    We submitted on May 29 and still waiting :(  How do I contact the congressmen?

    The time frame reflects the earliest case that is processed by USCIS. It does not mean you will wait three years. I have seen many May 2017filers get interviews here in houston.

    Now that it is updated (correctly), I think that means Houston is FINALLY ready to accept your case
    I anticipate your interview to be by year end of January 2019 at the latest!

    Well, initially our status said "ready to be scheduled for interview" since August 2017 and today I noticed the date changed to March 2018. Hmm I hope it means good news.

    It includes USCIS responses to congress about complaints that have been filed. The most recent document is from 2017 and it discusses multiple reasons why filing has slowed down. The document is broken up into Family, employment and other immigration types. It does not mention adjustment of status in particular, but I think it is worth a read, and allows for a little more clarity.

    So yes, been waiting since 1st April 2016.

    Because If my case says "ready for interview" for more than 3 months, I am considering reaching out to them and figuring out what in the world they expect to do about the backlog

    Oh man, yeah it is really unlikely that it will take less than 3 months. It looks more like 1.5 -2 yrs is the norm now. If you do, let me know how it goes. I will just wait, I really don't think much can be done.

    Yeah, it doesn't. It just means if he chooses to enter the usa with a work visa, he can. But then adding a fiance visa on top of that would be really complex. So he is forgoing entering through the work visa, and instead entering with a fiance visa, therefore having to wait for EAD after marriage.

    The fiance's expected job will not have any meaning for the I-134 (or I-864 later, unless they obtain an EAD and actually work there first, but the EAD requires a sufficient I-864 in the first place so it's a chicken and egg sort of issue).

     

    The IRS doesn't care if the income was earned above or below the table. It must be reported either way.

    For the I-134, you need to provide at least the most recent year's tax return.

    For the I-864 (for AOS later), you must provide at least the most recent year's tax return AND have filed taxes for at least the most 3 recent years.

     

    Note that he will not be obtaining a work visa. He will receive an EAD to show his work authorization. This is only after 1) entry on the K-1 visa, 2) Marrying within 90 days, and 3) Applying for AOS + the EAD. EAD approval is taking ~4-6 months currently, although you can request an expedite with a firm job offer to try to get one sooner. YMMV.

    I think she meant, the job can also support him through a work visa as apposed to only being supported by a fiance visa. What I understand is that the job will wait for him to get his EAD before he starts working. She only mentioned the job to state there is one line up for him.

     That is where the confusion came in. Yes K1 the apply and receive EAD, then work. Sorry if we misunderstood but it sounded like you meant he was going to work for the family as soon as he got here.                              when earning abroad, you only have to file taxes if you make more than $50,000

    You still have to file taxes, it is just that you don't pay unless you make over the set amount. 

    She said "He is NOT planning on working without a work visa!"

    No doubtful. For K-1, you didn't always need to have an interview. Could depend on the info given in the original I-485 petition, or I've heard that if the local office hits a certain monthly or quarterly quota of interviews they don't have to do any others. Now though as I understand it interviews are required no matter what, that's what I've heard anyways.

    It seems like people between May and June have not received anything. I honestly think my husband and I have an easy case, we are as clean as can be haha.
