Californiansunset got a reaction from Nicey&T in USCIS cancels Interview the last minute
I don't know what kind of job you have but if I were in your situation I would just let my boss know that I won't have to take that day off and just come into work. That way it's not as bad if you need to take another day off once your interview is rescheduled. If questions are asked I'd explain the situation and I'm sure he'd understand.

Californiansunset got a reaction from miki0630 in Does RFE affect my EAD??
Mine reset the clock as well. I received my approval after like a total of 140 days, but 98 days after they had received my RFIE response. However I was told that USCIS tries to approve the EADs that got an RFIE around the 75days mark from the response receival, so I think I was an exception.
The RFie didn't seem to reset my processing time for the I-485 though. There are people with my field office waiting for the interview appointment who filed their papers last December and me, as a later Feb Filer with RFIE response in early April already got an interview appointment.
I feel like it's random whether the RFIE is going to affect your processing time or not.

I agree 100 percent, but he has said he is not ready. Advising him to do so,(not you but others) so that she could become legal sounds to me like deciding to get married for immigration purposes,. I am simply saying do not tie the 2 issues together marriage and immigration.

I actually heard that they can not marry an US citizen to stay because they technically don't have a legal status to adjust from now. Same goes for people who entered the US without inspection and then stayed... they can not marry a US citizen in order to become legal but have to first leave the country and have an interview at their consulate overseas... so same goes for DACA.

I have seen that a fair number of Immigration Lawyers are scum and just out to get as much money from as possible. So that's why they are trying to spread fear so that someone feels that they need to pay for an expensive lawyer to settle their case.

I'm not sure we're on the same page here. I said you can Google cheapest civil surgeon, which is literally the type of doctor the USCIS Find-a-Doctor tool looks for. This isn't an ambiguous term. Civil surgeon = immigration doc.

Not to be confused with the surgeon general, the person who's on all booze bottles warning you not to drink and operate machinery/drive at the same time.

Near me, the cheapest is Simon Lee in the Bay Area. His office is basically a cash-only I-639 mill. But a legal, government approved one.

This is completely up to the interviewing officer whether he/she wants to have a new medical or not. Yours will just have expired so the IO might just let it go and be fine with the 'old' medical. You can read so many cases and won't get a definite answer on the K1 medicals. Some officers go by the fact that as long as you filed AOS within one year of the medical, you are fine and others go by the rule that the interview must take place within the one year timeframe the medical is valid (which is the official USCIS rule). It's the question whether you potentially want to waste a couple hundred bucks to play it safe or rather wait but have the peace of mind that you won't get an RFE for that and can potentially have the greencard two weeks after the interview or not... it's personal preference I guess.

    1. No the EAD card will not be taken away at the interview because you will need it until you receive the greencard to show your ongoing proof of valid immigration status.
    2. You are right, as soon as you get approved for the greencard, the EAD technically becomes void which leaves you in some sort of a limbo if you were to travel abroad with EAD/AP but have not received your greencard yet. Yes, I've read that there might be the chance that she would get lots of problems at the border in this case, but then again I feel like this must happen quite often with people who just get waivers and might be abroad in the timeframe their adjustment gets approved. This must be a grey area but I've read that technically the EAD is void and you would need the greencard to enter, however they should still let you enter if it happens to fall into this odd timeframe...
    3. Also keep in mind that you could potentially get a RFE/RFIE at the interview for missing documents or even renewing the medical (if adjustment is from K1 visa and it's been over a year), so it would take a while until you get the greencard and then it would suck if it gets all of a sudden approved while you are abroad.

Obviously in the best case and likely scenario you will have the greencard in hand two weeks after the interview, it's just the question whether you want to play it safe and not book anything or go with the likely scenario.

Glad to hear this!  Yes collect evidence and go to the appointment, can't hurt. Always good to cover yourself just in case.
I truly hope your grandmother heals and you can spend some quality time with her. My grandmother lived to 97.
    Blessings!

