Hello everyone.
I moved to the US April last year on a K1 visa and got my EAD this past February. My current AOS status says that my case is ready for interview to be scheduled but with the ongoing covid situation God knows when it will actually take place.
I have been employed since April and I have just become eligible for their benefits program (yay!) but here's the issue: the company's website states that:
"The Company has partnered with Med-Enroll, a free resource that helps you determine if you are eligible for free or low cost, state-sponsored medical, dental, prescription drug and vision coverage. Eligibility is based upon your state of residence, household size and income. Certain states, like Arizona, California, Colorado, New Mexico and Nevada have programs for family coverage."
Under my immigration status I am not supposed to use any government-subsidized program/benefit. Does anyone know if that will conflict with the benefit the company is offering?
Sorry if the question is too simple, I am entirely new to this world of healthcare in America.
Thanks in advance and God bless.

Great news!
My EaD has finally been approved!
Just got the update today on myUSCIS, the card has been ordered and should be delivered soon.
I had an issue with RFIE (it took me 2 months to get my hands on the documents needed) but finally it feels like the agony will be over soon.
I can't wait to get started working. I've been feeling like a broke teenager for the past 10 months hahahahaha.

Hi fellow June filers. This is my first time posting on this thread.
I would like to ask everyone if their cases also start with "MSC". Do all cases go first to Missouri?
Also, does anyone know at which point your case is transferred to a local office? And is it always the closest office?
I've had a RFE which was received by them 61 days ago, my whole process is on its 164th day and counting. I see that some people in similar situation already got their EADs. I haven't had any significant update on mine.
Is it normal for even the EAD to be taking this long? Is there anything any of you did regarding the EAD?
Being jobless for all these months is slowly driving me insane.
Have a good day everyone.

It sounds weird to me that your check hasn't been cashed yet. I'm assuming you didn't get an email as well?
I don't remember my exact timeline but we could verify that the check had been checked not long after FeDex notice of the package arrival.
As for your original question, never send documents that haven't been asked. Wait until you get a NoA or a RFE in order to do that. As far as you know they haven't even opened a case for your application yet.
If I were you I'd ask your lawyer again and try to call the USCIS, even though it may be hard to get an answer since you don't have a receipt number yet.
Just so it's clear, did your application contain an I-864 at all?

I think you need to sit down with all of your documents and the I864 you submitted and go over everything. This is never an easy RFE to fix unless you review everything and figure out where you went wrong. It's not as simple as you're thinking (and what everyone else thinks when they get this RFE).
Like I said though, I can help but you have to be willing to sit down with everything in front of you and really make a commitment to understand the complexity of the I864 and your issues with it and what you submitted.
If not, much luck to you.
Right I'd checked the wrong item before. Part 6 Item 7 is in regard to current annual income, which is 19k (reason why we have a cosponsor). Reported income in 2018 was 11k and expected income for this year is 21k.
Looking at it it makes sense why they may be confused about current income. Does that answer your questions?

Interesting...I was going to suggest letters from employers, but you say you included that with pay stubs.
They ask for proof of other income? Does your wife or cosponsor earn a significant income from dividends, pension, or retirement account? Perhaps they need proof that is ongoing income, like a brokerage account statement?
Hopefully others can give more and/or better advice. Good luck- Jason
Right, I am going to submit them again though, who knows if they got lost or something.
Yes they did. My wife doesn't but her father (the cosponsor) might have, I'll ask him about it. The letter was specific about them needing proof of this income in case it exists.
I did some research on other websites and older posts here and apparently it's not uncommon for submitted documents to get lost in handling, turning into RFIEs for things that were in the first mailed package. I posted here to see if others have had similar messages and maybe spot something that I missed.
Thanks!

Can you easily read the notary seal? Does the person translating and certifying the document include their name and title? There is an "official statement" the USCIS likes to see from translators about their abilities and the accuracy of the translation.
Yes for both. I didn't assume they could be talking about the translation itself but that's an interesting take.
7 minutes ago, K1visaHopeful said:I had an issue with my MC for the same reason. I presumed they lost it or couldn't see the seal as it's literally only a raised imprint in the paper. I photocopied it at a darker setting and resent it. No issues.
As per the proof of income, I'll need a lot more info.
Your i864:
What did you input in Part 6 Question 7?
Your 2018 reported tax info or your 2019 predicted income....?
If you have 30 minutes, all your documents in front of you and are willing to do the steps to figure out what you're missing/what you filled out wrong on your form, I can help.
I take that MC = Marriage Certificate? They didn't mention that, but my birth certificate, but I think the same applies. Better contrast and higher resolution I'm assuming.
Is question 7 the one about whether the sponsor had or not been required to file a Federal income tax return? If yes that was left blank.
All the tax documents were submitted and not mentioned on the RFIE letter, they stressed the necessity for proof of current income though, meaning pay stubs and letters of employment. Do you think I should revisit the tax files even if they were not mentioned?

