485.

     

    This just has me really confused, and I just don't want to run the risk of a denied application because of something so trivial.

     

    So, although our marriage certificate has her maiden name, and nothing has been done by us to change her name legally with social security office, I can still put her married name on I-485?

    Thanks a lot for the reply. That clears things up.

     

    I guess the part that confused me was the " Current Legal Name" in bold letters, and since we hadn't gone the social security route, thought that I would still need to use her maiden name. 

     

    I will put her married name, and then just put her maiden name in "Other names previously used"

  3. I had another question about I-485

     

    As I had mentioned earlier in the thread, I failed to get a social security card for my wife before she became out of status.. due to confusion. So, in essence, her name hasn't changed.

     

    I learned that when completing the I-485, that the name we use on the form will be the name the EAD and GC will be issued under. 

     

    The thing is, we want to change her name when we receive the EAD, because we failed to with the social security card. 

     

    Is that the best course of action, or my only choice at this point? I understand there is a pretty hefty fee to change a name on an issued green card. 

     

    Is the copy of our marriage certificate enough to go ahead and put her (future) last name on the I-485?

    As i mentioned in my first post, a lot happened in a very short amount of time to put us behind, but hopefully we’ll get it out soon. We’ve started completing the forms today and will be scheduling her medical exam Monday. 

     

    As for her social security, that definitely was a blunder of mine. But we’re ok waiting for EAD, as there is no real hurry for her to work right now. 

     

    Does the AP, allowing her to travel, come at about the same time as EAD?

    Thanks a lot for your reply. 

     

    We got married before the 90 day mark, which I knew had to be done. I was just misinformed about starting AOS before 90 day mark also. 

     

    But it’s my fault for dropping the ball at the end of the day, especially with the Social Security Card. 

     

    We are going to file for AOS within the next week or so. I think we’re ok waiting for EAD, and AP.. hopefully they come around the same time. 

     

    My main fear was just that she was in some immediate danger of being deported or something. 

     

    After going through the wait for the first part of this process to finally be together, the last thing I want is to have to be apart again. 

     

    Is is there a page on this website that lists specifics about AOS, such as forms needed, extra tips for easier processing , etc? Like there was for I-129f?

     

    i have a list of forms and things I need, but I want to make sure I don’t miss anything. Also, wanting to try to find answers to any evidential things I may need to send.

    My fiancé arrived on February 15th 2018, and we were just married on April 22nd. 

     

    I knew that the next step was to file for Adjustment of Status, but i was under the misassumption that there wasn’t a strict time limit to do this, although I wanted to do it as soon as possible. 

     

    Life happens,... a new position at work, a death in my family, trying to save the money for AOS, etc.. just literally haven’t had time to sit down and get the paperwork started until now. 

     

    So I finally gathered my wits and will be working on this now until it’s finished and turned in. 

     

    However, I have several questions and I need help being pointed in the right direction. 

     

    My wife’s K-1 status expired 4 days ago. 

    I called USCIS yesterday for questions about the AOS, (again under the assumption I had time to apply) and they informed me that I should have applied before the 90 days, and that she is now out of status. Which of course worries me. 

     

    My my main question is are we doomed and is she de-portable now?

     

    Also, we just got married, so we want to get her name changed.. but found out also yesterday that they check I-94 along with Marriage Cert at the Social Security office to do this.. and I-94 is now 4 days expired also. 

     

    Lastly, since I-94 is expired, no social security number, and we have to wait for EAD for her to work. I have no idea how long this takes. 

     

    I realize that some of my unpreparedness was because I had put AOS, etc on the back burner.. which was a mistake. But this process is also very confusing. 

     

    If if anyone could reach out to answer my questions, and point us in the right direction, I would be very grateful.

  7. Thank you for the info Marta. I read it and it seems to be correct. That's probably what we'll do. 

     

    However, the appointment website makes it confusing. I am attaching a screenshot of the website for our DS-160.  You can see that we have completed everything necessary, and they are requesting payment and appointment setting, for the next step.

    I have just joined VJ, although my fiancé and I are nearly through the visa process. She is from Mexico and I'm in the US.

     

    To fill you in on where we are currently in this process:

     

    We submitted our application in April, received approval in September without any RFEs, received our NVC letter, and finally received the letter from the consulate with instructions from Ciudad Juarez. 

     

    We are to the point now where we have completed the DS-160 online and we are attempting to pay the $265 fee and schedule an interview appointment. 

     

    On the fee/appointment page, it states that the fee needs to be paid, but also states that there are no appointments available, "Please check back in a few days."

     

    My questions revolve around the different things I have read online about the fee and appointment. 

     

    As as it looks right now, we cannot actually pay the fee until an appointment is available. Is this correct?

     

    I see no option of actually paying the fee on that page. Even though it is the actual "pay fee" page, it only shows appointment availability, which as I said, there are none currently. Does the payment option become available once I can actually choose an appointment date? 

     

    Also, I read somewhere else online that the fee could not be paid online, and of one actual instance of the consulate not accepting a receipt from payment made online and that person had to pay again at the consulate. Is this true?

     

    This is confusing, and I would like to know exactly what to do. 

     

    Lastly, how long does it take for an appointment to become available? 

     

    I know all of you can imagine how much we just want to be together. 

     

    Thank you for your time in responding. I really appreciate any and all info.
