The status online has changed to New card being produced!. So looks like it takes about 2 days for them to update the website. But it's great news.

    Mine is the same thing...

I just checked and it states that On January 17, 2017, we ordered your new card for Receipt Number MSCxxxxxxx, and will mail it to the address you gave us. If you move, go to www.uscis.gov/addresschange to give us your new mailing addres.

I called yesterday and was told that my case was still under review by a tier 1...

Hi all. I am also October 2016 filer. Did bio 30th Nov and status states " case is ready to be schedule for interview. But EAD yet to be receive. Pls do we have people in similar situation? Many job opportunities awaits but could not apply. Have october filers started getting EAD and interviews?

Hi, I'm in a similar situation.

    My PD was October 21st

    And Biometrics November 22

Still no EAD and my I485 changed to ready to be scheduled for interview since December 5 but no update on that either since then...

They always say every case is different though. I have a friend here who had to wait 9 months from her PD to do her Interview. We'll all get there. I'm trying to learn to wait. USCIS will teach most of us patience lol

Lol it certainly has taught me a bit..

I'm not really the patient kind but I've decided not to check the website until Monday which will be my 94 days mark. I'm hoping to have good news by them because it'll just break my heart to know that I've worked so hard to gain a little discipline and it didn't pay off. :D:dancing:.

My i-485 hasn't even changed from fingerprint fee received. I just want the EAD in hand. I know my field office is 8 months backlogged so I'm not even worried

My field office is backlog by about 4 or 5 months and I see persons with field offices 3 months behind my field office getting interview notice. I don't think the information given on the website is accurate.

Right.. I knew I heard that... but when I was looking at the timelines they don't reflect that.. as Lioness pointed out.. I suppose this is the reason I felt so confused by this... and the i-485 isn't listed at the uscis processing times for NBC.. so it is quite confusing atm..

It's not listed there because it wasn't their normal procedures. Since cases are no longer being transferred to CSC what's the point in sending them to local field offices if they find that the interview isn't necessary for some cases..

For the record, this is WAAAAAAY easier if you get a K1 Visa... Anyway, from the top!

    1) Have you been here longer than 90 days?

    2) What evidence do you have that you did not enter fraudulently on the VWP (return ticket won't cut it, and you are going to need a lot of evidence)

    3) In part 1 your current USCIS status would be "Entered under VWP"

    4) In part 2 the answer would be "a" (It assumes I-130 processing)

    5) Entrance status would be VWP, and yes you were inspected at the airport

    6) On form I-765 your status would be "VWP adjusting status"

As for the I-94 number requirements, leave them blank as you will not have one filing from VWP.

Now, cautionary note, this is not going to be easy! You will probably be accused of Immigration Fraud and you will have to prove otherwise. The burden of proof is on you here, effectively "guilty until you prove you are innocent". If you fail to prove your innocence you will be deported and face an even harder battle to get back to your wife and child. Why not return home and apply for a spouse Visa?

Bad advice. This is not true. In no way he committed immigration fraud... He entered the country legally with no intention of staying but circumstances chanced.

OFF TOPIC: I  don't understand why is it that whenever a person seeking advice about AOS from other visa or VWP than K1 everyone seems eager to blurt out immigration fraud or visa fraud. It's frustrating and not true so people need to stop saying it unless it truly applies....

    Thank you for replying.

I've been here 70ish days, as for going back and filing from there, there is no way I'm going to leave my wife to go through pregnancy alone, plus at the current time frame the visa would not be sorted in time and there is no way in hell im missing the birth of my first and most likely only child.

i came over purely for a visit, she was still married when I got here and we had no idea when it would be final as they couldn't find her husband. I'd just moved my mother in with me in England and she will now need to find somewhere new to live, I've left my dogs behind, there is more but the rest is very personal.

this was never our plan, she wants to move to the uk but she can't due to custody problems with her son, the plan was to keep visiting for this year while she tried to sort that out, then either she would move in with me or I would go through the normal channels I.e k1. But things happen and now we are adjusting as we go.
