Nevermind - I've found a thread that answers my question!

Are we suposed to send in G-325A for both the non us and the us citizen? I thought that for AOS I was only suposed to send in the G-325A for myself (non usc) but I have read that someone sent in G-325As for both???

What do we need to put under total annual income? Do we include the total with military benefits (housing, food etc) or without? There is a big difference of just under $20k a year without benefits but they are not taxable so do not show on the tax returns??
Take everything into account. Your BAH, BAS, and Basic Pay all get calculated for this. Go to the personell department to get a "statement of service" form. This is needed for your I864 form. You have to prove your in the miltary. On this form you should see the benefits paid to you along with time in service on the form. I was confused on this same issue...look for my thread for more help maybe.
Thanks

Well - we've just returned from getting married
and so we'll be sending my AOS off tomoro!! The only problem is that we havent received a certified marriage cert yet, just one from the minister who performed the ceromony and the cert marriage license, but we'll just expect an RFE as it can take up to 1 month to get the real ones and we dont want to submit after the fee goes up!!!
-
thanks guys
yea - we're gonna pay a lil extra for the minister to submit all the documents to the county clerk recorder the day after our wedding so that we can just pick it up that day. We were told that once they receive everything from the minister, they can issue the certified marriage cert straight away. As we're having our wedding in vegas, i've been told that it can take a month to get the cert if we dont pick it up ourselves, if this happens then we'll send in the license or something as we'd rather get a RFE than have to pay over $1000!!!

kool - I thought I was told somewhere that since I've done a K1 visa I dont need to include any divorce certificates etc as they already have copies of these??

So we're heading off to get married tomoro and I'm taking along my AOS package so we can send it off as soon as we have the wedding certificate in our hands! Does everything sound ok? I'm just applying for AOS only, not EAD or AP ... I have ...
- 1-485 form
- Copy of NOA2, front and back
- Copy of my birth certificate
- Copy of my passport - bio page and the k1 visa page
- Copy of I-94, front and back
- 4 pages of G-325A
- I-693A, sealed
- I-864 form
- W2s for the last 3 years
- Tax return transcripts for the last 3 years
- Letter from section commander confirming verification of monthly income
- 2 passport photos
We will write the check when we send it off and of course we'll have the marriage cert. Does this all sound ok? Is there anything we're missing out? Do I we need to send this to the Chicago address? Thanks

I was born in Bath but have lived in Cornwall, Bristol, London and Newmarket!! .. and now Arizona! and Jamal is from Philly, PA

Yea - I figured as much. Does anyone know when it will start happening if it goes through??
All those millions of hard working people are forced to work without status, under cover of darkness like thieves in the night, and all you can think of is your petition? Shame on you.
Are you joking? Of course I'm thinking of my petition! I dont want to go into the rights and wrong coz I can see both sides, but I want to able to get on with my life ASAP and not get caught up in the waiting game to be able to work and travel freely, especially as I came here legally!

Just out of curiosity .. if the immigration bill goes through and the 12 million people + are eligable for citizenship, will it effect us going through AOS etc in the future in regards to waiting time?? I'm not for it, I'm not against it, I was just wondering how it would effect legal immigrants?

Is everyone who came over on a K1 getting a RFE for the TB SKIN test or just some people? We're sending my AOS off next month - Ive had the vaccination suppliment done etc by the CS but I assumed that because i had the medical in April that I wouldnt need to get tested for TB again. Now, I keep seeing people who are getting RFEs for TB Skin tests AND the actual medical again. I think it's terrible that they are losing peoples medicals and demanding them to pay for another one! Anyway, as I'm about to take a college course within the health field, I'm required to have a TB skin test and a physical done. I want to go on the airforce base to get this done as it will not be alot of money at all as i will be a military spouse. The problem is that immigration wont recognize the test done by the airforce because they are not on the CS list. Do you think I'll get a RFE for the skin test? Hope that makes sense!!

