That seems like a really stupid question to even ask her since they've been closed since March 2020. 

    Did you submit pictures together and her family when you did travel to Vietnam? How about screen captures of chats between you? These would helped as supporting documents

    It's unfortunate you couldn't be there due to covid. It's just bad timing to apply and for an interview.

Well, if you really want the green card then you need to get some good legal advise and legal representation to try convince USCIS your marriage is legit.  It sounds as though you won't be able to solve this problem on your own. Yeah it's going cost money but you should find a way to hire someone to help you and be your advocate. I think that's what you need right now  As they say, "If there's a way there's a will"

  5. Applied for n400. Let's hope it will be quick one.

    😀😀 Filed online was pretty easy but long.  

    I prepared the documents to upload in advance so it made it easier.   The 6M file size limit was a pain since I needed to reduce some large files into smaller chunks.    I pretty much updated ,  reorganized and reused the I751 documents so was less work gathering supporting documents this time.  Good luck to everyone.  Screenshot_20211127-124916__01__01.thumb.jpg.fbeec3a9c44fb0c0614fb25a500e355b.jpg

    This is good example of not to file on the exact day you become eligible.  Give it few days after you become eligible to file.  Filing  Few days later not going to greatly delay your application. There is huge backlog in applications due to COVID-19 anyways.

    Keep records and evidence of abuse.  

    You can file ROC for yourself without spouse via waiver. That's when records and evidence comes in handy.

    October 2005-April 2014- We met and enjoyed each other's company as a bf/gf couple

    April 2014-Late 2016- We were married in New York City and lived together

    Early 2017- After much damage to the relationship, our divorce was finalized, and she also filed her first I-751 with a Divorce Waiver

    Mid-Late 2017- Her 2-year Conditional Green Card expired

    June 2018- USCIS sent an RFE asking for the Divorce Decree (since it wasn't ready in time for the first time she filed), but she never received this RFE since it was sent to a different address.

    November 2018- USCIS sent a letter stating that because she never replied to the RFE, that her Permanent Residence status is TERMINATED (This also went to the wrong address, so she never saw it)

    January 2019- She checked USCIS for a Case Status Update, and learned for the first time of the June 2018 and November 2018 letters that she never received

    February 2019- Thanks to unofficial suggestions from VisaJourney, she reapplied for the I-751

     

    During this time she was also advised to get an I-551 stamp in her passport, but she was never able to get an appointment, so she never got one.

     

    During this time, I may have accompanied her to get biometrics fingerprints done again, but I honestly can't remember

     

    During this time: she worked (she has a Social Security Card and NY State ID), received unemployment during Covid-19 (PUA), and filed taxes all years that she was required to. Also, she was waiting to be scheduled for an interview.

     

    November 2021- She received a "Notice of Action" mentioning an Initial Interview. She has been scheduled for December 2021

    QUESTIONS:

     

    1.) Any advice from anyone that's been through a similar situation, (i.e. working and living with an expired Green Card, filing taxes despite not having an official residence status since November 2018, etc.)? I advise her to be completely honest with the interviewer, but what can she expect to be asked?

     

    2.) The Notice of Action says that she needs to bring with her "All travel documents used to enter the United States" and that she should "take a certified English Translation for each foreign language document". Does this mean that she needs to get her Japanese Passport translated?

     

    3.) The Notice of Action also states that she should bring an "I-94" and "I-512" if they exist, but even if she did still have those, I don't see what the point of them would be since they'd be older and possibly outdated documents from before she ever got her Green Card in the first place, no?

     

    4.) Since this "initial interview" corresponds to the 2nd I-751 that she filed, does that mean that everything that happened before (things that were related to the filing of the first I-751) are null and void?

     

    5.) I'd be more than willing to accompany her on her interview, but I don't fall into any category of "Only the following people may come with you to your interview" The interview will be at 26 Federal Plaza in New York. Anyone have any experience with this location and think that the USCIS would allow me into the place anyway, despite me not "qualifying". I know that rules are rules, but sometimes rules are broken.

     

    P.S.- I know that it may be a little crazy that I'm trying to help her so much, but I am the one responsible for bringng her over to this country and getting her into this mess in the first place. I'm not trying to get back with her, but I know that she and I both would love the closure of getting this long journey settled (at least for 10 years)

    Usually, Foreign passports are written in their language along with English.  No need translation.

    If it was a joint filing both need to go. If she filed alone she needs to appear alone. 

     

    If it's a ROC with valid divorce waiver then she should be good to go.

We passed the ROC interview.  I was surprises that I was being asked all the questions instead of my conditional resident wife.  Initially the officer seemed bit cold but after few minutes of questioning she became cordial.  We both worked for the government so we kind of established rapport.   The officer asked her maybe 2 questions. I was asked 20 or so questions.  We had an interpreter but forgot to mention about her to the officer so ended up having on standby.  We didn't need one at all.  

    I was concerned that I checked she understands English on the form and be scrutinized about it.  Towards the end she said we are to be approved.  I offered 2 inch thick prong fastended updated documents but she said no need and didn't bother to accept it. 😁

     

    Here are the questions not exactly in the order listed:

    To US Citizen:

    Questions about her taking my last name after seeing her driver license and marriage certificate.

    Birth date of wife?

    Where do you work.?

    Other questions as bout my job, etc

    Do you have a mortgage?

    About my apartment bought before marriage, etc

    Do I have a side job?

    Did you have to pay a dowry?

    Where did you take the engagement photos.?

    Questions about engagement pictures.

    Your wife family are a middle class family?

    Do you have any children?

    Where your work?

    What year did I became naturalized?

    What year I immigrated to US.

    Who sponsored me to come to US?

    Did you do the application?

    More questions that lead from the other questions above.

     

    To conditional resident wife:

    How many bedroom?

    Who cooks?  (I intentionally redirected question to my wife so she can answer.  I wanted show her English improved and good since on the form I checked she understands English)

     

    It has been a long journey and many days of worrying and preparation.    Naturalization is next!

    It's not about number of pages but quality of the supporting documents.  Ask yourself, if I showed this supporting documents to a stranger will they believe my marriages is real?

    I just wrote a simple email  for help.  Their assistant well respond to you fairly quickly.   I believe it is a law that they must respond to you   There is a sample letter on the web if you google it.   I don't know how better a lawyer can do for you. 

  15. Perhaps file for extension and find a CPA to help you. It will give you more time to file a correctly filledt tax return.  .  First thing I did was to  apply for SSN when my fiance arrived US and by the time tax day came she had a SSN so it was simple filing jointly.    visajourney  has step by step guide that recomnend this.

    USPS has one job and they can't do it properly... They deserve an award!!!!! And nobody over there is ever held accountable for the poor service provided.

    Never trust USPS    they lost my registered mail and they can't find it.   I've done everything I could think of to protect my identify from id theft.     They really created a big mess for me

    Once you are US citizen you travel as an American and get to report and pay US taxes where ever you are! On a good note you qualify for social security benefits after 10 years of working and paying SS taxes.
