  4. Learning the lingo here is important. By "visa application" are you referring to the petition? Because the petition is not a visa application, and there is no financial info submitted during the petition process. Suggest you read up and become an A student about the overall process, as pushbrk likes to say.
  5. Yes, you can. Just make sure that you clearly note that your spouse will apply for consular processing, not adjustment of status. I believe it is #62 or 63 on the online form? Those who accidentally mark it incorrectly must then file a form which adds time has a fee.
  6. Could be an issue. Not sure what you're looking for here. They have told you that a decision cannot be made yet. No senator can change that. You just have to wait.
  7. Please learn about the visa bulletin. The form processing is not applicable in your case. Sibling visas are taking like 20 years.
  8. I don't see any exceptional circumstances which would allow for DCF. You will need to file for consular processing. I think your timeline is reasonable, and I wouldn't expect any issues returning. You will want to make sure that you are all up to date on taxes.
  9. Do you have a compelling reason to expedite? Job lined up back home? You will need a real reason with documentation as to the need.
  10. One angle to approach this would be that regardless of whether the kids move to the US, if they are in fact USCs, they have the right to have US passports. Norway allows for dual citizenship, right? It is in everyone's best interest for them to have both if they can. Also, if he does move back to the US, it benefits him if they're there too, right?
  11. If they are US citizens, they are not eligible for visas. As uncomfortable as it may be, you have no choice but to confirm their citizenship first. If the ex remains in Norway, he will also need to be involved in you being legally allowed to take the kids out of the country.

  15. The immigrant visa will be valid for 6 months following the medical. Visiting the US ever 6-9 months is not adequate for LPRs. Sounds like you do not plan to live in the US as an LPR anytime soon? Perhaps delay the process until you are ready.
  16. You can book a one way-ticket on your fiancé’s return flight. You will not go through US immigration if you fly into Canada. You will obviously go through Canadian immigration. Some Canadian airports have what is knows as “pre-clearance,” which is just like going through US customs and immigration, but it is pre-flight. If the flight from Canada to the US departs from a pre/clearance airport, your K-1 will be processed at that time. Otherwise, it will be processed when your flight to the US arrives.