Hi fellow Visa Journey visitors.
I am creating this post because I, unfortunately, have received a Request for Initial Evidence letter in regards to my AOS process and I would like some help from the community to understand exactly what is that needs to be sent back to USCIS.
My letter discriminates two items:
1 - Applicant's Birth Certificate;
2 - Proof of Current Income.
Here's where the plot thickens: I did submit copy of original and translated birth certificate so I am surprised that this showed up on the letter. The letter also mention that a valid copy should contain one of the following "A legible seal, a legible stamp or a signature with a title containing the words: secretary, registrar or births and deaths". The copy does have a stamp so right now my idea is to scan the original for a higher resolution picture but I am anxious about sending the exact same document. Could they've lost the one I sent? Am I missing something here?
And with regards to the proof of current income, I had also sent pay stubs for both my wife (sponsor) and our joint sponsor. I will get up to date pay stubs from both and submit them too. One thing that caught my attention was the line asking for "Evidence of other income, such as Tax-Exempt Interest, Qualified Dividends, IRA distributions, Pension, Annuities, and Social Security Benefits (only SSA-1099 and/or SSDI-1099).
Has anyone else gotten this request? What documents would apply? I am sorry if the question is vague but I am trying to cover all the bases.
Thanks in advance for your time.

Update!
I got an email this morning stating that my documents have been posted at Correios for delivery, along with a tracking number. The email also states that it takes 1 business day for the number to work and 1-2 business days for the shipment to be completed. So I'm expecting it do be delivered this week.

So we are about to schedule the interview at the consulate for him. We got our NOA2 and RDJ so far. I did not make the minimum required last year because I only worked from March-December (if I had worked since January I would have made it). This year I make way more. My pay x full time hours is 29k. But I heard that it’s only the last tax return that counts... I’m dual citizen and have always lived in Brazil, just started working here last year. But already built a good credit, have my own apartment (rent), car, etc. The only thing that I do that I am concerned is my school. I take financial aid and loans
No dependents for neither of us
I just had my interview this past week. You should be fine.
My soon to be father-in-law was our co-sponsor. @Ayrton advice is spot on. If you can add bank statements to the affidavit files that also helps.
Each case is different but I can tell that in my case they simply skimmed through the I-134 and asked me who my co-sponsor was and checked that he was indeed my fiancée's father.

I opted for delivery, they gave me 10 working days. I've just checked the CEAC status an it says issued, last updated yesterday, 4/11. My interview was on 4/10.
This actually raises a new question: has anyone who's also opted for delivery received a Correios tracking code? So far I haven't got any emails or communication of any sort. I want to make sure I'm home when the delivery is due.

Not enough time unfortunately 😕. From many reviews I’ve read and people I know that went through this process and had their k1 visa approved here in Rio, it’s safe to say it could take at the very least if you’re lucky 1 week. I wouldn’t count on it though, after the approval you have to wait until your status change to “Issued” and then wait again to have it sent to either the ASC (CASV in Rio, if you chose this option when you scheduled and paid your interview) or your mail address, and that could take another week. Not to mention they can put you on Administrative Processing and there’s no estimated time, it could take several weeks depending on your case and what they want.
If I get approved, I’m expecting to have my visa in hand 3 weeks after my interview if I’m lucky. I’d say that’s the average time.
Oh this is so unfortunate, Definitely a deal breaker for me. Thanks! I'll guess I'l change my application and choose shipping the passport to my address. Can the status be checked online (like we did on the CEAC) and are we provided a tracking code (do they use correios or a different courier? I really hate correios...).?
-
Another day, another question...
I intend to stay in Rio a couple of days after the interview, can anyone confirm what the average time is for the passport to be ready for pick up? Would 3 working days be enough?
-
Sorry to keep bringing questions but just now I saw this:
On my DS-160 confirmation instructs to bring the confirmation itself and also proof of the 129-f approval. Is the latter the NOA2? In this case, will a copy suffice (since the original is with my fiancée in the USA)?
-
One more question: Does anyone have experience with doing the medical with Dr. Paulo Ricardo Furbetta, in São Paulo?
How many days on average did it take for the exams to be available for pick up?
-

You can also schedule the medical. I'm having mine next week, even though the interview is only next month.
Thanks. My city doesn't have a certified doctor so I'll have the appointment in Rio too and have one "big" trip.
Did your doctor require the CASV appointment confirmation in order to schedule your medical?
-
Thanks! From what I read, I am all set to file and schedule the interview, right? Do I have to necessarily wait for the packet?

Thank you, that is very helpful! I figured that this is what the company meant and went ahead. The actual coverage is issued by a private company so no worries there.