Just wanted to post an update in case someone has the same issue that I had and is looking for an answer on VJ:

So six days after I made the service request over the phone, I saw online that they already completed it today and sent me the response via mail. Since I usually have to wait for USCIS mail a while (it took the interview letter 8 days) before it gets to me I called the USCIS hotline to have me transfer to a tier 2 officer to tell me the outcome of the service request (yes they can usually see the answer of the service request although they often pretend that they can't). He told me that USCIS honors my request to have it rescheduled and that they will let me know about a new date of the I-485 interview.
Obviously I am pleasantly surprised how fast and smooth this entire process was. On this past weekend I received pictures of my grandma's recent medical documents from my brother that describe her overall medical condition (almost completely blind, severe hip problems etc., it was a long list) and had started to prepare them in case I was asked to submit proof of a 'family emergency' (although they would've not completely justified a family emergency but I thought it would show that she has issues that recently appeared indicating that it's going downhill with her and that with a 93 year old you just never know when it could be the last time I can see her). They never asked for a reason or proof to submit though.

I still have my field office appointment here in San Diego in a week that I will still attend, just to speak to someone in person to make sure that my field office is aware that my husband and me won't be in town for the I-485 interview and that it was rescheduled. I guess I'm doing that more for my own peace of mind after reading the horror stories on VJ that the interviewing field office issued a 'no-show' because they didn't have a rescheduled interview on file. Plus I am hoping that there might be a tiny chance that the IO can tell me when I can approximately expect the new interview date.

I have my Advance of Parole as part of the EAD card so coming back shouldn't be an issue unless they would deny my AOS case for no reason while I am gone.

No it's San Diego. It has the same processing time as San Francisco though, so yes that was fast (hence why I booked the flights expecting to have the interview in November or December and not so early!!).
Thank you! Hoping it will work out rescheduling it... after reading the horror stories on VJ I'm a little terrified, but then again people post only when they have bad experiences and not good so I'm hoping for the best!

Was scheduled for the AOS interview next month... as I had already feared it falls into the period that I am home in Germany. I contacted USCIS and asked to have it rescheduled and am waiting now for an answer. If anyone has experience with this please let me know!

Also this shows that USCIS is randomly giving appointments for the interview. Another person with my field office who filed in December just got his interview for September, just two days before mine. Four others in the January forum with the same field office are still waiting on having theirs scheduled. I filed on Feb 27th with an RFIE response in April and already have my interview scheduled. There seems to be no way to anticipate when you get your interview.

Emphasize the reason your need to take the visit home not so much the cost. It's a factor but the reason for the trip is the real reason for the reschedule request. Definitely take the evidence with you just in case. They didn't look at any of ours but it's good to have it with you.

I wouldn't reschedule the AOS interview but that's just me. I personally never rescheduled any interviews. Maybe someone else can share their expertise.

Would you be able to change the date of your flight? Or maybe you have travel insurance to get a refund for the plane ticket?

I hope your grandmothers are doing OK and have support from the rest of the family who is there.

Yes we rescheduled our AOS interview.  It was not difficult.  We were rescheduled for another appointment right away and within a few weeks of our original appointment.  When we got to the interview and I attempted to apologize for rescheduling the IO stopped me, waved his hand in the air, and said "no big deal".  We were approved the next day. Our field office was Cleveland.
Someone very recently posted a topic on this same issue.  You can use the search tool to find that thread and see the responses.

Which sorts of comments?  Asking you about you or what I said about the OP?

About you - like I said I read your comments and the others. It just seems you always throw in a condescending jab at liberals, democrats, the left, etc and then the thread spirals into a ####### for tat.  Very similar to this thread so I guess that's why I decided to ask now since it's been on my mind. In this particular thread you are the only one making jabs at democrats and the stupidity of Obama. You have every right to free speech.  I'm just wondering why you feel the need to take it there constantly? You can agree/disagree without the insulting comments. It doesn't matter what others do. Whining about trump has nothing to do with you making insulting comments to others. I liked Obama very much. When people whine and make ridiculous statements about him I don't feel the need to make insulting comments about republicans, the right, conservatives, etc. I was just wondering why.  You don't have to answer.

Posts that are in another language besides English and are not posted in the country's forum are likely going to be deleted by one of the mods. Write this post in English....especially if you want people to help you as the chances of finding someone that can answer you are a lot bigger if you write your question in English!

To answer your question: I would probably mention it somewhere. Just in case so it doesn't fire back eventually claiming that you were trying to hide that fact.