Again I beg to differ with you all.
Yes they are probably happy they are leaving, but yes he is SUPPOSED to be notified and he is SUPPOSED to be red-flagged if he has a deportation order issued by a judge. That was the big deal after 9-11, INS was not red-flagging people properly and notifying them, they are supposed to be doing a better job of it now, but are they in reality, I highly doubt it, there is not enough man-power to update all the records. It is this slack or ineffectiveness why I give them a decent shot of actually getting thru the process and again unless they were CONVICTED of a criminal offense, these orders probably vacated themselves and are not even in the computer system.
Sincerely,
Ramos

They obviously have the information in the system, they took his fingerprints when he left the states, that is not normal, they will usually take fingerprints only on entry to the U.S. Anyway, regardless if the details are in the system. He will need to tell the truth when applying for the visa, and therefore will need to state that he overstayed his visa, had to face immigration court, didn't show up for the courtcase etc. The fact that he didnt attend college when he had a student visa will also come to light on the G-325a forms. He will need to put down the last 5 years jobs/schools attended and the last 5 years addresses. Unless he is to lie, then it will show up.

Well - yesterday I went for an interview thing with the instructor of my class and I got in! I'm really happy!! Here's to the start of a new career
-
Well I've been admitted into the class that I wanted to do (yey) and my question is do I need an EAD to do an externship as part of my course? I wont be paid for working, its just for the clinical experience and hours. Thanks.

In some state you can get a DL with the NOA1 for the AOS as well as the proof pf IDs. In Arizona my license is valid until my I-94 expires and all I need to do is bring my NOA1 for AOS and they will extend it for a year, or until my greencard is received.
-
I never drove before I came to the states. It really is easy, I picked it up after less than 4 hours driving! Here in AZ you can apply for the DL on a k1 and once your I-94 expires, you can extend your license with the NOA1 for the AOS so I'll never go without my license now. I know its different in each state, so contact your local DMV, or the one in Minnesota. I emailed the AZ DMV before I arrived in the US and explained my situation and they replied with a very helpful email, telling me exactly what I needed to do.

hmmm .. I called co clark yesterday and they told me that really its up to the minister. They record the marriage the day that the minister takes it to them and then you can pick it up after that. The woman told me that if the minister will take it to them straight after the wedding then we can the marriage cert then if we go with him. I cant actually speak to the minister until the wedding day, but i know we're gonna have to do a lot of begging!! It's really gonna screw us! I have another question. With the DMV you need to advise them of any name change within 10 days, and you have to advise SSA first because they will check their computers. What will happen if we dont have the marriage cert in time?I also need it so I can get my military ID, get the extra housing allowance and be put on to my fiances insurance! This is gonna make things real difficult. If we dont get it before July 25th then we will send of AOS without it and just wait for the RFE - we cannot afford the fee when it goes up!!!

I cant believe the arguments that you are coming out with and then turn around and say your not racist!!! It makes me angry!
Do you not know the modern history of south africa?
Apartheid (meaning separateness in Afrikaans, cognate to English apart and -hood) was a system of ethnic separation in South Africa from 1948, and was dismantled in a series of negotiations from 1990 to 1993, culminating in democratic elections in 1994.
The rules of Apartheid meant that people were legally classified into a racial group — the main ones being Black, White, Coloured and Indian — and were separated from each other on the basis of the legal classification. Blacks legally became citizens of one of ten bantustans (homelands) that were nominally sovereign nations. These homelands were created out of the territory of Black Reserves founded during the British Empire period -- Reserves akin to United States Indian Reservations, Canadian First Nations reserves, or Australian aboriginal reserves. Many Black South Africans never resided in these "homelands."
This prevented black people from having a vote in "white South Africa" (even if they resided there) -- their voting rights being restricted to the black homelands. Black homelands were created in the least productive lands in the country. Education, medical care, and other public services were segregated, and those available to Black people were inferior. Their education system, within "white South Africa", was designed to ensure that they were only capable of serving as labourers to White industry.
In South Africa you will find that there is a huge seperation between rich and poor - the poor being mostly black. This is NOT because of their skin color or their culture, but because they were forced into this poverty by the government of their own country. This is very similar to what happened to African Americans in the USA. Its not just slavery that have held african americans back, its the laws that were around until 1965. And you may try to disagree with me, but discrimination is still around, infact, your living proof.
