I mailed them a copy of the final decree, some pictures of us, a personal statement explaining what happened, and three letters from my friends.     Yes

     

    Now I'm thinking.. We are on good terms not but what if down the road things get bad? What if he writes a truthful affidavit for me right now but then when USCIS contacts him later he changes his words? Does USCIS contact people who write affidavits?

    If I get rejected for ROC, how long time do I have to sell the house and belongings before I have to leave the US? If I get rejected before the extension letter expires, does that change my status expiration date? If I get rejected, if there's any room for appeal, because our marriage was really entered in a good faith?

    Thank you! I have a question regarding the text in green - based on the wording, is there a difference between proving the marriage was entered into bonafied intent, versus the marriage is real? I'm asking because if these two are different things viewed by USCIS, I might need to put more emphasis on the "entering" part, but before we got married, we didn't have any financial assets together or any joint filings. It's really just stories, texts, and pictures.

  5. Thank you all for your reply. I was thinking about going through the divorce waiver path but wasn't sure when I should do that. After reading your reply, I'm planning to do it next week.

     

    There doesn't seem to be a form about this? Should I write a letter/personal statement to USCIS? Or to the field office? My case hasn't been transferred to local office yet but I know there's a filed office in Detroit, where we had our AOS interview. 

     

    Should I also include new evidence since we filed jointly to prove the marriage was in good faith?

  6. Hello VJFamily!

     

    I’ve been lurking around since AOS and VJ has been so helpful. I’m posting today in need of some guidance as everything happened so fast.. My husband told me this Wednesday that he’s thinking about leaving me, and yesterday he told me that he’s moving out next Monday and will be filing a divorce. It all happened so fast!! My heart is broken because I still love him but there is nothing I can do now.

     

    We got married in June 2016 (he is a US citizen), same month we filed AOS, CGC arrived in September 2016, expiring JAN 2019. We filed ROC JOINTLY October 2018, received extension letter in Dec 2018, and now (JAN 2019) this happened.

     

    When we submitted ROC, we submitted the following evidence:

    • joint bank statements
    • joint credit card
    • joint mortgage
    • house contract (we built a house together) & house is under both of our names
    • tax returns filed jointly for two years
    • joint auto insurance
    • medical plan that covers both people
    • Affidavit from two mutual friends

     

    Since filing ROC jointly, we also went to DC (have tickets and other evidence), re-elected medical insurance (covering both people), had family Holidays (have group pictures). We also have been going through marriage counseling (but I thought things were going well!!) since March 2018, and have receipts/insurance claims/emails to prove.

     

    What’s the next step for me now? I haven’t done much research on the divorce (I never thought we would divorce…), but he told me that it would take 75ish days for the divorce to finalize. Should I notify the USCIS right now? Or should I wait for the divorce to finalize while start preparing materials to send to USCIS?

     

    He mentioned that if I need his testimony or something to approve this marriage was entered into good faith, he would do it - is this going to be helpful?

    Sherri, pretty much just gather up all the tax documents again. They lose things all the time from what I've read on here. Currently the Federal poverty line at 125% is $20,025 for a household of two. If he meets the required income requirements resubmit all of your supporting documentation and perhaps a note explaining. My husband makes well over the guidelines but it's none taxable income so we included the past 6 months wage slips and an explanation of where the income is made up from. *fingers crossed I'm not jinxing us here* but I personally think they look at specific places on forms and need a slight nudge to see what they may not be looking for.

    I got a RFIE this morning for AOS. I'm super confused right now and hoping that someone would shed some light on this situation :) (I was on F-1/OPT visa, and am filing AOS based on marriage)



    So the "reasons" I got were:



    - The "Sponsor's Household Size" on the petitioner/sponsor's Form I-864, Affidavit of Support (revision date 07/02/2015), was calculated incorrectly or not completed. A household size of 0 or 1 is not acceptable. (This one my hubby and I figured out - we made a stupid mistake...)



    - Submit all supporting tax documentation (W-2s, 1099s, Form 2555, and all supporting tax schedules) submitted to the Internal Revenue Service for the most recent tax year. The petitioner/sponsor must submit all supporting tax documents for the most recent tax year.


    We sent my husband's W2, 1099s, the entire tax return of 2015 including the supporting tax schedules (filed in Feb 2016), and the 2 most recent pay stubs to USCIS.. I'm not sure what is missing.... He doesn't have foreign income so Form 2555 was not applicable.


    - Based on the documents submitted with Form I-864, Affidavit of Support, for the petitioner/sponsor, the income did not meet 125% of the federal poverty line for the petitioner/sponsor's household size. Submit evidence of assets that meet the standards listed below or obtain joint sponsor. Assets standards must equal the stated difference between the sponsor's household income and 125% of the federal poverty line.


    This one is really confusing... Our household income is a lot higher than 12% of the federal poverty line, I'm confused where this is coming from..
